About fundamentals of town planning

This Law creates the legal base of town-planning activities in the field of effective forming of systems of resettlement, planning, building and improvement of the territories, the cities and other settlements, development of their production, social, engineering, transport infrastructures, rational environmental management, preserving historical and cultural heritage and the environment, governs the town-planning relations, establishes powers of state bodies, physical persons and legal entities in town-planning activities for the purpose of ensuring life activity of the population with favorable conditions.

Chapter I. General provisions

Article 1. Basic concepts

The basic concepts used in this Law express the following values:

the town planning (town-planning activities) is activities of relevant organs of the executive authority, legal entities and physical persons in planning, design, construction and reconstruction of town planning with condition of effective placement of production forces and taking into account national, cultural and historical peculiarities, environmental, geological, hydrogeological, seismic requirements in the territorial and space organization of system of resettlement;

the urban policy is purposeful activities of the state in the field of town planning on creation of the favorable habitat of the population taking into account historically created systems of resettlement, national traditions and other local features, perspectives of social and economic development of society, climatic and ecological conditions;

the town-planning forecast - identification of the direction of development of the territories, the cities and other settlements in analysis result of conditions of town planning, economic, social, ecological, technical situation, the existing condition production, social, engineering (water, the sewerage, heating, gas, electricity, communication, etc.) and transport infrastructures;

the town-planning program is the documents covering the comprehensive plans and measures providing for the purpose of achievement of good results in town planning complex assessment of condition of town planning, rational use of the earth and natural resources, preserving national, historical and cultural heritage;

town-planning documentation is project documents on development planning and the buildings of the territories and settlements providing implementation of town-planning programs and forecasts, and also investments;

the state regulations and rules of town planning are the regulatory legal acts and normative and technical documents which are observed in town-planning activities constituted and approved by relevant organ of the executive authority;

town-planning regulations are requirements of rules of construction to types of use of the parcels of land and other real estate and to the forthcoming changes in limits of zones of the cities and other settlements when implementing town-planning activities;

sustainable and harmonious development of the territories and settlements is the town-planning activities performed for the purpose of rational use of the environment and restriction of the economic and other activity making on it harmful effects, creations of permanent favorable conditions for accommodation of the population;

the master plan is the town-planning document connected with social and economic development of the country, constituted for long term establishing planning framework of the cities and other settlements, living, industrial, utility and other functional areas, development production, social, engineering (water, the sewerage, heating, gas, electricity, communication, etc.) and transport infrastructures, the principles of protection and use of the environment, historical and cultural heritage;

the mezhselenny territory is the territory remaining outside the borders of the inhabited place established by the master plan;

the state town-planning inventory is complex assessment of the territory and set of its quantitative and qualitative indexes for adoption of relevant decisions in town-planning activities, including both registration, and accounting of lands and other real estate in the inhabited places;

the real estate in town planning are the territories of the cities and other settlements and their functional zones with the established borders, the constructions which are under them and on them, buildings, engineering and transportation networks and systems, long-term plantings;

the system of resettlement is the space organization of the interconnected cities and other settlements providing labor, social and spiritual needs of the population, protection, recovery and improvement of the environment;

the recreational territories are the territories allocated for rest and recovery of population health, and complexes created for this purpose;

production, social, engineering, transport infrastructures are industrial enterprises, objects of agricultural industry, water supply, necessary for sustainable and harmonious development of settlements, sewer, heating, gas, electric, communications, etc. the engineering, transportation networks and systems, objects of social and cultural and community servicing of the population established by the state town-planning regulations and rules;

zoning is division of the cities and other settlements the master plan on functional zones;

red lines are the borders separating streets and transport drives, the areas the parcels of land of other elements of planning structure of areas, residential districts, quarters of the cities and other settlements;

lines of regulation are lines of placement of buildings, structures and constructions from the red line or lot lines according to normative and technical requirements;

the cultural landscape is the picturesque earth surfaces created as a result of human activity;

the town-planning relations - interaction of subjects of town-planning on creation, development, reconstruction and protection of objects of town-planning.

Article 2. Legislation of the Azerbaijan Republic on fundamentals of town planning

The legislation of the Azerbaijan Republic on fundamentals of town planning consists of the Constitution of the Azerbaijan Republic, this Law, other regulatory legal acts of the Azerbaijan Republic and interstate agreements supported by it.

In case of contradictions between this Law and interstate agreements supported by the Azerbaijan Republic these interstate agreements are applied.

Article 3. Main directions of town-planning activities

The main directions of town-planning activities are:

placement of productive forces and forecasting and design of the territorial organization of systems of resettlement taking into account state of environment;

preparation of suggestions for improvement of administrative-territorial division of the Azerbaijan Republic for the purpose of effective use of the territories which are a part of the system resettlements of the cities and the inhabited places which are historically created around them, taking into account their natural and local features;
