About the state support and features of functioning of the children's centers "Artek" and "Young Guard"

Article 1. Basic principles of the state support of the children's Centers "Artek" and "Young Guard"

1. The state provides support of the state companies "The international children's center "Artek" (further - the children's center "Artek") and "The Ukrainian children's center "Young Guard" (further - the children's center "Young Guard") as institutions of improvement and rest of children of nation-wide value by establishment of tax benefits, determination of features of legal regime of the property assigned to these children's centers on the right of economic maintaining, and the parcels of land provided to them in permanent use.

2. Funds for acquisition of permits in the children's centers "Artek" and "Young Guard" for improvement and rest of children are annually provided in the Government budget of Ukraine.

The state redeems:

90 percent of permits of the children's center "Artek". Other permits are implemented by the specified children's center without involvement of the third parties;

100 percent of permits of the children's center "Young Guard".

Article 2. Features of legal regime of property and parcels of land of the children's centers "Artek" and "Young Guard"

1. The children's centers "Artek" and "Young Guard" are not subject to privatization.

The property assigned to the children's centers "Artek" and "Young Guard" on the right of economic maintaining is not subject to alienation and also transfers to lease (except transfer to lease for placement of pharmaceutical booths, technical constructions of communication, ATMs).

2. The territories in which the children's centers "Artek" and "Young Guard" are located belong respectively to natural reserved fund of nation-wide value and recreational lands with the building right only for requirements satisfaction of the specified children's centers according to the master plan of their development which affirms the Cabinet of Ministers of Ukraine.

The parcels of land the hectare 216,6423 size (including 5, hectare of the beach area, 2,8 of hectare of the former boarding house "Aue-Dag" with the beach area) provided in permanent use to the children's center "Artek", and the hectare 33,9 size (including 0,95 of hectare of the beach area), provided in permanent use to the children's center "Young Guard" belong to lands of state-owned property and are not subject to alienation.

3. The children's centers "Artek" and "Young Guard" are forbidden to act as founders of the companies with the mixed pattern of ownership, to sign contracts about joint (in particular investment) activities, commission agreements, orders, property administrations, concessions which consequence alienation of state-owned property can be.

4. Establishment of the servitude concerning the property assigned to the children's centers "Artek" and "Young Guard" on the right of economic maintaining and also concerning the parcels of land provided to these children's centers in permanent use is forbidden.

Article 3. Final provisions

1. This Law becomes effective from the date of its publication.

2. Make changes to the following laws of Ukraine:

1) ceased to be valid;

2) ceased to be valid.

3. Write off the tax debt which arose for January 31, 2009 from the children's centers "Artek" and "Young Guard".

4. To consider debt of the children's center "Artek" in the amount 16, 2 million hryvnias before the state company "Ukrinveststroy" which is in management of Public administration of cases written off since January 31, 2009.

5. Forbid construction of apartment houses in the territory of the children's center "Artek" and recognize necessary settling out of the citizens living in already built houses with provision of compensation by it in the form of living space using 1,5 coefficient.

To Council of Ministers of the Autonomous Republic of Crimea to resolve in accordance with the established procedure issue concerning settling out of residents and in case of requirement of demolition of the apartment houses located in the territory of the children's center "Artek".

6. Prices/rates for housing and communal services, services on gazo-and to electric utility service which are used for own requirements of the children's centers "Artek" and "Young Guard" are established at the level of prices/rates for the population.

To provide to Council of Ministers of the Autonomous Republic of Crimea, the Yalta and Odessa city councils, the Ministry of Fuel and Energy of Ukraine, the National commission of regulation of power industry of Ukraine adoption of relevant decisions.

7. To consider the objects constructed by the children's centers "Artek" and "Young Guard" in 2000-2008 put into operation from the date of entry into force of this Law.

To issue to the Ministry of Regional Development and Construction of Ukraine, the Ministry of questions of housing and communal services of Ukraine, Council of Ministers of the Autonomous Republic of Crimea the documents on completion of construction of the specified objects established by the legislation without application of penalties.
