About procedure for creation and the organization of activities of Coordinating committees of assistance of employment of the population

According to article 11 of the Law of the Republic of Tajikistan "About assistance of employment of the population" and for the purpose of development of agreed decisions and to establishing social dialogue by determination and implementation of policy of employment of the population the Government of the Republic of Tajikistan decides:

1. Approve the Provision, structure of republican Coordinating committee of assistance of employment of the population and the Rule of creation and the organization of activities of local coordinating committees of assistance of employment of the population (appendices 1, 2, 3).

2. To chairmen of the Gorno-Badakhshan Autonomous Region, areas, the city of Dushanbe, cities and areas on the basis of these Rules in two-month time to approve Regulations on local coordinating committees of assistance of employment of the population, to determine staff of committees and to organize their practical activities.

3. To provide to the Ministry of Labour, migration and employment of the population of the Republic of Tajikistan methodical management of activities of coordinating committees of assistance of employment of the population at the regional level.

4. Declare invalid the order of the Government of the Republic of Tajikistan of March 31, 2004, No. 133 "About the Procedure for the organization of activities of coordinating committees of assistance of employment of the population".

Regulations on Republican coordinating committee of assistance of employment of the population

I. General provisions

1. The coordinating committee of assistance of employment of the population (further Committee) is created according to article 11 of the Law of the Republic of Tajikistan "About assistance of employment of the population".

2. The committee is created for the purpose of development of agreed decisions, offers and recommendations, to establishing social dialogue by determination and implementation of policy of employment of the population in the Republic of Tajikistan within social partnership.

3. In the activities the Committee is guided by the Constitution of the Republic of Tajikistan, the laws and other regulatory legal acts of the Republic of Tajikistan, the international legal acts recognized by the Republic of Tajikistan, the orders of the Government of the Republic of Tajikistan, the Ministry of Labour, migration and employment of the population of the Republic of Tajikistan and this Provision.

II. Main functions of Committee

4. The state body of employment of the population coordinates activities, the companies and the organizations it is not dependent on patterns of ownership on employment of the unoccupied population.

5. Develops recommendations about enhancement of mechanisms of regulation of the labor market.

6. Organizes actions for non-admission of mass release of workers.

7. Exercises control of development and program implementation of "Assistance of employment of the population".

9. Organizes actions for prevention of increase in the level of unemployment in the republic.

10. Establishes quotas to the companies and the organizations for employment of disabled people and separate groups of citizens.

11. Develops for implementation of policy of employment of the population and makes decisions in the following directions:

estimates of market situation of work and the forecast in the field of employment;

coordination of activities of employers, public organizations and executive bodies of the government in the field of employment of the population;

programs of employment and to questions of financial provision of policy of employment;

- developments of system of professional training for the labor market;

- professional training and other support of workers which employment is complicated because of specifics of profession or to other reasons;

- assistance of employment of the citizens experiencing difficulties in job search;

- assistance of business activity, employment on social and temporary works;

- financial support of the dismissed workers;

- labor migration, attraction and use of foreign workers;

- developments of collateral actions "in case of threat of mass vysvobozhdeniye;

- control of accomplishment of decisions of Committee;

- to forming of standing and temporary groups on conducting social examination of drafts of social and economic programs regarding their influence on creation and jobs preservation.

III. Rights of Committee

12. The committee has the right:

- consider and approve programs of assistance of employment of the population, and also the program for mitigation of the consequences of mass vysvobozhdeniye, creation of conditions for retraining and further employment of the released workers;

- request from employers information on expected structural changes and other actions from which release of workers, and also data on manpower requirement, on the number of the released and dismissed workers can result;

- develop and send to the Government of the Republic of Tajikistan offers on measures for employment of separate categories of the citizens experiencing difficulties in job search (disabled people, youth, parents of large families, single mothers, pupils);

- make recommendations in collective agreements of the companies, organizations for inclusion of the actions directed to assistance of employment of the released workers and to provision of additional social and material guarantees to workers in the conditions of mass release, to determine sources of their financing;

- make in the Government of the Republic of Tajikistan offers on reservation of workplaces for the citizens experiencing difficulties in job search;

- exercise control of execution of programs of assistance of employment of the population, provide work market information in mass media.
