ORDER OF THE MINISTRY OF INTERNAL AFFAIRS OF UKRAINE

of July 26, 2004 No. 822

About approval of Rules of road transportation of dangerous goods

(as amended on 22-04-2014)

According to requirements of the laws of Ukraine "About transportation of dangerous goods", "About road transport", "About accession of Ukraine to the European agreement on the international road delivery of dangerous goods (DOPNV)", and also for the purpose of safety control of transportation of dangerous goods by road transport of PRIKAZYVAYU:

1. Approve Rules of road transportation of dangerous goods (daleepravil) (are applied).

2. Determine the single nation-wide center which performs management in industry of special training of drivers of the vehicles transporting dangerous goods, Department of the State traffic inspectorate of the Ministry of Internal Affairs of Ukraine.

3. To the chief Gosavtoinspektion of the Ministry of Internal Affairs of Ukraine militia colonel Georgiyenko G. V.:

3.1. Till October 1, 2004 to determine the basic educational and methodical centers, where to organize training of teachers of the regional centers and retraining of workers of the State traffic inspectorate to whom obligations on control of transportation of dangerous goods are assigned.

3.2. Develop and approve in coordination with the Ministry of transport of Ukraine the educational and thematic plan and courses programs of special training of drivers of vehicles which transport dangerous goods, taking into account the approved Rules.

3.3. Provide the edition of Rules of road transportation of dangerous goods and through mass media to bring their requirements to permission of subjects of transportations of dangerous goods.

4. To chiefs of GUMVD of Ukraine in the Autonomous Republic of Crimea, the city of Kiev and Kiev region, Regional Office of the Ministry of Internal Affairs of Ukraine in areas, the city of Sevastopol to organize studying of requirements of this order in subordinate divisions of the State traffic inspectorate and to provide efficient control of its execution.

5. Consider the Ministry of Internal Affairs of the USSR which is not applied the order of 23.09.1985 No. 181 "About approval of the Instruction about safety control of transportation of dangerous goods by road transport".

6. To impose control of execution of the order on the deputy minister militia major general Prisyazhnyuk A. Y. and Department of the State traffic inspectorate (Georgiyenko G. V.) of the Ministry of Internal Affairs of Ukraine.

Rules of road transportation of dangerous goods

1. General provisions

1.1. These rules determine procedure and the main requirements to safety control of transportation of dangerous goods in all territory of Ukraine.

1.2. Requirements of these Rules are obligatory for subjects of managing irrespective of patterns of ownership which are participants of transportations of dangerous goods by road transport.

1.3. The international road carriages of dangerous goods are performed according to the European agreement on the international road delivery of dangerous goods (further - DOPOG) and other international treaties of Ukraine.

1.4. It is authorized to transport dangerous goods road transport only in cases if they according to requirements of DOPOG and these Rules are allowed to transportation and when all requirements to transportation of such loads are fulfilled.

1.5. Subjects of transportations of dangerous goods shall accept corresponding to type and degree of danger of measure, directed to prevention of casualties, and in case of occurred the avariimer allowing to limit as much as possible heavy effects of this accident.

1.6. In these Rules terms are used in the following values:

the load of bulk - any load, mainly homogeneous on structure, is not liquid or gas and consists of mix of particles, granules or any large pieces of the substance loaded without application of any kinds of container into the vehicle or container;

loads of the increased danger - dangerous goods which can be used not for designated purpose, and in the terrorist purposes and in compliance to lead to serious effects, such as mass death of people or big destructions. The freight list of the increased danger is determined according to DOPOG;

unit load - any packagings, unpacked product or any transport packet;

the loader - the legal entity or physical person performing loading: dangerous goods in the vehicle or big container, container, container for bulk goods, multielement gas container, container tank, the figurative tank on the vehicle;

responsible for filling - legal entity or physical person which loads dangerous goods into the tank (truck tank, the removable tank, the figurative tank or container tank) and (or) the vehicle, big or small container for transportation of dangerous goods in bulk (in bulk), and also transport means battery or multielement gas container;

the sender of dangerous goods - the legal entity or physical person specified in carriage documents which prepares also gives this load to transportation;

the mixing and charging machine (MEMU) - the machine or the vehicle with the machine established on it for production of explosive substances from the dangerous goods which is not explosive and their charging;

container for bulk goods - the system of content (including any of investments or covering), is intended for transportation of the solid substances which are in direct contact with system of deduction (it is intended for reusable use and has permanent appointment; it is specially designed for simplification of carriage of goods by one or several modes of transport without intermediate reloading of loads; it is equipped with devices, facilitating accomplishment of cargo operations with it, at least 1 m - 3) has amount. This determination does not cover container, container of average load-carrying capacity for bulk goods, large-size container and tanks;

nominal capacity of vessel - the nominal amount of the dangerous substance containing in vessel, expressed in liters. For cylinders with compressed gases capacity is their reservoir when filling with water;

the receiver of dangerous goods - the legal entity or physical person specified in carriage documents which receives dangerous goods from carrier;

the heating device - the device in which liquid or gaseous fuel is directly used and is not used heat which departs from the vehicle engine;

the operator of container tank (the figurative tank) - legal entity or physical person addressed to which the container tank (the figurative tank) is registered;

the packer - the legal entity or physical person filling with dangerous goods container including large-size container and containers of average load-carrying capacity for bulk goods, and also in case of need prepares packagings for transportation;

carrier of dangerous goods - legal entity or physical person which transports dangerous goods;

full load - any load of one consignor, in transit which the vehicle or big container is loaded only by this load and all transactions on loading or unloading of which are performed according to instructions of the consignor or consignee;

approvals of road transportation - approval of the State automobile inspection of the Ministry of Internal Affairs of Ukraine (further - the State traffic inspectorate of the Ministry of Internal Affairs of Ukraine) movements of vehicles by specific streets and roads, causing non-admissions of journey through commercial or residential districts, ecologically sensitive areas, industrial zones with dangerous objects or on roads of the vehicles constituting serious physical danger for participants of movement; requirements concerning movement and the parking during adverse weather conditions, earthquakes, accidents, strikes, public conflicts or act of war; traffic restriction of vehicles in certain days of the week or years;

the discharger - the legal entity or physical person performing unloadings of dangerous goods from the vehicle or big container; removes container, container for bulk goods, multielement gas container, container tank, the figurative tank from the vehicle; unloadings of dangerous goods from the tank (truck tank, the removable tank, the figurative tank or container tank) and (or) the vehicle, big or small container for transportation of dangerous goods in bulk (in bulk), container for bulk goods, and also from transport means battery, the mixing and charging machine or multielement gas container;

the container combined - the transport container containing one or several units of interior tare with products and if necessary intermediate container and auxiliary packaging means;

container crude - container which contains remaining balance of dangerous goods;

transport unit - the vehicle to which the trail car, or the vehicle and the trail car linked to it is not fastened;

the vehicle of the joint-stock company - the vehicle, except FL or OH vehicles, intended for transportation of dangerous goods in container tanks or figurative tanks or MEGK with an individual capacity more than 3 m - 3, and also in the built-in tanks or removable tanks with a capacity more than 1 m - 3, and also transport means batteries spaciousness over 1 m - 3, except transport means batteries like FL;

the EX/II or EX/III vehicle - the vehicle intended for transportation of explosive substances and products;

the FL vehicle - the vehicle intended for transportation of liquids with flash temperature not above 60 °C in container tanks or figurative tanks or MEGK with an individual capacity more than 3 m - 3, in the built-in or removable tanks with a capacity more than 1 m - 3; the vehicle intended for transportation of flammable gases in container tanks or figurative tanks or MEGK with an individual capacity more than 3 m - 3, in the built-in or removable tanks with a capacity more than 1 m - 3; transport means batteries with a total capacity more than 1 m - 3, the flammable gases intended for transportation;

the MEMU vehicle - the same, as the mixing and charging machine;

the OH vehicle - the vehicle intended for transportation of the stabilized hydrogen peroxide or the stabilized water solution of hydrogen peroxide with mass fraction of hydrogen peroxide more than 60% (class of danger of 5.1 No. of the UN 2015) in container tanks or figurative tanks with an individual capacity more than 3 m - 3, and also in the built-in tanks or removable tanks with a capacity more than 1 m - 3.

Other terms in these Rules are used in the values given in GOST 4500-1:2008 "Dangerous goods. Terms and determinations", No. 125 approved by Gospotrebstandart's order of Ukraine of April 16, 2008 (further - DSTU 4500-1:2008).

1.7. The provision of Rules does not extend on:

a) urgent transportations of dangerous goods which are performed for the purpose of rescuing of people or environment protection provided that all proper measures for ensuring complete safety of such transportations are taken and on implementation of such transportations it is informed State traffic inspectorates of the Ministry of Internal Affairs of Ukraine;

b) transportation of the machines or mechanisms which are not specified in appendix 15 to these Rules, containing dangerous goods in the indoor or operational equipment of these machines or mechanisms;

c) gases which contain in fuel tanks of the vehicle transporting and are intended for ensuring draft or for functioning of any equipment of the vehicle (for example refrigerating);

d) the gases containing in the equipment which is used for operation of the vehicle (for example, in fire extinguishers), and spare parts. These Rules extend to tires even if they are transported as load;

ґ) oxidizing gases and asphyxiating gases which are transported in vessels or reservoirs provided that gas pressure in vessel or the reservoir at temperature of 20 grad.s does not exceed 200 kPa (2 bars) and that during transportation gas entirely stays in gaseous state. Here any kinds of vessels and reservoirs which, for example, are part of the machinery and appliances join;

e) gases which contain in foodstuff (except for the food carried to No. of the UN 1950) or drinks;

e) the liquid fuel containing in fuel tanks of the vehicle which transports and is intended for ensuring draft or for functioning of any equipment of the vehicle. Total capacity of the built-in fuel tanks shall not exceed 1500 l on one transport unit, and the capacity of the tank established on trail car shall not exceed 500 l. In figurative fuel bowls (for example canisters) it is possible to transport no more than 60 l of fuel on one transport unit. These restrictions do not extend to vehicles of rescue services;

є) transportations of substances which are packed in the limited and exempted quantities, on condition of fulfillment of requirements to their packaging and the markings stated respectively in Chapters 3.4 and 3.5 of appendix A to DOPOG. Requirements of Item 11.6 of Section 11 and Item 12.23 of Section 12 of these Rules extend to transportation of dangerous goods which is packed in limited quantities;

g) the gases containing in balls for different types of sport;

h) gases (except the class gases 7) containing in electric bulbs provided that in case of their gap the effect of scattering is limited to packaging;

i) the lithium batteries established on the vehicle which transports and are intended for ensuring draft or for functioning of any equipment of the vehicle;

i) the lithium batteries containing in the equipment held for use in transit, also provide its functioning (for example, in the portable computer);

й) other loads which do not fall under action of DOPOG.

1.8. Requirements of such Sections of Rules are applied to transportation of dangerous goods in packagings without exceeding of the maximum quantities on transport unit which are specified in appendix 1 to these Rules:

Section 2 "Preparation of Dangerous Goods for Transportation";

Section 3 "Marking and Danger Signs on Unit Loads";

Section 4 "Methods of Transportation of Dangerous Goods", Items 4.3.8 and 4.3.9;

the Section 5 "General Requirements to Transport Units and Their Equipment", the subitem and) Item 5.2 (irrespective of registration date of vehicles);

Section 7 "Training of Drivers and Other Persons Whose Obligations Are Connected with Motor Transportations of Dangerous Goods", subsection 7.2;

Section 9 "Carriage documents", subitems "an" and "d" of Item 9. 1, Item 9.2;

the Section 11 "Loading, Unloading and Processing of Dangerous Goods", except Items 11.19-11.22;

Section 13 "Requirements to Crew of the Vehicle Which Transports Dangerous Goods", Item 13.6;

Section 14 "Supervision of Vehicles Which Transport Dangerous Goods";

Section 15 "Obligations of Participants of Transportations in the field of Safety Control of Road Transportation of Dangerous Goods";

Section 16 "Control of Road Transportation of Dangerous Goods".

2. Preparation of dangerous goods for transportation

2.1. Dangerous goods before transportation shall be classified and carried to one of classes (subclasses) of danger. At the same time additional danger, and for substances of classes of danger 3, 4.1 (except self-reactive substances), 4.2, 4.3, 5.1, 6.1, 8 and 9 also packing group is determined. For explosive substances and explosive products of class 1 the group of compatibility is in addition determined.

Classification of dangerous goods is given in the regulating document on products or in the material safety data sheet of substance and in the transport document.

2.2. According to specific names and properties, for substances or products according to appendix 15 to these Rules number of the UN, class (subclass) of danger, type of additional danger packing group and/or group of compatibility is determined.

If products or substance are not specified specifically according to names in appendix 15 to these Rules, their class (subclass) of danger, type of additional danger, the packing group and/or group of compatibility are determined by results of classification testing and if it is pertinent, by the table of priority of dangers. Identification of loads (determination of number of the UN and transport names) is performed according to requirements of part 2 appendix A to DOPOG.

These indicators for dangerous goods of class 1 and not specified specifically in the list of dangerous goods of desensibilizirovanny explosive substances of class 3 and class 4.1, of self-reactive loads of class 4.1, of organic peroxides of class 5.2 and infectious substances of class 6.2 are determined by the name by competent authority, and for other dangerous goods - the producer of products.

2.3. Products or substances are packed according to the packing instructionss provided in divisions 4.1.4.1 - 4.1.4.3 appendix A to DOPOG, taking into account general and special requirements if other method of transportation is not supposed. Types and types of container, large-size container or containers of average load-carrying capacity for bulk goods which use is not authorized packing instructionss shall not be used for transportation of this or that substance or product, except as specified, when it is authorized based on the temporary departure approved by the countries - members of DOPOG, according to Section 1.5.1 of appendix A to DOPOG.

Packagings which are not specified in the above-stated instructions can be used for domestic transports in the consent of competent authorities on condition of compliance to requirements of standards.

2.4. Dangerous goods is packed into container, including containers of average load-carrying capacity for bulk goods, and large-size container which shall be rather strong to bear blows and the loadings arising during transportation including in case of overloads, and also in case of any movement from the pallet or withdrawal from transport packet for the purpose of the further manual or mechanized processing. The container, including containers of average load-carrying capacity for bulk goods and large-size container, shall have such design and be closed so that to prevent any leakage of content which can arise in case of usual conditions of transportation as a result of vibration, change of temperature, humidity or pressure. On exterior surface of packagings there shall not be remaining balance of dangerous substances.

2.5. Different dangerous goods or dangerous goods together with other loads can be packed jointly into the combined container if joint packing is allowed according to provisions DOPOG and on condition of accomplishment of Section 4.1.10 of appendix A to DOPOG or the subitem b) Item 1.1.4.2 of appendix A to DOPOG if road transportation is performed to sea or air or after them.

2.6. The container, including containers of average load-carrying capacity for bulk goods and large-size container which is used for dangerous goods shall conform to requirements of DOPOG (standards).

2.7. Each unit of container, including containers of average load-carrying capacity for bulk goods and large-size container, except for interior tare in the combined container, shall correspond to the design type tested and approved according to the requirements stated in Chapters 6.1-6.6 of appendix A to DOPOG and to have proper marking.

2.8. The container before filling and presentation to transportation is checked by the consignor and shall not have traces of corrosion, pollution and other damages. The container intended for reuse with the advent of signs of reduction of durability shall not be used for transportations or shall be recovered so that to be capable to pass tests as design. At the same time it shall have proper marking according to Item 6.1.3.4 of appendix A to DOPOG.

2.9. The defective packages and packagings having defects, and also dangerous goods which filtered or scattered can be transported in the emergency container tested and marked according to requirements of Item 6.1.5.1.11 of appendix A to DOPOG. The emergency container can be used only if damage of packagings happened during transportation.

2.10. Responsibility for the correct classification, marking of dangerous goods, marking and suitability of own container before transportation of dangerous goods are born by the consignor.

3. Marking and danger signs on unit loads

3.1. Number of the UN corresponding of its content shall be applied on each unit load with dangerous goods. Before this number the letters "UN" are put down. On unpacked the product marking is applied on product or on its resistance, transport loading equipment or the device for its storage and start.

3.2. The name is in addition applied on each unit load with dangerous goods of the 1st class transport. This name shall conform to requirements of Section 3.1.2 of appendix A to DOPOG. Their commercial name is applied on the unit loads containing brisant explosive substances.

3.3. The emergency container is in addition marked by the word "EMERGENCY".

3.4. On containers of average load-carrying capacity for bulk goods with a capacity more than 450 l and large-size container marking shall be applied on two opposite sidewalls.

3.5. Marking on unit load shall be:

a) accurately visible and legible;

b) capable to sustain impact of any weather conditions without essential reduction of their quality.

3.6. Except specified in this Section of the label, marking in accordance with GOST 14192-77, precautionary marking according to requirements of GOST 31340:2009 and other marking - according to requirements of the normative and technical document of products is applied on unit loads and container.

3.7. In transit dangerous goods  the danger signs specified for these loads in appendix 15 to these Rules shall be applied on unit loads.

3.8. Danger signs shall correspond on color, symbols and general format to the samples given in appendix 2 to these Rules.

3.9. All danger signs on unit loads:

a) shall take place on the one hand, and on unit loads with loads of the 1st class - near transport the name;

b) shall be accurate, visible and maintain impact of weather conditions without essential decrease in their quality for cargo transportation and shall not be closed by another marking;

c) if drawing several danger signs is required, they shall be placed by row the friend near the friend;

d) shall take place on contrast background or have intermittent or continuous external circuit.

3.10. If the unit load has the irregular geometrical shape or the small sizes which do not allow to place properly on it danger signs, it is allowed to put them by means of reliably fixed label or in a different way.

3.11. On containers of average load-carrying capacity for bulk goods with a capacity more than 450 l and large-size container danger signs shall be attached on two opposite walls.

3.12. The handling instruction "Top" is put on counter parties of the unit loads containing liquids or the cooled liquefied gases in reservoirs with locks or air vents invisible outside and also on counter parties of the reservoirs (without exterior tare) equipped with air vents.

3.13. If in unit load there are two dangerous loads or more, it is designated by the corresponding danger signs and marking for each of loads. The sign of additional danger is not put in cases when the sign of the main danger already specifies this dangerous property of load.

3.14. The crude container from under dangerous goods shall be marked and designated by danger signs as well as in the filled condition.

3.15. Transport packets are marked in addition by the words "TRANSPORT PACKET".

3.16. It is allowed not to apply marking, danger signs, the warning signs and handling instructions "Top" on transport packet when the signs and marking applied on the unit load and products which are in this transport packet clearly visible outside.

If  it is necessary for different unit loads or products only one marking or one danger sign, they are enough to be put once.

3.17. The precautionary sign according to appendix 3 to these rules is applied on the unit loads containing loads which are dangerous to the environment. This warning sign is placed near marking. The precautionary sign for loads which are dangerous to environment is not applied on the unit loads containing (in single or interior tare) no more:

5 l of liquids are dangerous to the environment;

5 kg (net weight) of solid substances which are dangerous to the environment.

3.18. Danger signs and precautionary signs for loads which are dangerous to the environment shall have the form of the square turned on 45 °C with the minimum sizes of 100 x 100 mm. The handling instruction "Top" has the form of rectangle of 148 x 210 mm in size. The sizes of danger signs, the warning signs and handling instructions "Top" depending on the sizes of unit loads can be reduced on condition of their accurate visibility.

3.19. In cases of road transportation of dangerous goods before following maritime, rail or to airborne transportations or after them unit loads can be marked and designated by danger signs according to requirements of regulating documents which regulate transportations of dangerous goods by these modes of transport.

3.20. Iskyuchen according to the Order of the Ministry of Internal Affairs of Ukraine of 19.09.2013 No. 904.

4. Methods of transportation of dangerous goods

4.1. Depending on sort, the name, dangerous goods can be provided to transport danger and degree of danger to transportation:

unit loads (separate or created in transport packets) in vehicles and containers;

in bulk and embankment in tanks;

in bulk (in bulk) in vehicles and containers.

It is necessary for transportation of dangerous goods obligatory determinations of the permitted transportation method.

4.2. If the big container conforms to requirements which are applied to bodies of the vehicles provided in this part and regarding 6 of these Rules for specific loads, then in cargo platform of the vehicle on which such container is loaded, the specified requirements can not be applied.

4.3. Transportation in packagings

4.3.1. In packagings, containers of average load-carrying capacity for bulk goods and large-size container only those substances and products for which such method of transportation is allowed by provisions DOPOG can be transported.

4.3.2. Packagings can be loaded (if another is not provided) in:

a) the closed vehicles or closed containers;

b) vehicles are spread or containers are spread;

c) open vehicles or open top containers.

4.3.3. In the closed or covered vehicles or containers packagings with the container made of materials, sensitive to moisture, and also the packagings containing such dangerous goods are transported:

a) self-reactive substances (class of danger 4.1);

b) the substances capable to self-ignition (class of danger 4.2);

c) the substances emitting flammable gases in case of contact with water (class 4.3);

d) organic peroxides (class of danger 5.2);

d) other dangerous substances and products (danger class 9).

4.3.4. The packaging and unpacked items containing explosive substances and explosive products of the 1st class shall be transported only in EX/II and EX/III vehicles. The trail cars (except for semitrailer trucks) conforming to demands which are made to EX/II or EX/III vehicles can be towed by vehicles which do not conform to these requirements. The choice like the vehicle depends on quantity of load which is transported what is limited counting on one transport unit according to provisions of Item 4.3.6 of these Rules.

4.3.5. In transit loose and powdery substances, pyrotechnic means of the 1st class of danger which have classification codes 1.1 A, 1.1 C, 1.1 D, 1.1 G, 1.3 C and 1.3 G and also pyrotechnic means in container its floor shall have nonmetallic surface or covering.

4.3.6. Total mass net of explosive substance (for explosive products total mass net of the explosive substance containing in all products) which is transported on one transport unit, shall not exceed these Rules of indicators specified in table 1.

In case of joint loading in one transport unit of substances and products of different subclasses of the 1st class, all load is considered as load which belongs to the most dangerous subclass (in such procedure: 1. 1, 1.5, 1.2, 1.3, 1.6, 1.4). At the same time the net weight of explosive substances of group of compatibility of S is not considered.

In transit substances of subclass 1.5 D together with substances or products of subclass 1.2, all load is considered as load of subclass 1.1.

4.3.7. By mixing and charging machines it is allowed to transport only those explosive substances and products of class 1, which are intended for production of explosive materials by these machines and initiation of the explosive materials made by them, in the amount of requirement. Transportations of explosive substances and products in mixing and charging machines it is allowed under following conditions:

a) transportations of packagings and products with dangerous goods of the 1st class it is authorized competent authority;

b) packagings with explosive substances and products of the 1st class are loaded separately from other dangerous goods into special department which meets the requirements of subitem 6.8.9 of Item 6.8 of Section 6 of these Rules and which design is approved by competent authority;

c) the amount of explosive substances of group of compatibility of D does not exceed 200 kg;

d) the total quantity of detonators and/or their assemblies does not exceed 400 pieces.

Packaging with explosive substances and products of the 1st class shall be loaded into the mixing and charging machine only after loading of other dangerous goods and just before transportation.

In case to joint loading of explosive substances of the 1st class and substances of class 5.1 (No. of the UN 1942 or 3375) if such loading is resolved, all load is considered as load of brisant explosive substances for the purpose of separation, cargo placement and determinations of the maximum quantities

4.3.8. The closed vehicles and containers in which the packagings containing compressed or liquefied gases or the acetylene dissolved under pressure are transported are equipped with ventilation.

4.3.9. The organic peroxides and self-reactive substances requiring temperature control shall be transported without exceeding of control temperature, including loading, unloading, and also any intermediate stops. The temperature control methods specified in the special provision V8 of Chapter 7.2 of appendix A to DOPOG.

4.3.10. The amount of self-reactive substances of class 4.1 or organic peroxides of class 5.2 of types B, C, D, E or F, is transported on one transport unit, shall not exceed 20000 kg.

4.3.11. No. 904 is excluded according to the Order of the Ministry of Internal Affairs of Ukraine of 19.09.2013.

4.4. Transportations of dangerous substances or products in bulk (in bulk):

4.4.1. Dangerous substances or products are transported by bulk (embankment) in vehicles and/or containers if it is provided by provisions DOPOG. The crude empty container can be also transported by bulk.

4.4.2. Substances which can become liquid at temperatures which can arise during transportation are not allowed to bulk transport (in bulk).

4.4.3. Containers and bodies of vehicles shall have design which prevents emptying of dangerous goods. They shall be closed so that there was no danger of penetration of content outside under normal conditions transportations which include influence of vibration, airflow, change of temperature, humidity or pressure.

4.4.4. Loading of vehicles with the damaged bodies or the damaged containers is forbidden.

4.4.5. For prevention of damage of container or the vehicle, to overload of the vehicle or penetration of substance outside which can result from movement of bulked cargoes it shall be distributed regularly on container or vehicle bodies.

4.4.6. The ventilation devices established on containers and bodies of vehicles shall contain in net and serviceable condition.

4.4.7. Bulked cargoes shall not enter dangerous reaction with material of container, vehicle body, laying, the equipment, including the covers and coverings contacting to content in order to avoid essential reduction of their durability. Containers and bodies of vehicles shall be designed or equipped so that loads did not get into slots between elements of wooden floor or did not contact to those parts of container or the vehicle which they can influence.

4.4.8. Before loading and transportation inner and outer surfaces of container or the vehicle are inspected and cleared of remaining balance of loads which:

lead to emergence of dangerous reaction with substance, it will be loaded;

damage constructional integrity of container or body of the vehicle;

reduce capability of container or body of the vehicle to content of load.

4.4.9. In transit remaining balance of dangerous goods on exterior surface of container or body of the vehicle is not allowed.

4.4.10. Empty containers and vehicles, crude from remaining balance of dangerous goods, are allowed to transportation on the same conditions, as in the filled condition.

4.4.11. The additional requirements of Chapter 7.3 of appendix A to DOPOG provided for dangerous goods which will be loaded into them are applied to design of containers and bodies of vehicles in which transportations of the bulked dangerous goods and products containing dangerous substances are allowed.

4.5. Transportation in tanks

4.5.1. Dangerous substances can be transported in the built-in tanks (truck tanks), removable tanks, transport means batteries, figurative tanks, container tanks and multielement gas containers only if it is provided by provisions DOPOG.

4.5.2. Tanks shall be loaded only by that dangerous goods to which transportation they are allowed and which in case of contact with body materials of the tank, laying and the equipment cannot enter with them dangerous reaction, form dangerous products or considerably reduce material durability.

4.5.3. Chemically unstable substances are allowed to transportation only when all necessary measures for prevention of their dangerous decomposition, transformation or polymerization are taken during transportation.

4.5.4. Extent of filling by liquids of the built-in tanks, figurative tanks, container tanks, removable tanks shall not exceed the extreme values stated in Chapters 4.2-4.4 of appendix A to DOPOG.

4.5.5. If cases of the tanks intended for transportation of liquids are not divided by means of partitions or volnouspokoitel into compartments with a maximum volume of 7500 l, they shall be filled or more than 80% or less than 20% of their reservoir.

4.5.6. When loading substance in heated condition temperature of exterior surface of the tank, except for openings and their closing appliances or heat insulation, during transportation shall not exceed 70 grad.s.

4.5.7. Figurative tanks, container tanks, multielement gas containers shall be loaded on the vehicle so that to be protected by the equipment of the vehicle or own equipment from angle or longitudinal collisions and from turning. If the design of the specified tanks, including the service equipment, can bear blows and resistant to turning, then in similar protection there is no need.

4.5.8. Remaining balance of dangerous goods on exterior surface of the loaded and empty tanks is not allowed.

4.5.9. Interconnecting pipelines between the connected cases of tanks of transport unit and flexible hoses for filling and emptying which are not combined with the case permanent fixture during transportation shall be empty.

4.5.10. The substances capable to enter dangerous reaction with each other shall not be transported in adjacent compartments of tanks, except as specified, when between these compartments there is partition which thickness is at least thickness of walls of the tank. As dangerous reactions are considered:

a) ignition and (or) allocation of significant amount of heat;

b) release of flammable, suffocating, toxic and (or) oxidizing gases;

c) formation of corrosion substances;

d) formation of unstable substances;

ґ) dangerous recompression.

4.5.11. The substances capable to enter dangerous reaction with each other can be transported in compartments of the same tank if these compartments are differentiated by the ullage space or void space.

4.5.12. All elements of transport means battery or multielement gas container in transit shall contain only the same gas.

4.5.13. The empty crude tanks are allowed to transportation on the same conditions, as in the filled condition.

4.5.14. Cases of tanks, the elements of transport means batteries and multielement gas containers intended for transportation of dangerous goods and their equipment shall be checked periodically. The frequency of checks and the list of the transactions which are carried out in check time, specified in table 2 of these Rules. Besides, frequency and the list can be determined by GNAOP 0.00-1.07 - 94 "The rules of structure and safe operation of the vessels working under pressure" (approved by Gosnadzorokhrantrud's order of Ukraine of 18.10.94 No. 104).

(1) Internal examination of the figurative tanks intended for transportation only of one substance can not be carried out or replaced with other testing or procedures of check determined by competent authority or authorized organization.

(2) In coordination with competent authority, hydraulic test under pressure of cases of the tanks intended for transportation of the powdery and granulated substances can not be carried out or replaced with leak tests. For tanks with vacuum isolation testing and check of internal state can be replaced with leak tests and vacuum measurement.

(3) Upon the demand of competent authority between recurring inspections leak test in addition can be carried out.

(4) Elements and pipelines shall be subjected to tests with the frequency established by the instruction for packing P 200, provided in Item 4.1.4.1 of appendix A to DOPOG, or other regulating documents.

4.5.15. It is forbidden to fill the built-in tanks, removable tanks, container tanks, figurative tanks, transport means batteries and multielement gas containers, and also to present them for transportation after the termination of effective period of the last recurring inspection. But tanks which were filled before the termination of this term can be transported no more than three months after the termination of effective period of this last periodic test in time.

The empty crude built-in tanks, removable tanks, transport means batteries, figurative tanks, container tanks and multielement gas containers can be transported after the termination of term of their next testing only for passing of checks no more than three months after its termination in time.

4.5.16. In case of detection of any dangerous defect the tank is withdrawn from operation and is again allowed to it only after elimination of this defect and passing of testing.

4.5.17. If as a result of repair, changes of design or the road accident arise doubts in integrity of the case of the tank and operability of its equipment, extraordinary special inspection is carried out.

4.6. It is excluded

4.6.1. If the load owing to its chemical, physical and biological properties cannot be allowed to transportation by any from above-mentioned methods or requirements of these Rules cannot be fulfilled, the State traffic inspectorate of the Ministry of Internal Affairs of Ukraine in specific case allows variation from requirements of these Rules on condition of issue of the conclusion of authorized body in ecology industry about possibility of such transportation. In this conclusion necessary safety precautions of transportation are surely specified. If necessary conclusion of other competent authorities is provided.

4.6.2. The admission to transportation of dangerous goods with variation from requirements of these Rules is issued in writing. If the provided safety precautions are not carried out, the issued permission can be cancelled.

5. General requirements to transport units and their equipment

5.1. The transport unit loaded by dangerous goods shall not include more than one trail car or semitrailer truck.

5.2. On transport units which transport dangerous goods there shall be such fire appliances:

a) on each transport unit there shall be at least than one figurative fire extinguisher for suppression of the fires of classes A, B and C in reservoir of 2 kg of dry powder (or equivalent amount of other fire-fighting mix), suitable for fire suppression in the engine or in cabin of the vehicle;

b) on transport units which permitted maximum mass with load constitutes more 7,5 of t - one or more portable fire extinguishers for suppression of the fires of the classes A, V and S in cumulative reservoir of 12 kg of dry powder (or equivalent amount of other fire-fighting mix), in any case one of which has the minimum reservoir of 6 kg;

c) on transport units which permitted maximum mass with load constitutes more 3, t, but the t there is less 7,, - one or more portable fire extinguishers for suppression of the fires of the classes A, V and S in cumulative reservoir of 8 kg of dry powder (or equivalent amount of other fire-fighting mix) and in any case one of which has the minimum reservoir of 6 kg;

d) on transport units which permitted maximum mass with load constitutes 3,5 of t or less, - one or more portable fire extinguishers for suppression of the fires of the classes A, V and S in cumulative reservoir of 4 kg of dry powder (or equivalent amount of other fire-fighting mix).

Value of reservoir of the fire extinguisher(s) necessary according to subitem 5.2 a) of these Rules, can be taken away from value of the minimum cumulative reservoir of the fire extinguishers necessary according to subitems), c) or d).

5.3. The design of fire extinguishers shall prevent release of the toxic gases of fire extinguishing substances containing in them, both in usual conditions of transportation, and under the influence of temperature arising in case of the fire.

5.4. Portable fire extinguishers shall be sealed up, have marking about compliance of the standard and the text specifying date (month, year) of the termination of term of suitability.

5.5. Fire extinguishers shall be established on transport units in easily available places, and also to be protected from impact of weather conditions for the purpose of preserving their operational reliability.

5.6. Each transport unit, transports dangerous goods, without fail is completed with such equipment:

a) irrespective of numbers of samples of the danger signs specified for them in the List of dangerous goods provided in the table A of Chapter 3.2 of appendix A to DOPOG:

to at least one anti-recoil emphasis on each vehicle which shall correspond to the maximum mass of the vehicle and diameter of its wheels;

at least than two precautionary signs (devices) with own support (cones with light-reflective surface, or the blinking lamps of yellow color with self-contained supply, or breakdown triangles). Transport unit can be completed with any combination from the specified precautionary signs (devices);

vests of orange color with light-reflective elements for each crew member;

protective gloves for each crew member;

figurative lamps for each crew member. Lamps shall not have the open metal surfaces capable to bring to sparking;

eye protections (for example, goggles) for each crew member;

b) in transit all dangerous goods, except dangerous goods for which in the List of dangerous goods provided in the table A of Chapter 3.2 of appendix A to DOPOG numbers of samples of danger signs 1, 1.4, 1.5, 1.6, 2.1, 2.2 or 2.3, - in addition by liquid for washing of eyes are specified;

c) in transit dangerous goods for which in the List of dangerous goods provided in the table A of Chapter 3.2 of appendix A to DOPOG numbers of samples of danger signs 2.3 or 6 are specified. 1, - in addition the remedies of respiratory organs necessary for emergency escape of the vehicle, for each crew member of the vehicle (for example, panoramic mask with the combined protigazoayerozolny A1B1E1K1-P1 or A2B2E2K2-P2 filter according to the European EN standard 14387);

d) during transportation of liquid and firm dangerous goods for which in the List of dangerous goods provided in the table A of Chapter 3.2 of appendix A to DOPOG numbers of samples of danger signs 3, 4.1, 4.3, 8 or 9, - in addition are specified:

shovel;

covering for collecting pipes;

in reservoir for remaining balance of dangerous goods.

6. The requirements concerning basic vehicles

6.1. Basic EX/II, EX/III, FL, OX and AT vehicles, are allowed to transportation of dangerous goods, shall meet the requirements of DSTU UN/ECE R 105-00-2002 "The Uniform Instructions Concerning the Official Approval of the Vehicles Intended for Transportation of Dangerous Goods concerning Design Features".

6.2. Additional requirements to EX/II and EX/III vehicles, the unit loads intended for transportation with dangerous goods of the 1st class:

6.2.1. The materials used in design of bodies of vehicles.

In design of bodies it is forbidden to use the materials capable to form dangerous connections with explosive substances which are transported.

6.2.2. Heating devices:

a) on vehicles only heating devices intended for heating of driver's cab or the engine can be established. It is forbidden to establish the heating devices intended for heating of the cargo compartment of the vehicle;

b) heating devices shall conform to the following requirements:

the international Rules No. 122 of ECE "The rules concerning the official heater system approval and the vehicle on its heater systems" with observance of the application terms specified in them;

devices and their exhaust system of exhaust gases shall be designed, take place, be protected or be closed so that to avoid any danger of overheat and ignition of load. This requirement is considered executed if the fuel reservoir and the exhaust system of exit gases of these devices meet the requirements established for fuel tanks and exhaust systems of exhaust gases of vehicles;

devices shall turn on only manually;

the switch can be established outside driver's cab in the easily accessible place;

devices can be switched off from exterior of the cargo compartment;

the heat exchanger in case of regular service conditions can have work cycle in the inertia mode over 40 °C;

c) use of the heating devices using gaseous fuel is forbidden;

d) it is not allowed to establish heating devices in bodies of vehicles. Fuel tanks, power sources, air collectors and exhaust pipes which are used for functioning of the heating device shall not be established in the cargo compartment.

6.2.3. EX/II vehicles.

EX/II vehicles are designed and made so that to protect explosive substances and products from external danger and impact of climatic conditions. Vehicles shall be the closed or covered types. The coating material shall not get wet, shall be strong on gap, flame-resistant and in transit tense so that to block boards from all directions. The cargo compartment of the closed vehicles shall not have windows, and all openings shall have dense doors or covers which are closed. Between driver's cab and the cargo compartment shall be continuous wall.

6.2.4. EX/III vehicles.

EX/III vehicles are designed and made so that to protect explosive substances and products from external danger and impact of climatic conditions. Vehicles shall be the closed type. Between driver's cab and the cargo compartment shall be continuous wall. The surfaces adjoining to load are made continuous. All connections shall be pressurized. All doors, covers are equipped with locking devices and designed so that to provide their closings with overlapping of each other and openings. Bodies can be equipped with devices for fixing of load.

Bodies have to be made of heat resisting and fire-resistant materials at least 10 mm thick. If the body is made of metal, all its inner surface becomes covered with materials, conforming to the specified requirements.

6.2.5. Cargo compartment and engine.

The vehicle engine shall be ahead of the cargo compartment. Placement of the engine under the cargo compartment is allowed provided that heat during its work does not create danger to load but above 80 °C do not heat inner surface of the cargo compartment.

6.2.6. Cargo compartment and other configuration items of vehicles.

The design of EX/II and EX/III vehicles shall provide protection of inner surface of the cargo compartment against heating above 80 °C.

6.2.7. Electric equipment.

Rated rating shall not exceed 24 Century.

Electric equipment placed in the cargo compartment of EX/II vehicles it shall be protected from mechanical impact. The illumination devices established in the cargo compartment of these vehicles shall be placed in ceiling part and shall be closed. Availability of the unprotected wires and glow lamps is forbidden.

Electric equipment placed in the cargo compartment shall be dustproof (with degree of protection of IP54 or equivalent to it). In transit dangerous goods of the 1st class of danger of group of compatibility of J it shall have degree of protection of at least IP65 (for example, explosive cover of EExd).

6.3. The additional requirements concerning design of bodies of the vehicles intended for transportation of unit loads with dangerous goods (except EX/II and EX/III vehicles).

6.3.1. The heating devices intended for heating of the cargo compartment of vehicles shall meet the following requirements:

the switch can be established outside driver's cab in the easily accessible place;

devices can be switched off from exterior of the cargo compartment;

the heat exchanger in case of regular service conditions can have work cycle in the inertia mode over 40 °C.

6.3.2. On the vehicles intended for transportation of dangerous goods to which danger signs of samples 1, 1.4, 1.5, 1.6, 3, 4.1, 4.3, 5.1 or 5.2, fuel tanks, power sources, air collectors and exhaust pipes which are used for functioning of the heating device are applied shall not be established in the cargo compartment. It is forbidden to block load opening for release of heated air. The heating devices established in cargo compartments shall have such design which would exclude ignition of load and its heating is higher than temperature of 50 °C.

6.4. The additional requirements concerning design of bodies of the vehicles intended for transportation of bulked cargoes:

6.4.1. The heating devices intended for heating of the cargo compartment of vehicles shall meet the following requirements:

the switch can be established outside driver's cab in the easily accessible place;

devices can be switched off from exterior of the cargo compartment;

the heat exchanger in case of regular service conditions can have work cycle in the inertia mode over 40 °C.

6.4.2. On the vehicles intended for transportation of dangerous goods to which danger signs of samples 4.1, 4.3 or 5 are applied. 1, fuel tanks, power sources, air inlets and exhaust pipes which are used for functioning of the heating device shall not be established in the cargo compartment. It is forbidden to block load opening for release of heated air. The heating devices established in cargo compartments shall have such?? design which would exclude ignitions of load and its heating temperature of 50 °C are higher.

6.4.3. Bodies of vehicles shall meet relevant requirements of Chapter 7.3 of appendix A to DOPOG provided for dangerous goods which will be loaded into them.

6.5. Additional requirements to the vehicles intended for transportation of the substances requiring temperature control.

The isothermal vehicles, transport means glaciers and transport means refrigerators intended for transportation of the substances requiring temperature control shall meet the following requirements:

the design and the equipment shall provide maintenance of temperature in the cargo compartment not above the control temperature ordered for the transported substance. The general heat transfer coefficient shall not exceed 0,4 of W/m - 2 K;

vapors of substances or coolant shall not get into driver's cab;

the driver's cab is equipped with the device allowing the driver to control constantly temperature in the cargo compartment;

if in transit dangerous goods in the cargo compartment pressure can grow, it shall be equipped with air vents or valves which shall not create obstacles for chilling;

for operation of refrigeration equipment only special nonflammable coolants shall be used;

the design of refrigeration unit of transport means refrigerator shall provide possibility of its functioning in off-line mode irrespective of vehicle engine operation.

6.6. Additional requirements to the vehicles intended for carriage of goods of the increased danger.

The vehicles transporting dangerous goods which is loads of the increased danger shall be equipped with the systems of telemetry or other devices allowing to monitor movements of these loads.

6.7. The additional requirements concerning truck tanks, transport means batteries, and also vehicles used for transportation of dangerous goods in removable tanks, container tanks, figurative tanks or MEGK (vehicles of the EX/III, FL, OX and AT types).

6.7.1. The requirements concerning tanks.

The built-in tanks, removable tanks, container tanks, figurative tanks, elements of transport means batteries, MEGK shall meet relevant requirements of part 6 of appendix A to DOPOG and requirements of other regulating documents.

6.7.2. Fixtures.

Fixture of tanks to the vehicle shall be such to maintain the static and dynamic loads arising in case of usual conditions of transportation. For truck tanks, transport means batteries and vehicles which transport removable tanks loadings are calculated according to requirements of DOPOG.

6.7.3. Grounding of FL vehicles.

The metal tanks, tanks manufactured of the plastic reinforced by fiber of truck tank like FL and elements of transport means batteries like FL shall unite with the vehicle chassis at least one electric cable. It is necessary to avoid any contact which is capable to cause galvanic corrosion.

6.7.4. Resistance of truck tanks to capsizing:

a) support width on soil which is determined by distance between external contact points with soil of the right and left tires of one axis shall constitute at least 90% of height of centroid of loaded truck tank. For the loaded semitrailer truck of load of axes shall not exceed 60% of gross weight of the tractor with the loaded semitrailer truck;

b) truck tanks with a capacity more than 3 m - 3 which are registered for the first time, intended for transportation of dangerous liquids or dangerous goods in the melted condition and tested under pressure of less than 4 kgfs/cm - 2, shall conform to requirements of DSTU UN / ECE R 111-00: 2002 "Single technical instructions of rather official approval of truck tanks of categories N and O concerning resistance to capsizing" (international Rules No. 111 of ECE) of rather lateral stability.

6.7.5. Protection of truck tanks, transport means batteries, vehicles which transport removable tanks.

The specified vehicles are equipped behind on all width of the tank with protective bumper. Distance between back head of the tank or fittings (the crane, the valve, measuring instruments, etc.) that faces dangerous substance and the rear of bumper shall constitute at least 100 mm.

The requirement for the vehicle equipment protective bumper does not extend to vehicles with the tank dump truck and vehicles with vacuum tanks which unload through back head, and back armature of the case of such tanks the equipped means providing the same protection, as bumper.

6.7.6. Heating devices:

a) heating devices shall meet the following requirements:

the international Rules No. 122 of ECE "The rules concerning the official heater system approval and the vehicle on its heater systems" with observance of the application terms specified in them;

devices and their exhaust systems of exit gases shall be designed, take place, be protected or be closed so that to avoid any danger of overheat and ignition of load. This requirement is considered executed if the fuel reservoir and the exhaust system of exit gases of these devices meet the requirements established for fuel tanks and exhaust systems of exit gases of vehicles;

devices shall turn on only manually;

the switch can be established outside driver's cab in the easily accessible place;

devices can be switched off from exterior of the cargo compartment;

the heat exchanger in case of regular service conditions can have work cycle in the inertia mode over 40 °C;

b) the heating devices established on FL vehicles shall be switched-off:

manually - from driver's cab;

after engine shutdown of the vehicle (in this case the heating device can be switched on manually by the driver again);

after actuation on the pump vehicle for loading (unloading) of dangerous goods;

c) operation of the heating devices established on FL vehicles in the inertia mode after their shutdown is allowed. After engine shutdown or turning on of the pump air supply in combustion tube shall be stopped by means of appropriate means after work cycle in the inertia mode during no more than 40 °C. It is allowed to use only those heating devices which heat exchanger maintains the reduced work cycle in the inertia mode during 40 °C in case of usual conditions of their operation;

d) on the vehicles intended for transportation of dangerous goods to which danger signs of samples 1.5, 3, 4.1, 4.3, 5.1 or 5.2, fuel tanks, power sources, air inlets and exhaust pipes which are used for functioning of the heating device are applied shall have such?? design which would exclude ignitions of load and its heating 50 °C are above.

6.7.7. Electric equipment:

a) any additional elements of electric equipment of FL vehicles and their modifications shall meet the requirements which depending on substances which will be transported are applied to electric equipment of the corresponding group and the corresponding temperature range;

b) electric equipment of FL vehicles placed in explosive zones is calculated on operation in such zones and has the corresponding degree of protection.

6.8. Additional requirements to mixing and charging machines.

6.8.1. The requirements concerning basic vehicles.

Mixing and charging machines shall be established on basic EX/III vehicles.

6.8.2. The requirements concerning tanks, containers for bulk goods.

The tanks, containers for bulk goods established by mixing and charging machines shall meet relevant requirements of Chapter 6.12 of appendix A to DOPOG and requirements of other regulating documents.

6.8.3. Grounding of mixing and charging machines.

Tanks, containers for bulk goods, special departments for explosive substances and products of the 1st class, are manufactured of metal or plastic reinforced by fiber, shall unite with the vehicle chassis at least one electric cable. It is necessary to avoid any contact which is capable to cause galvanic corrosion.

6.8.4. Stability of mixing and charging machines.

Support width on soil which is determined by distance between external contact points with soil of the right and left tires of one axis shall constitute at least 90% of height of centroid of loaded truck tank. For the loaded semitrailer truck of load of axes shall not exceed 60% of gross weight of the tractor with the loaded semitrailer truck.

6.8.5. Protection of mixing and charging machines behind.

The specified vehicles shall be equipped behind on all width of the tank with protective bumper. The distance between back head of the tank or fittings faces dangerous substance, and the rear of bumper shall make at least 100 mm.

The requirement for the vehicle equipment protective bumper does not extend to vehicles with the tank dump truck which unload through back head, and back armature of the case of such tanks the equipped means providing the same protection, as bumper. This requirement does not extend to mixing and charging machines if the tanks established on it are protected from blows behind by other equipment (for example, mechanisms, pipelines, etc.), does not contain dangerous goods.

6.8.6. Heating devices:

a) heating devices shall meet the following requirements:

the international Rules No. 122 of ECE "The rules concerning the official heater system approval and the vehicle on its heater systems" with observance of the application terms specified in them;

devices and their exhaust systems of exhaust gases shall be designed, take place, be protected or be closed so that to exclude danger of overheat and ignition of load. This requirement is considered executed if fuel reservoirs and exhaust systems of exhaust gases of these devices meet the requirements established for fuel tanks and exhaust systems of exhaust gases of vehicles;

devices shall turn on only manually;

the switch can be established outside driver's cab in the easily accessible place;

devices can be switched off from exterior of the cargo compartment;

the heat exchanger in case of regular service conditions can have work cycle in the inertia mode over 40 °C;

b) use of the heating devices using gaseous fuel is forbidden;

c) fuel tanks, power sources, air collectors and exhaust pipes which are used for functioning of the heating device shall not be established in the cargo compartment with tanks. It is forbidden to block opening for release of heated air. The heating devices established in cargo compartments shall have such?? design which would exclude ignition of load and its heating 50 °C are above.

6.8.7. Additional requirements on prevention of risk of fire.

Mixing and charging machines are equipped with the automatic stationary device for fire suppression in the engine.

The load by the mixing and charging machine, is protected from heat which can be distinguished in case of fire of wheels, metal heat shields.

6.8.8. Protective equipment treatment of mixing and charging machines.

Production equipment and special departments of mixing and charging machines shall have locking devices.

6.8.9. Special departments for explosive substances and products of the 1st class.

Special departments for explosive substances and products of the 1st class shall have such?? design which will provide effective department of detonators and their assemblies from explosive substances or products of group of compatibility of D and at the same time will do impossible pass of detonation from detonators and their assemblies to substances and products of group of compatibility of D. It can be reached by use of the isolated departments or placement of one of these two types of explosive substances and products in special system of deduction. The design of special departments and systems of content shall affirm competent authority.

If the department is made of metal, then all its inner surface has to become covered with heat resisting and fire-resistant materials.

Special departments are located so that to be protected from blows and damages during movement of the vehicle, and also from impact of other dangerous goods, and ignition sources (for example, exhaust pipes).

6.9. Check of suitability of vehicles to transportation of dangerous goods.

6.9.1. On all vehicles suitable for transportation of dangerous goods, the State traffic inspectorate of the Ministry of Internal Affairs of Ukraine draws up the approval certificate of vehicles to transportation of certain dangerous goods (appendix 4) (further - the certificate). The certificate is carried out on the standard A4 format (210? 297 mm), has white color with pink diagonal strip.

6.9.2. The certificate is granted or prolonged by the relevant division of the State traffic inspectorate of the Ministry of Internal Affairs of Ukraine by results of check of compliance of design and the special equipment of the vehicle to requirements of these Rules.

6.9.3. For receipt of the certificate the owner of the vehicle or person authorized by it gives to division of the State traffic inspectorate of the Ministry of Internal Affairs of Ukraine vehicles, and also the following documents are completed according to assignment:

a) the request for each vehicle (the brand, number board of the vehicle, No. of the UN, in case of need the transport name and (or) packing group, class(es) or the name of group of loads for which transportation the vehicle will be used are specified);

b) information about DOPOG-svidetelstva on training of the transport drivers transporting dangerous goods (number by whom it is issued, date of issue, effective period);

c) information about certificates on training of the representative for safety issues of transportations of dangerous goods (number by whom it is issued, date of issue, effective period);

d) on each vehicle in addition:

copy of the registration certificate of the vehicle;

the copy of licensed card on the vehicle (in case of provision of services on transportation of dangerous goods by motor transport);

the copy of the protocol of check of technical condition of the vehicle issued by subject of carrying out mandatory engineering supervision of vehicles which is entered in the register of the State traffic inspectorate of the Ministry of Internal Affairs of Ukraine, or the international certificate of the technical inspection issued according to requirements of the Directive 96/96/EU and the Instruction No. 1 of UNECE;

copy of the policy of compulsory insurance of civil responsibility of owners of land vehicles;

the receipt on payment for the form of the certificate and service in execution of the competency certificate of vehicles to transportation of dangerous goods.

6.9.4. Workers of the State traffic inspectorate of the Ministry of Internal Affairs of Ukraine have no right to demand from the vehicle owner or person of provision of other documents authorized by it, except provided by subitem 6.9.3 of this Item.

6.9.5. Check of compliance of design of vehicles and the special equipment is made by visual survey. When checking of the understaffed vehicles only those configuration items which were added or modified are checked.

6.9.6. By results of check the employee Gosavtoinspektsii of the Ministry of Internal Affairs of Ukraine issues (continues) to the vehicle owner or person authorized by it the approval certificate of vehicles certified by the personal signature and seal of division of Gosavtoinspektion of the Ministry of Internal Affairs of Ukraine to transportation of certain dangerous goods. The certificate is granted prolonged) no later than ten working days after registration of a statement.

6.9.7. The bases for refusal in issue (prolongation) of the certificate are:

representations by the vehicle owner or his authorized representative of incomplete document package, determined by subitem 6.9.3 of this Item;

identification in the documents submitted by the vehicle owner or his authorized representative, false information (discrepancy of the vehicle to the data specified in the registration certificate of the vehicle; discrepancy of design and/or special equipment of the vehicle to requirements of these Rules).

6.9.8. In case of identification of violation of the requirements established to design and/or picking of the vehicle by pieces of the special equipment, the vehicle after elimination of the revealed shortcomings can repeatedly move on check in divisions of the State traffic inspectorate of the Ministry of Internal Affairs of Ukraine.

When carrying out rechecking configuration items of the vehicle and (or) pieces of the special equipment, not conforming to the established requirements are inspected or were absent during conducting the previous check.

6.9.9. The certificate is granted for the term which shall not exceed effective period of the protocol of check of technical condition of the vehicle issued by the subject of implementation of mandatory engineering supervision.

6.9.10. The information about all issued is also continued certificates is introduced in the magazine and in the automated information retrieval system of the State traffic inspectorate of the Ministry of Internal Affairs of Ukraine.

6.9.11. In case of damage or loss of the certificate during the term of its action the State traffic inspectorate of the Ministry of Internal Affairs of Ukraine according to the address of the vehicle owner or his authorized representative grants the new certificate based on information containing in the automated information retrieval system of the State traffic inspectorate of the Ministry of Internal Affairs of Ukraine.

7. Training of drivers and other persons whose obligations are connected with motor transportations of dangerous goods

7.1. Training of transport drivers who transport dangerous goods

7.1.1. The transport drivers who are carrying out transportation of dangerous goods take basic course of special preparation which shall cover without fail at least such subjects:

a) the main regulating documents regulating transportation of dangerous goods;

b) general views of danger;

c) harmful effects of dangerous substances on the environment;

d) preventive measures and security measures in case of different types of danger;

ґ) actions in case of accidents and incidents (provision of first aid, safety control of other participants of traffic, use of protective gear and so forth);

e) marking, danger signs (danger signs boards) and information tables of dangerous goods (plate of orange color);

e) requirements to crew of the vehicle transporting dangerous goods;

є) assignment and use of technical equipment of vehicles which transport dangerous goods;

g) prohibitions on the compatible loading and actions of safety connected with joint loading;

h) special requirements to joint transportation of dangerous goods and food, consumer goods and forages for animals;

i) security measures when loading and unloading dangerous goods;

i) general information about the civil responsibility;

ї) features of implementation of multimodal transportations of dangerous goods;

i) restrictions for movement via tunnels, traffic rules in tunnels, actions in case of accident in the tunnel (road accident, the fire, etc.);

j) security measures.

7.1.2. Transport drivers (including mixing and charging machines) who transport dangerous goods in the built-in or removable tanks with a capacity more than 1 CBM, drivers of the transport means batteries with a total volume more than 1 CBM and transport drivers (including mixing and charging machines) transporting dangerous goods in container tanks, figurative tanks and multielement gas containers with an individual volume more than 3 CBM pass, except the basic rate specified in subitem 7.1.1 of this Item, specialization course of preparation on transportation in tanks which can cover without fail the following subjects:

a) influence of cargo motion in the tank on stability;

b) controllability of the vehicle;

c) systems of filling and emptying of tanks;

d) additional carriage documents during transportation of dangerous goods in tanks;

ґ) marking about carrying out testing;

e) marking of tanks danger signs (information displays) and information tables of dangerous goods (plates of orange color).

7.1.3. Transport drivers, the transporting substances and products of the 1st class (except substances and products of subclass 1.4 groups of compatibility of S), drivers of the mixing and charging machines transporting the mixed consignments of the 1st class and substances of class 5.1 pass, except the basic rate specified in subitem 7.1.1 of this Item specialization course of preparation on transportation of substances and products of the 1st class which has without fail to cover at least the following subjects:

a) types of danger of dangerous goods of the 1st class;

b) special requirements to joint loading of dangerous goods of the 1st class;

c) marking of vehicles which transport dangerous goods of the 1st class, tanks with loads of this class signs boards of danger and information tables of dangerous goods (plates of orange color).

7.1.4. The transport drivers who are carrying out transportation of radioactive materials of the 7th class of danger pass, except the basic rate specified in Item 7.1.1 of these Rules, specialization course of preparation on transportation of radioactive materials of the 7th class of danger which shall cover without fail at least such subjects:

a) types of danger of radioactive materials of the 7th class;

b) special requirements to packaging, processing, joint loading and to the conclusion of radioactive materials;

c) marking of vehicles which transport dangerous goods of the 7th class, tanks with loads of this class signs boards of danger and information tables of dangerous goods (plates of orange color);

d) special actions in case of accidents during transportation of radioactive materials.

7.1.5. To the driver after the end of special preparation and successful passing an examination conforming to requirements of DOPOG, the State traffic inspectorate of the Ministry of Internal Affairs of Ukraine grants the certificate on preparation corresponding to the sample given in appendix 5 to these Rules.

7.1.6. Effective period of the certificate constitutes five years. The validity of the certificate is extended for the next five-year period if the owner of the certificate within the last year of action of its certificate completed course of retraining and successfully passed examination. Upon the demand of the driver the rate of retraining can be replaced with rate of initial training.

7.1.7. The certificate DOPOG on training of the driver (DOPOG-svidetelstvo about training of the transport drivers transporting dangerous goods) issued by competent authority of other State Party DOPOG is recognized valid during the effective period specified in it.

7.2. Training of other persons whose obligations are connected with road transportation of dangerous goods

7.2.1. Persons who are engaged in classification, packaging of dangerous goods, drawing marking or danger signs on packagings, in preparation of transport documents on dangerous goods, presentation and acceptance of dangerous goods in transportation, filling and emptying of tanks, loading of the packagings containing dangerous goods in vehicles or their unloading from vehicles, loading or unloading of containers, overload of dangerous goods and also persons which otherwise are directly connected with transportation of dangerous goods shall have training according to requirements of the relevant regulating documents.

7.2.2. After preparation passing to person the appropriate certificate is granted. Retraining of the personnel which are taking part in road transportation of dangerous goods shall be carried out in case of considerable changes in regulating documents.

8. Authorized (consultant) for safety issues of transportation of dangerous goods

8.1. All subjects of road transportation of dangerous goods irrespective of pattern of ownership shall appoint in writing one or several representatives for safety issues of transportations of dangerous goods (further - the representative). In case of assignment of several representatives of their obligation are specified in writing. If the owner of the company or the entrepreneur independently performs functions of the representative, then in written assignment there is no need.

The representative shall keep records about the activities with indication of time of monitoring procedure, surname, name and middle name of under control person and the name of under control technological transactions. Records are stored within five years.

8.2. Functions of the representative can be performed by such persons (provided that they are capable to carry out the representative's obligations):

a) director;

b) the employee of the company who is carrying out other obligations;

c) person which is not working at this company;

d) entrepreneur or owner of the company.

8.3. Due to the activities of the company connected with transportation of dangerous goods such functions are assigned to the representative:

a) control of the execution of requirements regulating transportation of dangerous goods;

b) up-to-the-minute information about the shortcomings reducing safety in transit of dangerous goods, the entrepreneur or the director;

c) within activities of the company of safety control of transportation of dangerous goods;

d) preparation of the annual report on the questions of activities of the company connected with transportation of dangerous goods for administration of the company or, in case of need, for the State traffic inspectorate of the Ministry of Internal Affairs of Ukraine and other competent authorities on transportation of dangerous goods;

ґ) ensuring identification of dangerous goods which is transported;

e) check when purchasing vehicles of their suitability to transportation of dangerous goods;

e) control in case of the choice of subcontractors or other participants of the transactions connected with transportation of dangerous goods of their capability to perform the functions;

є) check of suitability of the equipment which is used for transportation of dangerous goods or for cargo-unloading transactions;

g) verification of presence at workers who are engaged in transportation of dangerous goods, their loading and unloading of written instructions of accomplishment of transactions;

h) carrying out verifications of presence on vehicles of documentation, additional equipment and their compliance to the existing regulations;

i) acceptance died on informing workers on the danger connected with transportation, loading and unloading of dangerous goods;

i) ensuring proper training of workers of the company and accounting of such preparation;

ї) investigation of circumstances of accidents and violations which were made or revealed during transportation, loading or unloading of dangerous goods;

й) acceptance of necessary measures for accident prevention and repeatings of violations;

j) verification of presence at the company of the plan of security measures;

8.4. The annual report which is constituted by the representative shall contain:

a) the list of the dispatched dangerous goods which is transported or accepted, divided into classes;

b) quantity of the dangerous goods divided into four categories:

to 5 tons;

from 5 to 50 tons;

from 50 to 1000 tons;

more than 1000 tons;

c) quantity and the analysis of accidents with dangerous goods for which the report on events was constituted during transportation of dangerous goods according to Section 1.8.5 MPOG/DOPOG (appendix 6);

d) other data necessary for the analysis and assessment of security status of transportations of dangerous goods.

8.5. The annual report is constituted by the representative no later than six months for the termination of year and upon the demand of the State traffic inspectorate of the Ministry of Internal Affairs of Ukraine and other competent authorities on transportation of dangerous goods goes for check. The storage duration of the annual report constitutes five years.

8.6. The traffic accident report is constituted by the representative in case of accident as a result of which dangerous substances had the environment, than loss of property is caused or people suffered.

8.7. The representative shall complete the corresponding course of training and the nobility:

a) requirements of the national legal system concerning transportation of dangerous goods, and also international conventions, agreements and agreements;

b) classification of dangerous goods (the procedure of classification of solutions and mixes, structure of the list of dangerous goods, classes of danger and the principles of their classification, nature of the transported substances and products, their physical, chemical, toxicological properties);

c) general requirements to unit loads and unit transport loads (types, codes, marking, production, the checklist and testing);

d) marking, danger signs, the warning signs, signs boards of danger and information tables of dangerous goods (drawing marking, precautionary signs and danger signs on unit loads, fixtures of signs boards of danger and information tables of dangerous goods on unit transport loads);

ґ) requirements to carriage documents and procedure for their filling (commodity transport documents on dangerous goods, written instructions, the approval certificate of vehicles to transportation of certain dangerous goods, the certificate DOPOG on training of the driver, other documents);

e) methods of transportation and possible restrictions (transportation by full load, container transports, etc.);

e) requirements to crew of the vehicle and its professional training;

є) prohibitions on joint loading and the security measures connected with joint loading;

g) special requirements to joint transportation of dangerous goods and food, consumer goods and sterns for animals;

h) procedure for transportation of dangerous goods in the limited and exempted quantities;

i) requirements to loading, unloading and fixing of loads (loading and unloading, extent of filling, packaging);

i) cleaning and (or) decontamination before loading and after unloading;

ї) requirements to additional equipment;

й) modes and condition of carriages of dangerous goods;

j) the reasons of the accidents connected with transportation of dangerous goods and their effects.

8.8. For accomplishment of the functions the representative shall have the certificate on the corresponding preparation corresponding to the sample given in appendix 7 to these Rules. For receipt of the certificate the candidate shall pass examination in the State traffic inspectorate of the Ministry of Internal Affairs of Ukraine, according to DOPOG.

8.9. Effective period of the certificate constitutes five years. This term can be continued for the subsequent five-year period if the owner of the certificate within the last year of its action, completed course of retraining and successfully passed examination.

8.10. The certificate on training of the representative for safety issues of transportations of dangerous goods issued by competent authority of other State Party DOPOG is recognized valid during the effective period specified in it.

8.11. Each subject of transportation of dangerous goods upon the demand of the State traffic inspectorate of the Ministry of Internal Affairs of Ukraine and other competent authorities on transportation of dangerous goods shall provide information on the representative.

9. Carriage documents

9.1. In transit dangerous goods on transport unit, except listed in Traffic regulations, there shall be following documents:

a) commodity transport documents on dangerous goods. If the quantity of loads does not allow to load them all into one transport unit, then separate commodity transport documents are constituted or copies of one document on quantity of the loaded transport units are made.

On loads, cannot be loaded together into one vehicle because of prohibition on their joint loading, separate commodity transport documents are surely written out;

b) the approval certificate of vehicles to transportation of certain dangerous goods. If transport unit consists of several vehicles, on each vehicle there shall be separate approval certificate of vehicles to transportation of certain dangerous goods.

For the vehicles performing international carriages of dangerous goods also meet the requirements of DOPOG, the approval certificate of vehicles to transportation of certain dangerous goods is granted only on EX/II, EX/III, FL, OX vehicles, the joint-stock company and MEMU;

c) the certificate DOPOG on training of the driver or DOPOG-svidetelstvo about training of the transport drivers transporting dangerous goods (appendix 8);

d) written instructions.

The automobile carrier provides crew members of the vehicle with written instructions according to DOPOG (appendix 9).

Written instructions are stored in cabin of the vehicle in the easily accessible place.

The automobile carrier is responsible for acquaintance of the drivers participating in transportation with contents of written instructions and their execution properly;

ґ) in transit dangerous goods which is loads of the increased danger, - approval of road transportation of dangerous goods (the appendix 10) issued by the State traffic inspectorate of the Ministry of Internal Affairs of Ukraine;

e) if road transportation of dangerous goods in big container is carried out before sea, - the certificate on loading of big container / vehicle (appendix 11) which is issued by person or the organization, responsible for container load.

The certificate on loading of big container / vehicle is signed by person responsible for container load.

The certificate on loading of big container / vehicle can be included in commodity transport documents. In this case in commodity transport documents it is specified that the container load is carried out according to established on sea transport of requirements, and also the information about person responsible for container load is provided.

9.2. Commodity transport (and) the document(s) on dangerous goods shall (shall) contain the following information on everyone of dangerous substance, material or the product shown to transportation:

a) number of the UN before which the letters UN are put down;

b) transport the name, determined according to Section 3.1.2 of appendix A to DOPOG and in case of need added with the technical name;

c) for substances and products of the 1st class of danger: number of subclass and letter of group of compatibility and if substance or product has additional types of danger, - numbers of samples of the danger signs specified for dangerous goods in the list of dangerous goods provided in the table A of Chapter 3.2 of appendix A to DOPOG, the dangers specifying these types. For substances and products of other classes of danger: numbers of samples of danger signs specified for dangerous goods in the list of dangerous goods provided in the table A of Chapter 3.2 of appendix A to DOPOG.

Numbers of samples of danger signs specifying additional types of danger are specified in brackets

d) packing group if that is determined before which there can be letters "GP";

ґ) quantity and description of unit loads;

e) total quantity of dangerous goods (amount, weight gross or net weight depending on specific case);

e) name and location of the consignor;

є) name and location of the consignee (consignees).

In transit the empty crude unit transport loads containing remaining balance of dangerous goods of any class except class 7, and also in case of transportation of the empty crude vessels for gases with a capacity more than 1000 l depending on specific case of entry in commodity transport documents shall include such words as "the EMPTY TRUCK TANK", "EMPTY the removable tank", "PUSTAYA the figurative tank", "the EMPTY CONTAINER TANK", "EMPTY MEGK", "EMPTY TRANSPORT MEANS-BATTERY", "the EMPTY mixing and charging MACHINE", "EMPTY the VEHICLE", "the EMPTY CONTAINER", "empty vessel" after which there shall be words "LAST LOAD". This record shall be supplemented with information provided by subitems "a" - "" of Item 9.2 of this Section (for example: "EMPTY TRUCK TANK, LAST LOAD: UN 1017 CHLORINE 2.3 (5.1, 8)").

9.10. If dangerous goods is transported in emergency container, then after description of goods in commodity transport documents the words "EMERGENCY PACKAGING" are added.

9.11. In transit different dangerous goods in multisection tanks or transport units with several tanks in commodity transport documents has to be specified information provided by subitems "a" - "" of Item 9.2 of this Section, for each tank or section of the tank. This information not to be specified if on information the tables of dangerous goods attached to side surfaces of each tank or compartment of the tank it is possible to determine all substances loaded into tanks or tank compartment.

9.12. Entries in commodity transport documents shall be legible.

9.13. The sender and carrier of dangerous goods shall store the copy of the commodity transport document and attached to it, within at least 3 months.
