The agreement between the Government of the Russian Federation and the Government of the Azerbaijan Republic on cooperation in the field of the prevention and liquidation of emergency situations

of January 9, 2001

The government of the Russian Federation and the Government of the Azerbaijan Republic which are hereinafter referred to as with the Parties

aiming at strengthening of the traditional friendly relations between two people according to the Treaty of friendship, cooperation and mutual safety between the Russian Federation and the Azerbaijan Republic of July 3, 1997,

recognizing that the cooperation in the field of the prevention and liquidation of emergency situations will help welfare and safety of both states,

understanding danger which is born for both countries by emergency situations,

considering that exchange of scientific and technical information in the field of the prevention and liquidation of emergency situations is of mutual interest,

proceeding from the coherence of ecological systems of both countries requiring implementation of interaction according to the prevention and liquidation of emergency situations, and also the organization of monitoring of the environment

in view of possibility of emergency situations which cannot be liquidated by forces and means of one of the Parties, and the need for the coordinated actions of both states for the purpose of the prevention and liquidation of emergency situations,

agreed as follows:

Article 1. Determinations

The terms used in this agreement mean the following:

"the requesting Party" - the Party which appeals to other Party about the direction of groups on assistance, equipment and materials of providing;

"the providing Party" - the Party which grants request of other Party for the direction of groups on assistance, equipment and materials of providing;

"competent authority" - the body appointed by each of the Parties for management and coordination of the works connected with implementation of this agreement;

"group on assistance" - the organized group of specialists of the providing Party intended for assistance and provided with necessary equipment;

"emergency situation" - the situation in certain territory of the states of the Parties which developed as a result of accident, natural hazard, catastrophic crash, natural or other disaster which can entail or entailed the human victims, considerable material losses and violation of conditions of life activity of people, can cause or caused damage to health of people or the surrounding environment;

"the prevention of emergency situations" - complex of the events held beforehand and directed to the greatest possible reduction of risk of emergence of emergency situations, and also to preserving human health, decrease in the extent of damage to the surrounding environment and material losses in case of their origin;

"liquidation of emergency situation" - the rescue and other urgent works which are carried out in case of emergency situation and directed to rescuing of life and preserving human health, decrease in the extent of damage to the surrounding environment and material losses and also on localization of zone of emergency situation, cancellation of characteristic factors, dangerous to it;

"zone of emergency situation" - the territory in which there was emergency situation;

"wrecking" - actions for rescuing of people, material and cultural values, protection of the surrounding environment in zone of emergency situation, localization of emergency situation and to suppression or bringing to minimum possible level of characteristic factors, dangerous to it;

"equipment" - materials, technical and vehicles, equipment of group on assistance and personal equipment of members of group;

"providing materials" - the appliances intended for distribution among the population injured with emergency situation.

Article 2. Competent authorities

For implementation of this agreement of the Party appoint the following competent authorities:

from the Russian Side - the Ministry of the Russian Federation for civil defense, to emergency situations and natural disaster response;

from the Azerbaijani Side - State commission of the Azerbaijan Republic on emergency situations.

In case of appointment of other competent authority of the Party in writing will notify each other on it through diplomatic channels.

Article 3. Forms of cooperation

The cooperation within this agreement provides:

organization and implementation of monitoring of dangerous technogenic and natural processes;

forecasting of emergency situations and assessment of their effects;

the organization of preparation of the population for actions in emergency situations, including on first aid;

risk assessment for the environment and the population in connection with possible pollution as a result of industrial accidents, catastrophic crashes and natural disasters;

collaborative planning, development and implementation of research projects, exchange of scientific and technical literature and results of research works;

exchange of information, periodicals, methodical and other literature, video and photographic materials, and also technologies;

organization of joint conferences, seminars, working meetings, doctrines and trainings;

preparation of joint publications and reports;

training of specialists in educational institutions of other Party, exchange of trainees, teachers, scientists and specialists;

ensuring communication between competent authorities of the Parties;

rendering mutual aid in case of equipment by the equipment, property and equipment;

planning and holding actions for the prevention and liquidation of emergency situations;

rendering mutual aid in case of liquidation of emergency situations;

other activities in the field of the prevention and liquidation of emergency situations which can be approved by competent authorities of the Parties.

This agreement does not extend to cooperation in the field of search and rescuing of people, in distress at the sea.

Article 4. Cooperation between the organizations and organizations of the Parties

The parties can where it is reasonable, to encourage cooperation between the state bodies, government and non-governmental institutions and the organizations, legal entities and physical persons performing activities in the field of the prevention and liquidation of emergency situations.

Article 5. Joint commission

For implementation of actions on accomplishment of this agreement competent authorities of the Parties will found the joint commission on cooperation in the field of the prevention and liquidation of emergency situations, will determine its structure, functions and operating procedure.
