Being one of the main components of the environment and biological diversity, national property of the country, source of spiritual and esthetic needs of the population, the fauna is used and protected as subject to scientific research, raw materials and foodstuff.
This Law establishes the legal basis of protection and use of fauna in the Azerbaijan Republic.
The terms and concepts used in this Law express the following values:
the fauna is set of quantity and quality of types of wild animals, constantly, temporarily living and wandering in naturally free, semi-free conditions and in bondage on the land, in water, the earth and air in all territory of the Azerbaijan Republic, including in the sector of the Caspian Sea (lake) belonging to the Azerbaijan Republic;
population is capable to give posterity geographical, zoological and elementary group of individuals of type of animals;
the habitat of fauna is the habitat of animals in water, on the land, in the earth and air in the conditions of natural freedom;
use of fauna is studying, cultivation, reproduction, trade and other types of activity with withdrawal or not withdrawal of objects of fauna from the environment for the purpose of satisfaction of material and spiritual needs of people;
protection of fauna is preserving biological diversity and life activity of objects of fauna;
users of fauna are the physical persons and legal entities using fauna objects according to the procedure, established by the legislation of the Azerbaijan Republic.
The legislation of the Azerbaijan Republic on fauna consists of this Law, the legislation of the Azerbaijan Republic on conservation and other legal acts.
Rules of protection and use of the agricultural and cultivated animals, other tamed animals are regulated by the corresponding legal acts of the Azerbaijan Republic.
The relations on water, the earth, the wood, property, conservation, etc., their dwellings arising in connection with protection and use of fauna and the circle, are regulated by the relevant legislation of the Azerbaijan Republic taking into account this Law.
The purpose of the legislation on fauna consists in ensuring preserving and rational use of all types of wild animals, constantly, temporarily living and wandering in naturally free, semi-free conditions and in bondage in the territory of the Azerbaijan Republic, places of their dwelling, reproduction, populations, gametes, embryos and other objects of fauna.
Tasks of the legislation on fauna consist in creation of the legal base for the organization, management and state regulation of protection and use of fauna.
Treat objects of fauna:
the elementary organisms, coelenterates, worms, arthropods, mollusks, Cyclostoma, fishes, amphibiouses, reptiles, birds and mammals (further - wild animals);
populations, gametes, embryos, the impregnated caviar, larvae and generative bodies of wild animals;
skins, coverings of skins, horns, bones of wild animals and other parts of animal organisms;
waste products of wild animals (poison of snakes, scorpions, bees and other animals, bee honey, propolis, wax, hormones, etc.);
paleontologic remains of animals;
dens, holes, shelters of wild animals, places of their pereklikivaniye, molt, reproduction, spawning, permanent and temporary collection and other habitats.
The physical persons and legal entities which are engaged in the procedure established by the legislation of the Azerbaijan Republic in protection, use of objects of fauna, and also cultivation, reproduction and content of objects of wild animals in research, medical, teaching and educational, economic, esthetic, spectacular and other purposes are subjects of fauna.
The fauna in the territory of the Azerbaijan Republic belongs to the state without causing damage to the rights and interests of all physical persons and legal entities and is its property.
The fauna objects living in conditions of natural freedom in especially protected natural territories and objects of the Azerbaijan Republic in the sector of the Caspian Sea (lake) belonging to the Azerbaijan Republic, other water objects, in places of trade and on sites of forest fund, belong to natural wealth of the state value.
The fauna types relating to natural wealth of the state value are established by relevant organ of the executive authority.
The wild animals and other objects of fauna withdrawn from conditions of natural freedom or the environment and which are grown up (received) in semi-free conditions and in bondage, or acquired in other ways allowed by the legislation can be in municipal or private property.
Legality of acquisition of objects of fauna in municipal or private property (except acquisition according to the procedure of general use) shall be drawn up by the relevant documents.
