About fight against tuberculosis in the Azerbaijan Republic

(as amended on 19-05-2020)

This Law establishes organization-legal bases of protection of the population against tuberculosis, the right and obligation of the patients with tuberculosis of persons.

Chapter I. General provisions

Article 1. Measures for fight against tuberculosis and principles of their implementation

Measures for fight against tuberculosis (sanitary and improving and anti-epidemic measures, inspection, diagnostics, treatment, prevention and rehabilitation) in the Azerbaijan Republic are performed according to the procedure, established by this Law and other corresponding regulatory legal acts.

Measures for fight against tuberculosis are carried out for all citizens and persons without citizenship who are constantly living in the Azerbaijan Republic is non-paid, on an equal basis, with respecting the rule of law, humanity, rights of man and citizen.

Inspection and treatment of the foreigners who asked for medical care in TB medical institutions in the Azerbaijan Republic are performed in the procedure established by the legislation.

Article 2. The legislation of the Azerbaijan Republic on fight about tuberculosis

The legislation of the Azerbaijan Republic on fight against tuberculosis consists of this Law, other regulatory legal acts and interstate agreements supported by the Azerbaijan Republic.

Other legal acts of the Azerbaijan Republic cannot limit the rights of citizens provided by this Law in the field of fight against tuberculosis.

Article 3. Scope of the Law

This Law extends to the citizens of the Azerbaijan Republic, foreigners who are constantly living in the Azerbaijan Republic persons without citizenship and on all legal entities irrespective of form of business.

Chapter II. Types of the antituberculous care guaranteed by the state and social protection

Article 4. Measures for rendering the antituberculous care guaranteed by the state

Antituberculous care is provided:

creation of the organizations giving antituberculous out-patient, stationary and sanatorium care;

the organization of the general education of the children who are on treatment for disease of tuberculosis in TB stationary facilities and sanatoria;

the organization of labor therapy in antitubercular dispensaries;

creation of organizations with the facilitated working conditions for job security of the patients with tuberculosis of persons (workers, persons with disability, including children up to 18 years with limited opportunities of health which are in especially heavy and especially harmful working conditions);

obligatory establishment at the state companies, in organizations and the organizations of quotas of workplaces for the patients with tuberculosis of persons with disability, including children up to 18 years with limited opportunities of health;

creation of special medical institutions (hospitals boarding schools, etc.) for content on complete state providing the persons which lost social touches and who got sick with infectious chronic forms of tuberculosis;

implementation of other necessary measures for social protection of persons having tuberculosis.

For the purpose of rendering antituberculous care the state guarantees:

acceptance and implementation in the territory of the Azerbaijan Republic of "The national program for prevention of spread of tuberculosis";

emergency antituberculous care;

conducting the examinations connected with tuberculosis;

the social help, including first-priority provision by the patient who got sick with infectious form of tuberculosis, the isolated living space, providing persons suffering from tuberculosis and its consequences, work;

specific prevention of tuberculosis, advisory diagnostics, treatment and rehabilitation help in out-patient, stationary, sanatorium conditions in TB public medical institutions;

rendering specialized medical care to persons who got sick with the tuberculosis serving sentence in organizations of serving sentence;

in case of delivery of health care to persons who got sick with tuberculosis compensation in the procedure for the damage caused to their health established by the legislation.

Article 5. The legal entities and physical persons giving antituberculous care

Antituberculous care appears the doctors-phthisiatricians having the higher medical education and performing activities based on special permission according to the procedure, established by the legislation of the Azerbaijan Republic, and the specialized public, local and private medical institutions which got special permission from relevant organ of the executive authority for rendering such type of the help.

Registration and accounting of patients in all TB medical institutions irrespective of pattern of ownership are performed according to the procedure, established by relevant organ of the executive authority.

Article 6. Types of antituberculous care and rule of its rendering

Types of antituberculous care are specified in the charter of medical institution or in issued in the procedure established by the legislation special permission what the patient shall be notified on.

Measures for rendering the antituberculous out-patient and polyclinic, preventive and anti-epidemic care, measure for stationary and out-patient treatment, and also for rehabilitation (including in sanatorium conditions) are performed according to the procedure, established by relevant organ of the executive authority.

Article 7. Types of the antituberculous out-patient care

The antituberculous out-patient care is performed in the procedure established by relevant organ of the executive authority in the form of the medical and diagnostic help and dispensary control.

The medical and diagnostic help to the patient with tuberculosis to person appears the doctor-phthisiatrician based on the individual appeal or the direction of treatment and prevention facility, and to minors - according to the petition of parents or legal representatives.

Dispensary observation of the patient with tuberculosis of person is conducted irrespective of its consent and covers regular control of condition of tubercular process from the local doctor-phthisiatrician, rendering the necessary medical and public assistance to this person.

Obligatory dispensary observation also extends to persons subject to high risk of disease of tuberculosis.

Article 8. Antituberculous stationary care

Persons who got sick with tuberculosis and the patients allocating tubercular sticks are without fail hospitalized.

Hospitalization of persons suspected of disease of tuberculosis and the TB patients who are not constituting danger to people around is performed based on medical indications.

Need of hospitalization is determined:

in case of direct threat of life of the patient and to people around;

in case of considerable deterioration in health of the patient as a result of complication of general condition;
