About approval of Rules of the budget subsidizing of production management systems of agricultural products

1. Approve the enclosed Rules of the budget subsidizing of production management systems of agricultural products.

2. This resolution becomes effective from the date of official publication.

Rules of the budget subsidizing of production management systems of agricultural products

1. General provisions

1. These rules of the budget subsidizing of production management systems of agricultural products (further - Rules) the agricultural industry of complex and the rural territories", of December 4, 2008 "About the republican budget for 2009-2011" are developed according to the laws of the Republic of Kazakhstan of July 8, 2005 "About state regulation of development and determine procedure for the budget subsidizing of cost of services in development, implementation and certification of international standards of the companies of industries of agro-industrial complex.

2. The budget subsidizing is performed at the expense of means of the republican budget for the corresponding years (further - means) according to the republican budget program 051 "Subsidizing of production management systems of agricultural products" (daleeprogramm).

3. In these rules the following concepts and determinations are used:

1) administrator of the program - Ministry of Agriculture of the Republic of Kazakhstan;

2) body for confirmation of conformity - the legal entity accredited in accordance with the established procedure for performance of works on confirmation of conformity;

3) certification - the procedure by means of which the body for confirmation of conformity in writing certifies compliance of products, services to the established requirements;

4) the customer subject of agro-industrial complex who is at stage of development, implementation and certification of international standards;

5) participating customers are the customers who are taking part in program implementation;

6) the attracted consultant - the legal entity or physical person performing consulting (consulting) services on development, implementation of international standards;

7) the international standard - the standard accepted by International Organization for Standardization and available to wide range of consumers;

8) the consultant in the state - the physical person, the customer's employee performing consulting (consulting) services on development, implementation of international standards;

9) selection - determination of the participating customers participating in the program for distribution between them the budget subsidies, provided in the republican budget for 2009-2011.

2. Procedure for the budget subsidizing of cost of services in development, implementation and certification of international standards of the companies of industries of agro-industrial complex

4. For distribution of means on the budget subsidizing of cost of works on development, implementation and certification of international standards of the companies of industries of agro-industrial complex the administrator of the program makes selection among customers.

5. The amount of means paid from the republican budget constitutes no more than 50% of costs of the customer of all project cost on development, implementation and certification of international standards.

6. For carrying out selection of the customers participating in program implementation, the administrator of the program:

1) forms the commission as a part of the chairman, members and the secretary of the commission. The quantitative structure of the commission shall be odd and at least five people;

2) sends the invitation to all customers according to the list provided by Deraptments of Agriculture of akimats of areas, cities of Almaty, Astana (further - managements).

7. The administrator of the program performs selection of the customers participating in program implementation and answering to the following criteria:

1) resident of the Republic of Kazakhstan (the legal entity or physical person is registered in judicial authorities of the Republic of Kazakhstan, in accordance with the established procedure);

2) lack of tax debt and other obligatory payments in the budget.

8. The customer can use the international standard which implementation is provided with the attracted consultant, or to implement it independently in the presence in structure of the company of the service of quality consisting of salaried employees in number of at least two people.

9. Requirements to the attracted consultant:

1) work experience at least two years on development, implementation and certification of international standards on the date of the conclusion of the contract with the customer;

2) participation at least in two completed projects;

3) availability in staff of qualified specialists in the field of development, implementation and further confirmation of conformity of the international standards having the corresponding diplomas, certificates on the end of seminars, rates, and work experience in development and deployment of international standards (for legal entities);

4) availability of the corresponding diploma, certificates on the end of seminars, rates, and work experience on development and deployment of international standards (for physical persons).

Requirements to the consultant in the state:

1) availability of the corresponding diplomas, certificates on the end of seminars, rates and work experience on development and deployment of international standards;

2) work experience at least two years the employee of service of quality in the company developing system of management.

10. The customers wishing to take part in selection submit to the commission the request in form according to appendix 1 to these rules signed by the first head of the customer or person having properly drawn up power of attorney on the right of signing of the request, under seal the customer in sealed envelope.

11. As integral part are applied by the customer to the request:

1) notarially attested copy of the certificate of the taxpayer of the Republic of Kazakhstan;
