2. To provide to the Ministry of Finance of the Republic of Kazakhstan, the Ministry of the industry and trade of the Republic of Kazakhstan in the procedure established by the legislation:

1) the conclusion of credit agreements with local executive bodies of areas, cities of Astana and Almaty;

2) control of target use and timely return of the credits to the republican budget.

3. To local executive bodies of areas, cities of Astana and Almaty quarterly, no later than the 10th following the accounting period to provide information on development of the credits to the Ministry of the industry and trade of the Republic of Kazakhstan and the Ministry of Finance of the Republic of Kazakhstan.

4. To impose control of execution of this resolution on the Ministry of the industry and trade of the Republic of Kazakhstan.

5. This resolution becomes effective from the date of signing.

1. General provisions

These rules of crediting of regional budgets, budgets of the cities of Astana and Almaty on construction and acquisition of housing for 2009 (further - Rules) are developed according to article 29 of the Law of the Republic of Kazakhstan on December 4, 2008 "About the republican budget for 2009-2011", the Presidential decree of the Republic of Kazakhstan of August 20, 2007 No. 383 "About the State program of housing construction in the Republic of Kazakhstan for 2008-2010", the order of the Government of the Republic of Kazakhstan of October 1, 2007 No. 867 "About approval of the Actions plan on implementation of the State program of housing construction in the Republic of Kazakhstan for 2008-2010", the order of the Government of the Republic of Kazakhstan of December 18, 2008 No. 1184 "About implementation of the Law of the Republic of Kazakhstan "About the republican budget for 2009-2011" and determine procedure for crediting of regional budgets, budgets of the cities of Astana and Almaty on construction and acquisition of housing for 2009.

2. Procedure for crediting of regional budgets, budgets of the cities of Astana and Almaty for construction and acquisition of housing for 2009

To local executive bodies of areas, cities of Astana and Almaty (further - borrowers) within ten calendar days after acceptance by the relevant maslikhats of the decisions providing the corresponding receipts in regional budgets, budgets of the cities of Astana and Almaty for 2009 to provide the specified decisions of maslikhats in the Ministry of Finance of the Republic of Kazakhstan (further - the creditor).

To the creditor according to the legislation of the Republic of Kazakhstan after accomplishment of Item 2 of these rules to grant to borrowers budget credits for the total amount of 16100000000 (sixteen billion hundred million) tenges (further - the credits) by means of the conclusion of credit agreements according to appendix 31 of the order of the Government of the Republic of Kazakhstan of December 18, 2008 No. 1184 "About implementation of the Law of the Republic of Kazakhstan "About the republican budget for 2009-2011".

4. Establish the following main conditions of loan granting to borrowers:

1) the loans are granted to borrowers in tenge for a period of 3 (three) on zero rate of remuneration (interest) on construction and acquisition of housing within the State program of housing construction in the Republic of Kazakhstan for 2008-2010;

2) the period of development of the credits is estimated from the moment of transfer of the credits from the account of the creditor and comes to an end on December 25, 2011.

5. Other conditions on provision, repayment and servicing of the credit are established in the credit agreement.
