1. Approve the enclosed Regulations on Committee of fishery of the Ministry of Agriculture of the Republic of Kazakhstan.

2. This order becomes effective from the date of signing.

Regulations on Committee of fishery of the Ministry of Agriculture of the Republic of Kazakhstan

1. General provisions

1. The committee of fishery of the Ministry of Agriculture of the Republic of Kazakhstan (further - Committee) is the department and authorized body within competence of the Ministry of Agriculture of the Republic of Kazakhstan performing realizable, control functions in the field of fishery, assigned to it by the Constitution, the laws, other regulatory legal acts of the Republic of Kazakhstan and this Provision.

The committee has territorial authorities - regional territorial inspections of fishery, interregional basin inspectorates of fishery.

2. The main objectives of Committee are:

1) ensuring realization of the state and regional policy, strategic plans, state and other programs and projects concerning fishery;

2) ensuring the state control of protection, reproduction and use of fish resources and other water animals and maintaining fishery;

3) ensuring management of fishery and state regulation of fishery and fish-breeding and reproduction activities.

3. The committee in the activities is guided by the Constitution of the Republic of Kazakhstan, the laws of the Republic of Kazakhstan, acts of the President and the Government of the Republic of Kazakhstan, other regulatory legal acts, and also this Provision.

The committee is the legal entity subordinated to the Ministry, in form of business of public institution, has seal and stamps with the name in state language, forms of the established sample, and also according to the legislation of the account in bodies of Committee of treasury of the Ministry of Finance of the Republic of Kazakhstan and banks.

The committee enters the civil relations from own name.

The committee has the right to act as the party of the civil relations on behalf of the state if it is authorized on it according to the legislation.

5. The structure and limit of the number of staff of Committee affirm the Responsible secretary of the Ministry after coordination with the Minister of Agriculture of the Republic of Kazakhstan.

2. Functions and rights of Committee

10. The committee performs the following functions:

1) realizes state policy of field of protection of reproduction and use of fauna regarding fish and other water animals;

3) keeps the state account, the inventory of fish resources and other water animals, including the rare and being under the threat of disappearance species of fish and other water animals;

5) participates in the edition of the Red List of the Republic of Kazakhstan;

6) is performed by monitoring of fish resources and other water animals;

7) is provided by implementation of protection, reproduction and rational use of fish resources and other water animals;

8) establishes separate quotas for accomplishment, the state order in case of scientific research in the field of protection, reproduction and use of fish resources and other water animals;

9) issues permissions to use of fish resources and other water animals;

10) performs issue of brand for trade in caviar of sturgeon species of fish;

11) issues permissions to opening of new fishery sites, Tonja, alloys and plav in the rivers;

12) issues permissions to fishing and other water animals and signs contracts on use of fish resources and other water animals;

13) issues import permits and evacuation of fishes, their parts and derivatives, including types of the water animals referred to category rare and who are under the threat of disappearance, according to the procedure, established by the legislation of the Republic of Kazakhstan;

14) issues permissions to use of new tools and methods of fishing, and also fishing tools with cell of the smaller sizes provided by the corresponding standard rates;

15) distributes quotas for withdrawal of objects of fauna (regarding fish resources and other water animals) based on the approved limits, except for quotas for subjects of fishery on the fixed fishery reservoirs and (or) sites of local value;

16) will be organized by activities for introduction, and also for artificial cultivation of the rare and being under the threat of disappearance species of fish and other water animals;

17) will organize works on ensuring protection, reproduction and the state accounting of fish resources in reserve fund of fishery reservoirs (sites);

18) exercises the state control in the field of protection, reproduction and use of fauna (regarding fish resources and other water animals);

19) No. 362 Is excluded according to the Order of the Minister of Agriculture of the Republic of Kazakhstan of 01.06.2010

20) is checked by activities of users of fish resources and other water animals for the purpose of determination of observance of requirements of the legislation of the Republic of Kazakhstan in the field of protection, reproduction and use of fish resources and other water animals;

21) is performed by production on cases on administrative offenses within the competence established by the laws of the Republic of Kazakhstan;

22) approves the fish-breeding and meliorative and technical actions providing improvement of condition of water objects and water management constructions or their parts;
