1. Approve the enclosed Rules of registration, accounting and issue of permissions to carrying out aero film-making works.

2. This resolution becomes effective from the date of signing.

Rules of registration, accounting and issue of permissions to carrying out aero film-making, geodetic and cartographic works

These rules are developed according to the Law of the Republic of Kazakhstan of July 3, 2002 "About geodesy and cartography" and determine order of registration, accounting and issue of permissions to carrying out aero film-making works.

1. General provisions

1. Registration, accounting and issue of permissions to carrying out the aero film-making works performed by means of photographic, television, infrared, radar and other equipment for activities of the state, special and (or) industry purpose is performed by authorized body in the field of geodesy and cartography (further - authorized body).

Registration, accounting and issue of permissions to carrying out aero film-making works is performed for the purpose of ensuring defense and homeland security of the Republic of Kazakhstan when carrying out aero film-making works.

2. In these rules the following concepts are used:

1) aerial photograph - shooting of the area from aircraft with use of film-making systems (information receivers) working in different sites of range of electromagnetic waves;

2) aero film-making works - the works consisting of flight and film-making works and data processing.

2. Consideration and issue of Permission to carrying out aero film-making works

3. For receipt of permission to carrying out aero film-making works (further - Permission) legal entities and physical persons (further - Applicants) submit applications to authorized body.

Permission is issued by authorized body no later than twenty five working days from the date of receipt of the request with the relevant documents established by these rules.

The request is drawn up in writing, the signed Applicant. In the request conditions and time of aerial photograph, territorial placement of the subjects, their areas, appointment and specifications of aerial photograph shall be specified.

4. Are applied to the request:

1) the copy of the service provision agreement with the civil aircraft for aero film-making works (The applicant provides notarially attested copies of documents, or shows originals of documents for reconciliation);

2) cartogram of the territory on which carrying out aero film-making works with indication of its geographical coordinates, in four copies is planned;

3) engineering designs (or specifications) for the planned aero film-making works in duplicate.

In case of planning of carrying out aero film-making works in the new territories during effective period of the issued Permission, the documents specified in subitems 2) and 3) of this Item are attached to the request.

5. The authorized body within two working days performs the request and the enclosed documents which includes:

1) check of completeness of documents and correctness of their registration;

2) identification of duplication of the declared works to earlier carried out aero film-making works, when financing these works from means of the government budget.

6. If by results of check it will be revealed:

1) that documents are provided not in full or drawn incorrectly up according to Items 3 and 4 of these rules, the request with all materials within two working days goes to the Applicant for elimination of the revealed notes;

2) duplication of the declared works, to earlier carried out aero film-making works, the authorized body within two working days notifies the Applicant and the customer of aero film-making works. At the same time the Applicant and the customer of aero film-making works uses earlier created aero film-making materials and data.

7. In the absence of the notes specified in Item 6 of these rules the request with the enclosed documents within two working days is sent by authorized body for consideration in the Ministry of Defence of the Republic of Kazakhstan and others, within their competence, state bodies for the benefit of ensuring defense and homeland security of the Republic of Kazakhstan.
