About foodstuff
This Law establishes the legal basis of quality management, production and organization of the market of foodstuff, ensuring food security of the population in the Azerbaijan Republic.
The concepts used in this Law express the following values:
foodstuff - food staples, food and additives (ingredients), products included in group of flavoring goods;
food - the products consumed by the person in the natural or processed type;
the minimum quality of foodstuff - the organoleptic, physical and (or) chemical qualities guaranteeing suitability of foodstuff to consumption by the person;
safety of foodstuff - compliance of food to the environmental, sanitary, veterinary and phytosanitary standards, rules and requirements guaranteeing their safety for life and health of the person;
packing and auxiliary materials - the natural and artificial materials used (which are in contact) in production process, storages, transportations and sales of foodstuff;
the consumer value of foodstuff - properties of the foodstuff providing food, biological and physiological needs of the people and also provided and used in the different purposes;
children's food - the special products of food adapted for physiological features of children's organism;
dietary food - the special products of food used in the preventive and medical purposes;
food security of the population - system of the economic, legal and organizational measures performed by the state for the purpose of providing the population of the country with the foodstuff necessary for his health and activities;
food staples - products of vegetable, animal, microbiological and mineral origin, and also the waters used in production of food;
power-supply circuit - set of stages of primary production, procurement, production, processing, packing, storage, transportation, turnover (including import and export transactions), uses in the field of public catering and services, utilizations, destructions of food on basis the principle "from the field to table";
the subjects performing activities in the field of food (foodstuff) - business entities, and also state bodies (organizations), the municipalities performing activities at all stages of power-supply circuit.
The legislation of the Azerbaijan Republic on foodstuff consists of this Law, regulatory legal acts adopted according to this Law and also other legislation of the Azerbaijan Republic.
Rules of quality management and the minimum safety of agricultural products, the fish and fish products used as food and raw materials, the organizations of their production and the market are regulated along with this Law and the corresponding legal acts of the Azerbaijan Republic.
If the rules of quality management and the minimum safety, production organization and the market of foodstuff established by the interstate agreements supported by the Azerbaijan Republic differ from the rules provided by this Law, then rules of international treaties are applied.
In the field of foodstuff production, procurement, packing, storage, transportation, purchase and sale of foodstuff and transaction on their import export are considered as activities.
Activities in the field of foodstuff are performed according to the procedure, stipulated by the legislation the Azerbaijan Republic.
Quality and the minimum safety of foodstuff are provided as follows:
regulation and enhancement of quality requirements and minimum safety of foodstuff;
certification of foodstuff;
state registration of the subjects performing activities in the field of food;
state control of quality and minimum safety of foodstuff.
Regulation in the field of quality assurance and safety of foodstuff of minimum is performed by means of environmental, sanitary, veterinary and phytosanitary standards, rules, the technical regulatory legal acts in the field of safety of food (further requirements) establishing quality requirements and safety of the specified products minimum, conditions of their production, transportation, storage, packing, gluing of labels and sale.
Development and acceptance of technical regulatory legal acts in the field of food safety is performed by body (organization) determined by relevant organ of the executive authority.
Technical regulatory legal acts in the field of food safety on all equipment and means used for production of foodstuff are accepted by body (organization) determined by relevant organ of the executive authority.
Execution of requirements of technical regulatory legal acts in the field of food safety for the purpose of quality assurance and the minimum safety of foodstuff is obligatory for all legal entities and physical persons performing activities in the field of foodstuff.
If the importing country requires the certificate of food safety on the food exported to foreign countries, then the relevant organ of the executive authority issues the certificate of food safety taking into account and requirements of importing countries.
If importing countries require the certificate of food safety and (or) other certificate (veterinary, phytosanitary and so forth) concerning food product, its raw materials, issue of these certificates is provided by relevant organ of the executive authority.
The food imported to the Azerbaijan Republic shall have the certificate of food safety (clean bill of health) recognized in the appropriate order or issued by relevant organ of the executive authority. If the producer of the imported foodstuff was registered food safety, the certificate of food safety on products of this producer is not required.
The form and rules of issue of the certificate of food safety on foodstuff are established on concern by relevant organ of the executive authority.
The state fee shall be paid for receipt of the certificate of food safety only by means of bank, mail, plastic card, electronic payment systems or the Internet.
