About especially protected natural territories and objects

Especially protected natural territories and objects are national property of the Azerbaijan Republic and represent special ecological, scientific, cultural and esthetic value.

This Law establishes the legal basis of the organization and protection of especially protected natural territories, preserving especially protected natural objects in the territory of the Azerbaijan Republic.

Chapter I. General provisions

Article 1. Concept about especially protected natural territories and objects

Especially protected natural territories - land areas and waters (water area) consisting of natural complexes and objects, places of distribution rare and being under the threat of the disappearance of types of vegetation and animals representing special ecological, scientific, cultural, esthetic and improving value which fully or partially, constantly or are temporarily withdrawn from economic circulation, and atmospheric space over them.

Especially protected natural objects - the rare, being under the threat of disappearance, characteristic, zoological, botanical, dendrology, hydrological, geological, geomorphological, hydrogeological, forest, landscape and land objects with specific mode of protection representing scientific, cultural, esthetic and improving value.

Article 2. The legislation on especially protected natural territories and objects

The legislation on especially protected natural territories and objects consists of this Law, the Law of the Azerbaijan Republic "About environmental protection" and other regulatory legal acts.

Article 3. The basic principles of the organization, protection and use of especially protected natural territories

The organization, protection and use of especially protected natural territories are based on the principles:

preserving biological diversity and natural ecological system;

target use of especially protected natural territories and objects, and also their effective use for development of science, culture, education and education;

tourism developments and recreations taking into account socio-economic factors and interests of local population;

state regulation and control in the field of especially protected natural territories and objects;

in the cases of paid use of especially protected natural territories and objects provided by the Law;

participations of the population and public associations in the field of protection of especially protected natural territories and objects;

international cooperation.

Article 4. Property on especially protected natural territories and objects

Especially protected natural territories and objects of the international, republican and regional value which are in the territory of the Azerbaijan Republic belong to the Azerbaijani state without damnification to the rights and interests of these or those physical persons or legal entities, and cannot be aloof.

Transfer of especially protected natural territories and objects of local value to property of municipalities is performed in the procedure established by the legislation.

Especially protected natural territories and objects can create physical persons and legal entities, in property which use and lease there are parcels of land.

Chapter II. The organization of especially protected natural territories

Article 5. Types of especially protected natural territories

Especially protected natural territories in the territory of the Azerbaijan Republic depending on the purpose, the mode of protection and features of use are subdivided into the following types:

national natural parks, including biospheric;

national parks;

natural parks;

ecological parks;

state natural wildlife areas;

nature sanctuaries;

zoological parks;

botanical gardens and dendrology parks;

medical and improving areas and resorts;

geological parks.

By the legislation of the Azerbaijan Republic also other types of especially protected natural territories can be provided.

The status of organizations of conservation and scientific institutions or organizations is provided to the types of especially protected natural territories specified in paragraphs 2, of 3, of 4, 8, 9 and 11 parts one of this Article irrespective of their categories.

Especially protected natural territories with the status can have symbols (flags, emblems, etc.).

General provisions by types of especially protected natural territories specified in paragraphs 2, of 3, 4, 6 and 11 parts one of this Article affirm relevant organ of the executive authority.

Article 6. Categories of especially protected natural territories and objects

Especially protected natural territories and objects in the Azerbaijan Republic are subdivided into categories of the international, republican, regional and local value.

The territories of the national natural parks, geological parks and national parks belong to especially protected natural territories of republican value.
