The decision on competitive situation in the markets of air transportation of the State Parties of the CIS

The Council of Heads of Government of the Commonwealth of Independent States DECIDED:

1. Take into consideration the report "About competitive situation in the markets of air transportation of the State Parties of the CIS" it (is applied).

2. To the governments of the State Parties of the CIS in case of implementation of the Decision of Council of CIS Heads of Government of November 22, 2007 about the Main directions of development of civil aviation and measures for increase in safety of flights in the State Parties of the CIS to consider conclusions and offers of the specified report for the purpose of effective market development of passenger air transportation in the State Parties of the CIS.

3. To interstate council on the antimonopoly policy and Council for aircraft and use of airspace to assist national antimonopoly authorities and competent authorities in the field of civil aviation of the State Parties of the CIS in development of the competition in the national markets of air transportation and potentially competitive segments of the markets adjacent to the markets of air transportation.

It is made in the city of Chisinau on November 14, 2008 in one authentic copy in Russian. The authentic copy is stored in Executive committee of the Commonwealth of Independent States which will send to each state which signed this Decision, its verified copy.

The report "About competitive situation in the markets of air transportation of the State Parties of the CIS"

Introduction

The modern international economic relations are characterized by growth of openness and interdependence of national economy, rapid development of information technologies, the international goods markets. The competition becomes more and more sharp and acquires the international nature.

Transport is one of the key factors integrating economy of the State Parties of the CIS. In this sense air transportation has crucial importance. Implementation competitive and development of the market relations are the main mechanism of goal achievement of effective economy.

Level of air transportation in the State Parties of the CIS does not meet the requirements of integration, the activities of this sector which are not corresponding to social requests of citizens of gosudarstvuchastnik of the CIS which mobility of movement in borders of the CIS owing to small availability of the aircraft transport is substantially limited are insufficiently effective.

Prior to the beginning of the 90th years of the 20th century the aviation message in the former USSR developed very high rates, and in 1989 indicators were at the level of developed countries. The economic and political crisis in the 90th years led to sharp reducing air transportation. At this time there was approximately quadruple reducing both amounts of transportation of passengers, and passenger turnover. The main recession had for the beginning of the 90th years. Since the end of the 90th years the strong growth of air transportation takes till present place. However as of 2005 in comparison with 1990 lagging in amounts of air transportation is still big and constitutes approximately time 1,5. There was reducing number of the airports. Substantially growth of air transportation within the last 8-10 years is caused by growth of economy of the State Parties of the CIS though in many respects it still has recovery nature. According to forecasts, amounts of air transportation can be recovered to the level of 1990 in 2012-2015.

At the same time air transport, being one of most quickly and dynamically developing industries of the world economy, is designed to become one of real tools on achievement of this purpose.

Successful functioning of the market of passenger air transportation - not only means of satisfaction of solvent demand for transportations of passengers, but also the important factor promoting expansion of internal and interstate bonds in the Commonwealth.

The decision of Council of CIS Heads of Government of November 22, 2007 approves the Main directions of development of civil aviation and measure for increase in safety of flights in the State Parties of the CIS (further - the Main directions of development of civil aviation) in which particular purposes and tasks of development of civil aviation, namely: provide economic air traffics and increase amounts of air transportation according to the growing needs of citizens of the State Parties of the CIS; expand participation of the State Parties of the CIS in international carriages due to increase in competitiveness in the world market of air-transport services. The main directions of development of civil aviation correspond to the main directions of development of transport system both in the CIS in general, and within other integration associations of the states in the former Soviet Union.

As it is especially noted in the Main directions of development of civil aviation, serve as guarantee of successful accomplishment of objectives: unity of technical base and the applied technologies; similarity of financial and economic condition of the air enterprises and tasks in the State Parties of the CIS; growth of real incomes of the population of the State Parties of the CIS; high level of unification of regulatory framework in the field of civil aviation; the general borders and air passage passing from Europe and North America to Asia; community of the people, culture and languages.

In this sense the task set by Council of CIS Heads of Government on forming of model legislative and other regulatory legal acts on different activities of civil aviation, including the Model agreement of the State Parties of the CIS on air traffic for application at the bilateral and regional levels, is one of first-priority for development of the competition in the market of air transportation.

The investigations and legal proceedings made by competitive departments concerning similar anti-competition practice can infringe on interests of other states in certain cases. At the same time situations in which competitive department of affected countries has no opportunity to stop or take any other measures concerning the actions directed against the competition from large business groups are possible.

All this determines need of development of cooperation concerning competition policy and first of all for the purpose of overcoming negative effects of anti-competitive actions, increase in efficiency of measures for suppression of anti-competition practice of the companies located in the territory of one state if their activities infringe on interests of other states and has an adverse effect on development of international trade.

These aspects determine requirement of use of new conceptual approaches to implementation of competition policy as at the national, and regional and international levels that causes need of interaction of antimonopoly authorities of the different countries.

Activities in the field of the antimonopoly policy are the indivisible element of integration development of gosudarstvuchastnik of the CIS providing market nature of the undertaken reforms according to the principles of workable competition, promoting thereby development of trade and economic relations between the states. Not accidentally so essential attention is paid to questions of the competition in the course of forming of regional integration associations on space of the CIS.

State cooperation - members of the CIS in the field of the competition has under itself the strong legal basis which is based on the Agreement on carrying out the approved antimonopoly policy of December 23, 1993 (further - the Agreement, in 2000 new edition of the Agreement is signed).

For the purpose of implementation of the Agreement of the Party founded Interstate council on the antimonopoly policy of the State Parties of the CIS (MSAP) which members are representatives of 11 State Parties of the CIS.

In 2006 at the XXIV meeting of MSAP the decision on carrying out the State Parties of the CIS by antimonopoly authorities of joint surveys (investigations) anti-competition practice of the companies operating in the international markets within the CIS is made. Shtab on joint investigations of antitrust violations in the State Parties of the CIS is created (further - Shtab). Experts from antimonopoly authorities of the State Parties of the CIS were Shtab's part. The deputy manager of Federal Antimonopoly Service of the Russian Federation Golomolzin A. N. is elected the head Shtaba.

At one of the first meetings of the Headquarters the markets which successful functioning provides creation of the infrastructure which is basis of forming of the Common Economic Space within the CIS are determined and also exerts direct impact on welfare of citizens of the State Parties of the CIS.

As one of such markets the market of passenger air transportation is determined by routes between the State Parties of the CIS as sharp decrease in share of the made passenger air transportation both between the State Parties of the CIS, and in the domestic market in their total amount did not correspond to steady growth rates and increase in goods turnover between the State Parties of the CIS (fig. 1) *.

By results of the made investigation this report is prepared.
