Regulations on Council for energy policy under Integration Committee of Eurasian economic community

This Regulations on Council for energy policy under Integration Committee of Eurasian economic community (further - Council) determine its purposes, tasks, competence, procedure for education and activities, and also the right and obligation of his members.

Article 1

1. Council on energy policy under Integration Committee of Eurasian economic community (further - EurAsEC) is created for forming of total energy market and is the body performing interaction of the countries of Community in the field of power.

2. In the activities Council is guided by the international treaties existing within EurAsEC, decisions of bodies of Community and this Provision.

3. Council acts on the basis of the this provision approved by Integration Committee of EurAsEC, and the Regulations of work approved by Council.

Article 2

1. Council is responsible before Integration Committee of EurAsEC and is accountable to it.

2. The integration Committee of EurAsEC determines the main activities of Council.

Article 3

Council on the questions carried to its competence:

a) takes measures for implementation of decisions of bodies of Community and international treaties in the field of power, makes offers on carrying out the approved energy policy within EurAsEC;

b) considers questions of forming of total energy market of the countries of Community and makes in accordance with the established procedure offers in Integration Committee of EurAsEC;

c) performs the economic analysis of condition of energy industries of the states of EurAsEC, and also the analysis of national legal systems in the field of power;

d) takes part in development and implementation of interstate projects, programs and other joint actions of the Parties for forming of total energy market of state members of EurAsEC;

e) annually provides to Integration Committee of EurAsEC information on condition of processes of integration into the fields of power and the report on the work;

e) at the request of Integration Committee interacts with similar bodies of other international organizations;

i) performs other functions within the competence.

Article 4

Council has the right:

a) draft within the competence the acts directed to implementation of decisions of bodies of Community and the international agreements signed within EurAsEC in the field of power;

b) make in accordance with the established procedure offers on deepening of integration interaction of state members of EurAsEC in the field of power, and also to drafts of decisions of Integration Committee of EurAsEC and Interstate Council of EurAsEC;

c) draw the conclusions according to drafts of international treaties on the questions entering its competence;

d) develop recommendations and specific proposals about harmonization (rapprochement, unification) of national legal systems in the field of power;

e) interact with offices of bodies of Community;

e) request and obtain necessary information according to the national legal system of the Parties and decisions of bodies of Community;

g) submit for consideration of Integration Committee of EurAsEC of the offer on the conclusion of the agreements on performance of works connected with forming of total energy market of state members of EurAsEC, within expense budget of Integration Committee of EurAsEC, provided on these purposes;

h) create under Council of the commission and the working groups on certain directions of forming of energy market, approve their structure and the work plan, to exercise control of their activities.

Article 5

Council is established by the decision of Integration Committee of EurAsEC.

Article 6

1. The structure of Council is created by the Secretariat of Integration Committee of EurAsEC on representation of the Parties and affirms Integration Committee of EurAsEC.

Members of council are heads of relevant organs of public administration by power.

Members of council have the equal rights in case of discussion of questions.

2. The organization of work of Council is performed by the Responsible secretary of Council appointed by Council in coordination with the Secretariat of Integration Committee of EurAsEC from number of persons employed of the Secretariat of Integration Committee of EurAsEC.

Article 7

The Chairman of the board elected by members of council from the structure open voting directs work of Council.

Article 8

Chairman of the board:

a) presides over meetings of Council;

b) performs the common directorship of preparation of the questions submitted for consideration of Council;

c) exercises general control of implementation of the decisions made by Council;

d) is present and makes reports and supporting reports at meetings of bodies of Community by consideration of the questions entering competence of Council;

e) represents Council in relations with bodies of Community, bodies of other international organizations and executive bodies of the Parties;

e) signs documents of Council;

g) performs other functions provided by this Provision.

Article 9

1. Meetings of Council are held as required, but at least once a half-year serially in the territory of state members of Community.

Relevant organs of the executive authority of the Parties render assistance in the organization and holding meetings of Council.

2. The procedure for holding meetings is determined by Regulations of Council.

Article 10

1. Council is competent to make decisions if all members participate in its meeting.
