About radiation safety of the population of the Kyrgyz Republic

This Law determines legal relations in the field of ensuring radiation safety of the population and environment protection against harmful effects of sources of ionizing radiation.
In this Law the following basic concepts are applied:
radiation safety of the population (further - radiation safety) - condition of security of these and future generations of people and the environment from harmful effects of ionizing radiation. Radiation safety is component of safety of the personality, society, state and is provided due to implementation of package of measures of legal, organizational, technical, sanitary and hygienic, medical, educational and educational nature;
ionizing radiation - the radiation which is created in case of radioactive decay nuclear transformations, braking of charged particles in substance and forms in case of interaction with environment ions of different signs;
natural radiation background - the dose of ionizing radiation created by the space radiation and radiation of the natural radionuclides which are naturally distributed in the earth, water, air, other elements of the biosphere, foodstuff and human body;
tekhnogenno the changed radiation background - the natural radiation background changed as a result of activities of the person;
radionuclides - atoms in which kernels spontaneously break up with allocation of energy in the form of gamma quanta, beta particles or alpha particles, or neutrons electrically loaded;
effective dose - the size of impact of ionizing radiation used as measure of risk of emergence of the remote consequences of radiation of the person and his separate bodies taking into account their radio sensitivity;
radioactive pollution - presence of radionuclides of technogenic origin in the environment which can lead to radiation in individual dose of more 0,001 of sievert a year;
radiation by ionizing radiation - impact of ionizing radiation on biological objects which can be external (if its source is out of organism) and internal (if its source is in organism);
the sanitary protection zone - the territory around source of ionizing radiation in which the level of radiation of people in the conditions of normal operation of this source can exceed the set radiation dose limit for the population. In the sanitary protection zone permanent and temporary residence of people is forbidden, the regime of restriction of economic activity is introduced and radiation control is carried out;
observation zone - the territory outside the sanitary protection zone on which radiation control is carried out;
the worker - physical person which permanently or temporarily works directly with sources of ionizing radiation;
radiation accident - the loss of management of source of ionizing radiation caused by defect of the equipment, the wrong actions of the worker (personnel), natural disasters or other reasons which could give or led to radiation of people above of the established regulations or to radioactive environmental pollution.
The international agreements which came in the procedure established by the law into force which participant is the Kyrgyz Republic and also the conventional principles and rules of international law in the field of radiation safety are component of system of law of the Kyrgyz Republic.
1. The basic principles of ensuring radiation safety are:
the principle of regulation - not excess of admissible limits of individual doses of radiation of citizens from all sources of ionizing radiation;
the principle of reasons - prohibition of all types of activity on use of sources of ionizing radiation in case of which the advantage received for the person and society does not exceed risk of the possible harm done by radiation, additional to natural radiation background;
the principle of optimization - maintenance at perhaps low and achievable level taking into account economic and social factors of individual doses of radiation and number of the irradiated persons when using any source of ionizing radiation;
the principle of openness - openness and availability to the population of information on ionizing radiation in the territory of accommodation, and also the happened radiation accidents.
2. In case of radiation accident the system of radiation safety of the population is based on the following principles:
expected actions for mitigation of consequences of radiation accident shall bring more benefit, than harm;
types and scale of activities for mitigation of consequences of radiation accident shall be realized so that the advantage of decrease in dose of ionizing radiation, except for the harm done by the specified activities was maximum.
Radiation safety is ensured:
carrying out package of measures of legal, organizational, technical, sanitary and hygienic, medico-preventive, educational and educational nature;
implementation of the Kyrgyz Republic by public authorities, local government bodies, other legal entities and citizens of actions for observance of rules, regulations and standard rates in the field of radiation safety;
training of the population in the field of ensuring radiation safety and informing it about radiation situation.
1. Public administration in the sphere of ensuring radiation safety is exercised of the Government of the Kyrgyz Republic.
2. Development of policy and implementation of supervising and control functions in the sphere of ensuring radiation safety are implemented by the authorized state bodies determined by the Government of the Kyrgyz Republic.
1. National and regional programs are developed for planning and implementation of actions for ensuring radiation safety.
National programs in the field of ensuring radiation safety are developed and implemented by specially authorized state bodies with participation of local public administrations, local government bodies according to the procedure, established by the legislation of the Kyrgyz Republic.
2. Regional programs in the field of ensuring radiation safety are developed by bodies of the local government and will be approved with specially authorized state bodies.
3. The procedure for financing of state programs in the field of ensuring radiation safety is determined by the legislation of the Kyrgyz Republic.
