Agreement between the Russian Federation and Azerbaijan Republic on differentiation of adjacent sites of bottom of the Caspian Sea

The Russian Federation and the Azerbaijan Republic which further are referred to as with the Parties

proceeding from the aspiration to develop friendly good-neighbourhood,

considering mutual interest in creation of the contractual legal basis of activities of both Parties for development of mineral resources of subsoil of adjacent sites of bottom of the Caspian Sea,

being guided by the conventional principles and rules of international law, interests of the Parties in case of development and use of mineral resources of subsoil of adjacent sites of bottom of the Caspian Sea, the existing practice on the Caspian Sea,

understanding the responsibility before present and future generations for preserving the Caspian Sea and integrity of its unique ecological system,

recognizing importance of observance of special ecological requirements in case of investigation and development of mineral resources of the Caspian Sea,

in view of the reached two-way deals concerning legal status of the Caspian Sea,

agreed as follows:

Article 1

1. The bottom of the Caspian Sea and its subsoil are differentiated between the Parties on the basis of method of the median line drawn taking into account the equidistance of points and modified by agreement of the Parties, and also taking into account the conventional principles of international law and the practice which developed on the Caspian Sea.

2. This agreement establishes geographical coordinates of passing of this Article of the line of demarcation of adjacent sites of bottom of the Caspian Sea determined according to Item 1 between the Russian Federation and the Azerbaijan Republic for the purpose of implementation of the sovereign rights concerning mineral resources and other lawful economic economic activity connected with subsurface use at the bottom.

3. The initial point of the specified line of demarcation of adjacent sites of bottom of the Caspian Sea between the Russian Federation and the Azerbaijan Republic is the point located at the exit of frontier of the Russian Federation and the Azerbaijan Republic to urez of water of the Caspian Sea with coordinates 41 °50', the 5th northern latitude and 48 °35', the 6th east longitude which are determined by the topographic map of the scale 1:200000 (sheet K-39-XIX) of the edition of 1979.

4. Final point of the line of demarcation is the point with coordinates 42 °33', the 6th northern latitude and 49 °53', 3 east longitudes.

The specified point can be accepted as point of joint of the lines of demarcation of bottom of the Caspian Sea between the Russian Federation, the Azerbaijan Republic and the Republic of Kazakhstan that will be fixed in the tripartite agreement between them.

5. The line of demarcation is applied on the scheme of differentiation of adjacent sites of bottom of the Caspian Sea approved by the Parties (Appendix).

Article 2

1. The parties perform the sovereign rights concerning mineral resources and other lawful economic economic activity connected with subsurface use at the bottom within the ground sectors / zones to the line of demarcation determined in Article 1 of this agreement.

2. Development of mineral resources of the structures crossed by the line of demarcation will be performed on the basis of the international practice applied in case of development of cross-border fields, the authorized organizations appointed by the Governments of the Parties.

3. The governments of the Russian Federation and the Azerbaijan Republic draw up to the authorized organizations the rights to development of mineral resources of the structures crossed by the line of demarcation determined in Article 1 of this agreement within the ground sectors / zones to the specified line of demarcation.

4. Authorized organizations of the Parties on the basis of internationally acknowledged practice of development of cross-border fields with the consent of the Governments of the Parties will sign the corresponding agreements on cooperation.

Article 3

This agreement does not affect the rights and obligations of the Parties following from other international treaties which participants they are for signature date.

Article 4

Disagreements in interpretation and application of provisions of this agreement are permitted by negotiations and other means at the choice of the Parties.

Article 5

This agreement does not interfere with achievement of consensus of the Caspian states on legal status of the Caspian Sea and is considered by the Parties as part of their general arrangements.

Article 6

The parties will promote achievement of consensus of the Caspian states about differentiation of bottom of the Caspian Sea taking into account the principles of this agreement.

Article 7

This agreement is temporarily applied from the moment of signing and becomes effective from the date of the last written notice of accomplishment of the interstate procedures by the Parties necessary for its entry into force.

It is made in the city of Moscow on September 23, 2002 in duplicate, everyone in the Russian and Azerbaijani languages, and both texts are equally authoritative.
