About approval of Instructions for use by cars and containers

For the purpose of determination of payment and procedure for use of goods wagons and containers by subjects of business activity according to article 119 of the Charter of the railroads of Ukraine PRIKAZYVAYU:

1. Approve Instructions for use by cars and containers (are applied).

2. To headquarters of tariff and insurance regulation (S.P.Shcherbin) together with Main department for legal services (L. M. Loginov) in accordance with the established procedure to register noted Rules in the Ministry of Justice of Ukraine.

3. Public administration of rail transport (A. V. Slobodyan):

3.1. Bring these Rules to permission of workers of the railroads of Ukraine, the companies, the organizations and organizations, freight forwarders and citizens who use railway transport.

3.2. Organize studying by involved workers of the railroads of Rules, take them to management and provide accomplishment.

3.3. Consider invalid Item 2 of the order of the Ministry of transport of Ukraine "About procedure for temporary action of separate regulatory legal acts" of 08.05.98 No. 174, No. 346/2786 registered in the Ministry of Justice of Ukraine 26.05.98.

4. To impose control of execution of the order on the First Deputy Minister of Transport L. M. Kostyuchenko.

Instructions for use cars and containers (Art. 119-126 of the Charter of the railroads of Ukraine)

I. General provisions

1. Instructions for use cars and containers determine procedure and conditions of use of cars and containers:

- to the park of the railroads of Ukraine;

- to the park of the railroads of other states;

- to the belonging companies, the organizations, ports, organizations and citizens and also leased by them (for delay time on the ways of the railroads public).

2. For use of cars and containers consignors, consignees, owners of sidings, ports, the organizations, organizations, physical persons - subjects of business activity (further - freight owners) bring payment.

3. No. 336 is excluded according to the Resolution of the Cabinet of Ministers of Ukraine of 24.07.2018.

II. Procedure for use of cars and containers

3. The time management of use of cars and containers and charge of payment for use is performed by them on stations of origin and assignments according to the Sheet of payment for use of cars of the GU-46 form (appendix 1), Sheets of payment for use of containers of the GU-46k form (appendix 11) which are constituted based on Instruction sheets of giving / zabiranii cars of the GU-45 form (appendix 2), Instruction sheets of issue/acceptance of containers of the GU-45k form (appendix 8), Notices on the end of cargo operations with cars (appendix 12), Acts of delay of cars of the GU-23a form (appendix 3), Acts of general format GU-23 (appendix 6). The procedure of electronic document management in transit of loads by rail in internal connection is regulated by appendix to the agreement on the organization of carriages of goods and carrying out calculations for transportation and the services provided by the railroad.

Sheets of payment for use of cars, containers are constituted on cars, containers which move under loading and unloading, are documents of time management of stay of cars, containers in Items of loading and unloading and on sidings and contain calculations of payments for use of cars, containers.

Sheets of payment for use of cars (containers) shall be signed by the employee of the station and the freight owner daily or during the periods of presentation by their station to settlement division that are established by the chief of the railroad.

In case of discrepancy of the data noted in the sheet, the representative of the freight owner shall sign the sheet with notes.

The sheet of payment for use of cars (containers) is constituted in triplicate - two for the railroad and one for the freight owner, separately for cars and for containers.

Time of use of cars is calculated from the moment of their transfer to the freight owner until their actual acceptance from the freight owner.

In case of giving of cars without message, the beginning of time of use of them is calculated after the termination of two hours provided by Instructions for use cars and containers.

In case of giving of cars with delay, after time noted in the message, time of use is calculated from the moment of the actual giving if delay does not exceed two hours.
