About enhancement of procedure for licensing of lawyer activities and creation of lawyer forming

According to the Law of the Republic of Uzbekistan of December 31, 2008 "About modification and amendments in some legal acts of the Republic of Uzbekistan in connection with enhancement of institute of legal profession" and the Presidential decree of the Republic of Uzbekistan of May 1, 2008 the No. UP-3993 "About Measures for Further Reforming of Institute of Legal Profession in the Republic of Uzbekistan" Cabinet of Ministers decides No. ZRU-198:

1. Approve:

Regulations on licensing of lawyer activities according to appendix No. 1;

Regulations on state registration (registration) of lawyer forming according to appendix No. 2.

2. Establish the following rates of the state fee:

for state registration of lawyer bureaus, law firms and Bars - 2 basic settlement sizes;

for registration of legal advice bureaus - 1 basic settlement size;

for state registration of the made changes and additions in constituent documents of lawyer bureaus, law firms and Bars, and also regulations on legal advice bureaus - 20 percent from the rates specified respectively in paragraphs second and third this Item;

for issue of licenses for the occupation right lawyer activities - 1 basic settlement size.

The amount of the state fee is credited in in off-budget fund of development of bodies and organizations of justice in the sizes established by the legislation.

3. Determine that persons applying for acquisition of the status of the lawyer pay to relevant organs of justice collection for consideration of their statements for licensing in the amount of 50 percent of basic settlement size.

3-1. Persons applying for acquisition of the status of the lawyer only on one chosen specialization, pay the state fee for licensing for the occupation right lawyer activities and collection for consideration of their statement for licensing in the amount of 50 percent from the amount provided respectively in paragraph five of Item 2 and Item 3 of this resolution.

4. Take into consideration that according to article 7 of the Law of the Republic of Uzbekistan of December 31, 2008 No. ZRU-198 "About modification and amendments in some legal acts of the Republic of Uzbekistan in connection with enhancement of institute of legal profession" the lawyer forming operating by January 1, 2009, and also the lawyers working in them shall bring till July 1, 2009 forms of business of lawyer forming, licenses and the statuses of lawyers into compliance with the specified Law.

To provide to the Ministry of Justice together with Chamber of lawyers of the Republic of Uzbekistan:

in two weeks formation of the Highest qualification commission under Chamber of lawyers of the Republic of Uzbekistan and qualification commissions under territorial administrations of Chamber;

till July 1, 2009 re-registration of the operating lawyer forming, repeating an examination by the lawyers of qualification examinations working in them, issue of licenses for the occupation right to them lawyer activities of new sample and certificates of the lawyer;

issue of licenses for the occupation right lawyer activities to the faces included in structures of the Highest qualification commission under Chamber of lawyers of the Republic of Uzbekistan and qualification commissions under territorial administrations of Chamber without passing qualification examinations.

5. Exempt from payment of the state fee and charges the operating lawyer forming and the lawyers working in them respectively in case of re-registration of lawyer forming and issue of licenses for the occupation right lawyer activities according to this resolution.

6. Recognize invalid:

the resolution of the Cabinet of Ministers of March 13, 1997 No. 139 "About procedure for state registration of lawyer bureaus, boards, firms and issues to citizens of the Republic of Uzbekistan of licenses for the occupation right lawyer activities" (the joint venture of the Republic of Uzbekistan, 1997, No. 3, the Art. 12);

Item 8 of appendix to the resolution of the Cabinet of Ministers of April 30, 2003 No. 197 "About modification of some decisions of the Government of the Republic of Uzbekistan" (the joint venture of the Republic of Uzbekistan, 2003, No. 4, the Art. 34);

the resolution of the Cabinet of Ministers of November 5, 2003 No. 485 "About modification and amendments in Regulations on procedure for state registration of lawyer bureaus, boards, firms and issue of licenses to citizens of the Republic of Uzbekistan for the occupation right lawyer activities" (the joint venture of the Republic of Uzbekistan, 2003, No. 11, the Art. 109).
