About approval of Rules of development and accomplishment of the state task

1. Approve the enclosed Rules of development and accomplishment of the state task.
2. This resolution becomes effective from the date of signing.

These rules of development and accomplishment of the state task (further - Rules) are developed according to Article 41 of the Budget code of the Republic of Kazakhstan of December 4, 2008 (further - the Code) and determine procedure for development and accomplishment of the state task.
1. The state task is the order to legal entities with participation of the state in the authorized capital, to the organizations entering into group of National welfare fund, to the National chamber of entrepreneurs of the Republic of Kazakhstan and its organizations determined by the Government of the Republic of Kazakhstan, to the autonomous organizations of education and their organizations determined by the Government of the Republic of Kazakhstan for rendering separate state services, implementation of the budget investment projects and accomplishment of other tasks aimed at providing social and economic stability of the state.
2. Allocation of budgetary funds to legal entities with participation of the state in the authorized capital on accomplishment of the state task is performed without increase in the authorized capital of these legal entities.
3. Development of the state task includes preparation of offers and reasons on rendering the state services, implementation of the budget investment projects or accomplishment of other tasks in the form of the state task.
4. The administrator of republican budget programs in case of development of the republican budget together with the draft of the strategic plan and the budget request represents to the central authorized body on state planning the offer on rendering the state services or implementation of the budget investment projects in the form of the state task.
5. The offer is provided in form according to appendix to these rules and shall contain:
1) name of the state service or budget investment project;
2) description of the state service or budget investment project;
3) the name of the legal entity with participation of the state in the authorized capital or the organization entering into group of National welfare fund, either National chamber of entrepreneurs of the Republic of Kazakhstan, or its organizations, determined by the Government of the Republic of Kazakhstan or autonomous organization of education, or its organization, actionee of the state task;
4) the name of the republican budget program within which accomplishment of the state task, and the amount of the budgetary funds planned for its accomplishment is offered;
5) term of accomplishment of the state task;
6) reasons for need of realization of the state service or the budget investment project in the form of the state task.
6. The list of the state services and the budget investment projects planned to accomplishment in the form of the state task is submitted for consideration of the Republican budget commission together with drafts of strategic plans of state bodies, the budget requests of administrators of republican budget programs.
7. The budget investment projects planned to realization in the form of the state task undergo all procedures of planning of the budget investment projects established by the budget legislation of the Republic of Kazakhstan.
8. The central authorized body on state planning based on the law on the republican budget and taking into account offers of the Republican budget commission creates the list of the state tasks with indication of administrators of republican budget programs and legal entities, actionees of the state tasks (further - the list of the state tasks).
Shall contain list of the state tasks:
1) the name of the state service or the budget investment project performed in the form of accomplishment of the state task;
2) short description of the state service or budget investment project;
3) name of the administrator of the republican budget program and legal entity, actionees of the state task;
4) the name of the republican budget program with indication of code of Single budget classification within which the state task is performed;
5) the amounts of the budgetary funds necessary on accomplishment of the state task.
The description of the state service or the budget investment project shall be short and clear and shall capture the essence of the state service or the budget investment project.
The list of the state tasks affirms as appendix form to the order of the Government of the Republic of Kazakhstan about implementation of the law on the republican budget.
9. Within financial year in case of need of the immediate solution of the tasks aimed at providing social and economic stability of the state, by the Government of the Republic of Kazakhstan taking into account offers of the Republican budget commission additions can be made to the List of the state tasks within the republican budget programs approved in the republican budget.
10. Accomplishment of the state task is performed within implementation of the approved republican budget programs by the conclusion of the civil transaction between the administrator of republican budget programs and the contractor of the state task with indication of in it indicators of results (further - the agreement).
11. The agreement shall contain indicators of straight lines and resulting effects, if necessary - indicators of quality and efficiency of accomplishment of the state task, accomplishment terms, responsibility of the legal entity who received and using budgetary funds, for not achievement of fill rates of the state task, provided by the laws of the Republic of Kazakhstan.
12. Accomplishment of the state task is performed without observance of competitive procedures, stipulated by the legislation the Republic of Kazakhstan about public procurements.
