Chapter 1. General provisions

Article 1. The basic concepts used in this Federal Law

For the purposes of this Federal Law the following basic concepts are used:

1) information on activities of state bodies and local government bodies - information (including documented) created within the powers by the state bodies, their territorial authorities, local government bodies or the organizations subordinated to state bodies, local government bodies (further - the subordinated organizations), or arrived in the specified bodies and the organizations. To information on activities of state bodies and local government bodies also the laws and other regulatory legal acts, and belong to information on activities of local government bodies - the municipal legal acts establishing structure, powers, procedure for forming and activities of the specified bodies and the organizations, other information concerning their activities;

2) state bodies - the public authorities of the Russian Federation, public authorities of subjects of the Russian Federation and other state bodies formed in accordance with the legislation of the Russian Federation, the legislation of subjects of the Russian Federation;

3) the user information - the citizen (physical person), the organization (legal entity), public association performing information search about activities of state bodies and local government bodies. Users information are also state bodies, local government bodies performing search of the specified information according to this Federal Law;

4) request - the address of the user information in oral or written form, including in the form of the electronic document, in state body or local government body or to his official about provision of information on activities of this body;

5) the official site - the website on the Internet (further - Internet network) containing information on activities of state body, local government body or the subordinated organization which e-mail address includes domain name, the rights to which belong to state body, local government body or the subordinated organization, in Internet networks;

6) the official page - the personal page in the information systems and (or) programs for the electronic computers conforming to requirements, the stipulated in Article 10.6 Federal Laws of July 27, 2006 No. 149-FZ "About information, information technologies and on information security" determined by the Government of the Russian Federation created by state body, local government body or the subordinated organization and containing information on their activities.

Article 2. Coverage of this Federal Law

1. Operation of this Federal Law extends to the relations connected with ensuring access of users information to information on activities of state bodies and local government bodies.

2. If the Federal constitutional Laws, the Federal Laws and other regulatory legal acts of the Russian Federation accepted according to them provide features of provision of separate types of information about activities of state bodies and local government bodies, provisions of this Federal Law are applied taking into account the features provided by these Federal constitutional Laws, the Federal Laws and other regulatory legal acts of the Russian Federation.

3. If the laws and other regulatory legal acts of subjects of the Russian Federation adopted on areas of jurisdiction of subjects of the Russian Federation provide features of provision of separate types of information about activities of state bodies of subjects of the Russian Federation and local government bodies, provisions of this Federal Law are applied taking into account the features provided by these laws and other regulatory legal acts of subjects of the Russian Federation.

4. Operation of this Federal Law extends to the relations connected with provision by state bodies and local government bodies of information on the activities for requests of editorial offices of mass media in the part which is not settled by the legislation of the Russian Federation on mass media.

5. Operation of this Federal Law does not extend on:

1) the relations connected with ensuring access to personal data which processing is performed by state bodies and local government bodies;

2) procedure for consideration by state bodies and local government bodies of addresses of citizens;

3) procedure for provision by state body, local government body in other state bodies, local government bodies of information on the activities in connection with implementation by the specified bodies of the powers.
