The government of the Russian Federation and the Cabinet of Ministers of Ukraine which are hereinafter referred to as by the Parties

recognizing need of preserving the surrounding environment and rational use of natural resources,

according to the Agreement between the Russian Federation and Ukraine on the status and conditions of stay of the Black Sea Fleet of the Russian Federation in the territory of Ukraine of May 28, 1997 and the Agreement between the Government of the Russian Federation and the Government of Ukraine on the settlement connected with the Section of the Black Sea Fleet and stay of the Black Sea Fleet of the Russian Federation in the territory of Ukraine of May 28, 1997.

agreed as follows:

Article 1

The Russian side from signature date of this agreement and throughout all term of stay of the Black Sea Fleet of the Russian Federation in the territory of Ukraine:

Provides observance by the Black Sea Fleet of the Russian Federation of requirements of the current legislation of Ukraine in the field of protection of the surrounding environment, radiation safety and rational use of natural resources. Payments for emissions, dumpings of pollutants, placement of waste by military forming, courts, the companies, the organizations and organizations of the Black Sea Fleet of the Russian Federation and compensation of ecological damage, except emergency cases, the Black Sea Fleet of the Russian Federation connected with stay in the territory of Ukraine, are part of compensation payments of the Russian Federation to Ukraine that is provided by the Agreement between the Government of the Russian Federation and the Government of Ukraine on the settlement connected with the Section of the Black Sea Fleet and stay of the Black Sea Fleet of the Russian Federation in the territory of Ukraine of May 28, 1997.

Allows according to Regulations on procedure Ukraine of the state environmental control in places of basing of the Black Sea Fleet of the Russian Federation in the territory of Ukraine which is integral part of this agreement, visit by officials of state bodies of Ukraine on protection of the surrounding environment of military forming, courts, companies, organizations and organizations of the Black Sea Fleet of the Russian Federation in the territory of Ukraine.

Informs regional authorities and state bodies of Ukraine on protection of the surrounding environment immediately on all emergencies of ecological nature including connected with use of sources of ionizing radiation and also on delivery to military forming and to vessels, the companies, to the organizations and organizations of the Black Sea Fleet of the Russian Federation in the territory of Ukraine of new sources of ionizing radiation and highly toxic substances and on their movement on the territory of Ukraine.

Takes the measures for mitigation of consequences of emergency pollution of the surrounding environment approved with regional authorities military forming, courts, the companies, the organizations and organizations of the Black Sea Fleet of the Russian Federation and indemnifies loss according to the procedure, provided for similar objects of Ukraine.

Represents in the procedure established by the current legislation of Ukraine statistical data on emissions and dumpings of pollutants into the surrounding environment and placement of waste.

Approves in the procedure established by the current legislation of Ukraine construction projects and reconstruction of nature protection constructions and objects in places of stay of the Black Sea Fleet of the Russian Federation in the territory of Ukraine.

Article 2

The Russian side shall:

till 2005 to provide construction (reconstruction) and commissioning of necessary quantity of floating and stationary objects for acceptance and purification of lyalny waters, technical, household and food wastes from the ships and vessels of the Black Sea Fleet of the Russian Federation in the territory of Ukraine;

till 2012 to carry out additional equipment of the ships and vessels belonging to it by water treatment technical means, reservoirs for accumulating, systems and devices for issue of ship waste.

Article 3

The parties shall:

take measures for prevention of pollution of the surrounding environment, and also perform actions for elimination of effects of the pollution allowed by the Black Sea Fleet of the former USSR in the past and to improvement of ecological condition in places of joint basing of the Black Sea Fleet of the Russian Federation and Naval forces of Ukraine. The amount, procedure, financing and terms of holding actions are determined by the Parties;

in case of joint use of nature protection constructions in case of need to carry out construction (reconstruction) of objects of the sewerage, water - and gas-purifying constructions of petroleum storage depots, heating plants.

Financing of designing, construction (reconstruction) of joint nature protection objects is performed due to equity of the Parties in proportion to amounts of dumpings (emissions) of pollutants and formations of waste. The amount of equity is determined in each case by the Parties.

Article 4

The Ukrainian Side conducts ecological examination and examination of the territories of places of basing of military forming, the companies, organizations and organizations of the Black Sea Fleet of the Russian Federation in the territory of Ukraine for the purpose of determination of their actual state, development in need of actions for elimination of effects of pollution and does not make claim to the Russian Side for the allowed environmental pollution by the Black Sea Fleet of the former USSR. Representatives of the Russian Side take part in this work. Results of inspection, examination and the actions plan are drawn up by protocols and signed by agents of the parties.

Article 5

Disputes on interpretation and application of provisions of this agreement are permitted by the Mixed Russian-Ukrainian commission which creation is stipulated in Article 24 Agreements between the Russian Federation and Ukraine on the status and conditions of stay of the Black Sea Fleet of the Russian Federation in the territory of Ukraine of May 28, 1997.

Article 6

This agreement becomes effective from the date of the last written notice of accomplishment of the interstate procedures by the Parties necessary for its entry into force, and is effective during all term of stay of the Black Sea Fleet of the Russian Federation in the territory of Ukrainy*.

It is made in Moscow on December 18, 1998 in duplicate, everyone in the Russian and Ukrainian languages, and both texts are equally authoritative.
