About hydrometeorological activities

This Law determines the legal basis of conducting observations, researches and works of active impact on atmospheric processes, developments, uses and protection of data by hydrometeorology and monitoring of the environment in the Azerbaijan Republic.

Chapter I. General provisions

Article 1. Basic concepts

The concepts used in this Law have the following values:

hydrometeorological activities - the works and services connected with conducting observations, researches and works of active impact on atmospheric processes, collection, the analysis, development, storage, transfer and scientific and technical providing data on meteorology, aviameteorology, agricultural meteorology, hydrology, oceanology, climatology and monitoring of the environment;

national system on hydrometeorology - set of the companies, organizations and organizations operating in the territory of the Azerbaijan Republic, conducting observations and researches developing data on hydrometeorology and monitoring of the environment and exercising the state control of hydrometeorological activities;

monitoring of the environment - system of the regular observations and researches determining chemical composition, extent of pollution, radioactivity, hydrobiological features, physical properties of the air, water, soil circle for the purpose of assessment and forecasting of condition of this environment.

network of observation - set of the centers, observatories, stations, the research ships, laboratories, gages, technical complexes and other observation posts on meteorology, aviameteorology, agricultural meteorology, hydrology, oceanology, climatology and monitoring of the environment;

the state fund of data of the Azerbaijan Republic for hydrometeorology and monitoring of the environment - collection of data of national state hydrometeorological system, international and space meteorological systems on meteorology, aviameteorology, agricultural meteorology, hydrology, oceanology, climatology and monitoring of the environment;

data on the hydrometeorological phenomena and degree of extreme impurity of the environment capable to generate catastrophic crashes - actual data and data of forecast nature on the emergencies arising in the atmosphere on the land surface and water objects, and on high impurity of the environment;

data of special purpose - the data on hydrometeorology and pollution of the environment developed according to needs of consumers;

target hydrometeorological works - observations, researches and developed data on hydrometeorology and pollution of the environment which are kept according to the order of legal entities and physical persons;

works on active impact on atmospheric processes - fight technical means against hail, artificial overhead irrigation and other measures of fight against natural hazards.

Article 2. Legislation of the Azerbaijan Republic on hydrometeorological activities

The legislation of the Azerbaijan Republic on hydrometeorological activities consists of this Law and other regulatory legal acts adopted according to it.

The water, land, property, nature protection and other relations arising in connection with hydrometeorological activities are governed along with this Law and other corresponding legal acts of the Azerbaijan Republic.

Article 3. Objects and subjects of legal relations in the field of hydrometeorological activities

Objects of legal relations in the field of hydrometeorological activities are:

1. airspace over the Azerbaijan Republic;

2. the soil and vegetable cover which is in the territory of the Azerbaijan Republic;

3. internal waters of the Azerbaijan Republic and water area of the Caspian Sea (lake).

Subjects of legal relations in the field of hydrometeorological activities are the Azerbaijan Republic, Nakhchivan Autonomous Republic, municipalities, producers and consumers of data on hydrometeorology and monitoring of the environment.

Relevant organs of the executive authority participate in legal relations in the field of hydrometeorological activities on behalf of the Azerbaijan Republic and Nakhchivan Autonomous Republic.

Municipalities participate in legal relations in the field of hydrometeorological activities within the powers conferred to them by the legal acts determining their status.

Producers and consumers of data on hydrometeorology and monitoring of the environment participate in legal relations in the field of hydrometeorological activities in stipulated by the legislation procedure for the Azerbaijan Republic for the purpose of implementation of business activity and satisfaction of the requirements.

Article 4. Producers and consumers of data on hydrometeorology and monitoring of the environment

Legal entities irrespective of pattern of ownership, citizens of the Azerbaijan Republic and foreign states and persons without citizenship (further - legal entities and physical persons) who are engaged in hydrometeorological activities according to the procedure, established by the legislation of the Azerbaijan Republic, are producers of data on hydrometeorology and monitoring of the environment.

Customers and users the data on hydrometeorology and monitoring of the environment are consumers of these data.

Conditions of development, acquisition, use of data on hydrometeorology and monitoring of the environment, the mutual rights and obligations of the Parties are determined based on the agreements signed between producers and consumers.

Article 5. Accounting of physical persons and state registration of the legal entities who are engaged in hydrometeorological activities

Accounting of physical persons and state registration of the legal entities who are engaged in hydrometeorological activities is performed according to the legislation of the Azerbaijan Republic.

Chapter II. Management in the field of hydrometeorological activities

Article 6. Obligations of the state in the field of hydrometeorology

Obligations of the state in the field of hydrometeorology:

1. organize conducting observations and researches, development of data on hydrometeorology and pollution of the environment in the extreme cases resulting from natural disasters, technogenic catastrophes and artificial impacts and their transfer to relevant organs;

2. organize development of operational forecasts and the notification of relevant organs about the beginning, strengthening and duration of the dangerous hydrometeorological phenomena;

3. provide the relevant state bodies, the population, subjects of media and separate industries of economy with regime, polling, actual and forecast data, the warning of the expected natural hazards and on high degree and danger of pollution of the environment;

4. perform meteorological providing civil and military aviation;

5. carry out works on active impact on atmospheric processes, protection of the state supervisory network;
