Based on article 3 of the Law No. 420-XVI of December 22, 2006 on technical regulation (The official monitor of the Republic of Moldova, 2007, No. 36-38, of the Art. 141), with subsequent changes and amendments, DECIDES: the Government

Approve:

The technical regulation "The Main Safety Requirements to Explosives for Civil Application and Condition of Their Placement in the Market" according to appendix No. 1;

The paragraph of ceased to be valid according to the Order of the Government of the Republic of Moldova of 02.12.2016 No. 1289;

The technical regulation "Means and Protective Systems, Held for Use in Potentially Explosive Environments" according to appendix No. 3.

Technical regulation "Means and Protective Systems, Held for Use in Potentially Explosive Environments"

I. Scope

1. The technical regulation "Means and Protective Systems, Held for Use in Potentially Explosive Environments" (further - the Technical regulation) is developed on the basis of provisions of the Directive of the European Council 94/9/SE of March 23, 1994 on harmonization of the legislation of member countries of the European Union and is applied to means and protective systems, held for use in potentially explosive environments.

2. The scope of this Technical regulation switches on also protection, control and control devices, held for use outside potentially explosive environments, but which are necessary or which promote functioning in safety conditions of means and systems of protection concerning risks of explosion.

3. This Technical regulation is not applied:

a) to medical devices, held for use in the medical circle;

b) to means and protective systems at which explosion hazard is caused only by presence of explosives or unstable chemicals;

c) to means, held for use in household and non-commercial circles in which potentially explosive environments can seldom arise owing to accidental leakage of gas;

d) to the regulated individual remedies which are subject of appendix No. 2 to this Resolution;

e) to ocean ships and mobile sea platforms together with the equipment on their board;

f) to vehicles, namely vehicles and trail cars to them intended only for transportation of passengers by air, the highway, the railroad or water and also to the vehicles intended for transportation of goods by air, the highway, the railroad or water. It is not necessary to exclude vehicles, held for use in potentially explosive environment;

g) to weapon, ammunition and military equipment.

II. Terminology

4. In this Technical regulation the following terms and determinations are used:

a) means and protective systems, held for use in potentially explosive environments:

means - machines, the equipment, stationary or mobile devices, components of control and management, and also detection systems and prevention which, taken separately or together, are intended for generation, transfer, storage, measurement, control and transformation of energy and/or processing of materials and which because of own potential sources of ignition can become cause of explosion;

protective systems - the devices other than components of the means determined above which are intended for immediate stop of the arising explosion and/or restriction of the zone subject to explosion which are delivered on the market separately for use as systems with autonomous function;

components - the details essential to functioning in safe conditions of means and protective systems, but which have no autonomous functions;

b) the explosive environment - air mix, under atmospheric conditions, with flammable substances in the form of gases, vapors, fog or dust in which after ignition burning extends on all mix;

c) potentially explosive environment - the environment capable to become explosive owing to local and operational conditions;

d) groups and categories of means:

means of the I group - means, held for use in underground parts of mines and in those parts of the land constructions subject to danger of firedamp and/or explosive dust;

means of the II group - the equipment, held for use in other places subject to danger of the explosive environment.

Categories of means which determine levels of necessary protection are provided in appendix No. 1 to this Technical regulation.

Means and protective systems can be intended only for one explosive environment, and in that case shall be noted as appropriate;

e) the intended use - use of the means, protective systems and devices provided in Item 2 of this Technical regulation according to the group and category of means and all information provided by the manufacturer which is necessary for their work in safe conditions.

III. Placement conditions in the market and free circulation

5. Placement in the market and/or commissioning of the means, protective systems and devices provided in Item 2, only if they do not threaten safety and human health or, on circumstances, pets, to property when they are as appropriate established, served and used according to their purpose is allowed.

6. Competent authorities can develop, as necessary, and other regulations for ensuring protection of people, in particular workers who use means, protective systems and devices provided in Item 2, provided that they will not demand change of the means, protective systems and devices provided in Item 2, which contradict provisions of this Technical regulation.
