No. 127-130, 496) DECIDES: Administrative board of National Bank of Moldova

1. Approve Regulations about issue by National Bank of Moldova of export permits of money from the Republic of Moldova it (is applied).

2. The instruction about translation/export from the Republic of Moldova of money separate categories of physical persons approved by the resolution of Administrative board of National Bank of Moldova No. 184 of July 13, 2006. (2006, 426), with subsequent changes and amendments, to change the official monitor of the Republic of Moldova to Art. No. 116-119, as follows:

1) In the name and in the text of the instruction (including in appendices) the text "/export" (the word "export in the corresponding case) and texts " / scoaterea", "/" to exclude scoaterii;

Regulations about issue by National Bank of Moldova of export permits of money from the Republic of Moldova

The preamble of Regulations is excluded according to the Resolution of National Bank of the Republic of Moldova of 30.11.2023 No. 240

Chapter I. General provisions

1. In these regulations the concepts determined by the Law on currency control No. 62/2008 (repeated publication in Monitorul Oficial al Republicii Moldova, 2016, No. 423-429, the Art. 859), further - the Law No. 62/2008 are used. Also for the purpose of these regulations the following concepts are used:

a) the export permit of money from the Republic of Moldova (permission of NBM) - the official document issued by National Bank of Moldova on paper resolving to its owner export of money from the Republic of Moldova;

b) money - cash national and foreign currency and travel checks in foreign currency;

c) physical resident persons are the physical persons specified in the subitem and) Item 9) of the article 3 Law No. 62/2008;

d) physical nonresident persons are the physical persons specified in the subitem and) Item 10) of the article 3 Law No. 62/2008;

e) the applicant - physical resident person or physical nonresident person who intends to export money from the Republic of Moldova and submits to National Bank of Moldova (personally or through the representative) the statement for issue of the export permit of money from the Republic of Moldova and the documents relating to currency transaction for which permission is asked.

2. These regulations establish:

a) requirements to the statement for issue of the export permit of money from the Republic of Moldova and to the statement for issue of the duplicate of permission, and also the list of the documents enclosed to these applications;

b) procedure for issue by National Bank of Moldova for export permits of money from the Republic of Moldova, and also their duplicates;

c) other provisions concerning permission of currency transaction on export of money by physical persons from the Republic of Moldova.

3. These regulations are applied to physical persons which intend to export money from the Republic of Moldova and to get for it permission of NBM if:

a) physical resident persons go abroad on the permanent residence and own on the property right the money which is subject to export;

b) physical nonresident persons own on the property right the money which is subject to export.

4. Permission of transaction on export of money from the Republic of Moldova is performed from the point of view of currency control and does not involve obligations from National Bank of Moldova of rather this transaction.

4-1. The statement for issue of permission of NBM and documents attached to it are filed to National Bank of Moldova by physical resident person or physical nonresident person on paper or electronically.

4-2. The physical person submitting the documents provided by these Regulations, electronically shall use the qualified digital signature according to the Law on electronic identification and confidential services No. 124/2022 (further - the Law No. 124/2022).

4-3. The National Bank of Moldova does not resolve the currency transactions specified in Item 3, under conditions, in case of which:

a) the physical resident person or the nonresident intending to perform currency transaction is subject of the international restrictive measure which began to be applied in the territory of the Republic of Moldova in accordance with the terms, provided by the Law No. 25/2016 on application of the international rationing arrangements, and

b) this international restrictive measure has the object or the investigation restriction of the right to carrying out the corresponding currency transaction.

In case of decision making about permission of currency transaction the National Bank of Moldova will consider the exceptions established by the Law No. 25/2016 on application of the international rationing arrangements.

Chapter II. Procedure for issue by National Bank of Moldova to physical persons of export permits of money from the Republic of Moldova and their duplicates

5. The National Bank of Moldova issues export permits of money from the Republic of Moldova according to the written petition of the physical resident persons and physical nonresident persons mentioned in Item 3 of these regulations.
