About procedure of the preventive actions directed to prevention of approach of insured events

(as amended on 16-12-2011)

 According to article 11 of the Law of Ukraine "About obligatory national social insurance on unemployment case" and Item 13 of the Fund charter of obligatory national social insurance of Ukraine on unemployment case board of the DECIDES: Fund

Approve enclosed:

1.1. Procedure for financing of expenses of the employer on compensation of workers who for the purpose of prevention of release are temporarily translated in their consent to other work (up to 6 months for year) on condition of preserving principle place of employment behind them.

1.2. Procedure for financing of expenses of the employer on occupational retraining or advanced training of workers concerning which there is threat of release in connection with reorganization or reshaping of the company, temporary cessation of production on condition of preserving for workers of place of employment.

2. To submit to executive directorate of Fund the resolution of board on state registration to the Ministry of Justice of Ukraine.

Procedure for financing of expenses of the employer on compensation of workers who for the purpose of prevention of release are temporarily translated in their consent to other work (up to 6 months for year) on condition of preserving principle place of employment behind them

I. General provisions

1.1. The procedure for financing of expenses of the employer on compensation of workers who for the purpose of prevention of release are temporarily translated in their consent to other work (up to 6 months for year) on condition of preserving principle place of employment behind them (farther the Procedure) is developed according to the Law of Ukraine "About obligatory national social insurance on unemployment case" and is directed to prevention of approach of insured events.

1.2. The procedure determines conditions, funding mechanism by fund of obligatory national social insurance of Ukraine on unemployment case (further - Fund) parts of expenses of the employer on compensation of workers which for the purpose of prevention of release are temporarily translated in their consent to other work (in addition created workplace (places)) on condition of preserving behind them principle place of employment, and also control of use of fund and employment security of these workers.

1.3. In this Procedure terms are used in such value:

principle place of employment - the workplace determined by the employer to the worker on whom he works for the moment of approach of insurance risk;

insurance risk - circumstances as a result of which persons can lose work and will need material support and social services according to the Law of Ukraine "About obligatory national social insurance on unemployment case";

in addition created workplace (places) - workplace which in addition, for up to 6 months, is created by the employer for temporary (up to 6 months for year) the translation of the worker in its consent with the purpose of prevention of its release;

regional jobcenters - jobcenter of the Autonomous Republic of Crimea, regional, Kiev and Sevastopol city jobcenters to which functions of working bodies of executive directorate of Fund are assigned;

basic jobcenters - district, gorrayonny and district in the cities, city jobcenters to which functions of working bodies of executive directorate of Fund are assigned;

the temporary termination of activities is forced temporary reducing normal or established at the employer according to the legislation the Ukraine duration of working hours which arises on circumstances, independent of the employer, has no regular or seasonal character and is inevitable.
