About Regulations on the Commission on interaction in the field of export control under Integration Committee of Eurasian economic community

The integration Committee of Eurasian economic community solved:

1. Approve Regulations on the Commission on interaction in the field of export control under Integration Committee of Eurasian economic community it (is applied).

2. Declare invalid Regulations on the Commission under Integration Committee on interaction in the field of export control and the Regulations of its work, approved by the decision of Integration Committee of February 15, 1999 (the protocol N 14, Item 14).

3. Ask the governments of state members of EurAsEC (daleestorona) to provide offers on inclusion of agents of the parties at the level of deputy managers of relevant organs of the executive authority or authorized persons of these bodies to structure of the Commission on interaction in the field of export control under Integration Committee of Eurasian economic community till April 25, 2002.

4. To the secretariat of Integration Committee of EurAsEC to create on the basis of offers of the Parties structure of the Commission on interaction in the field of export control under Integration Committee of Eurasian economic community and to submit it in accordance with the established procedure for consideration of Integration Committee of EurAsEC.

Regulations on the Commission on interaction in the field of export control under Integration Committee of Eurasian economic community

1. This Regulations on the Commission on interaction in the field of export control under Integration Committee of Eurasian economic community (further - the Commission) determine the purposes, tasks, competence, procedure for education and activities of the Commission.

2. The commission is body for interaction of state members of Eurasian economic community (further sootvetstvennostorona, EurAsEC or Community) on realization of the purposes and tasks of EurAsEC, and also the arrangements following from article 5 of the Agreement on single measures of non-tariff regulation when forming the Customs union of October 22, 1997.

3. In the activities the Commission is guided by the international treaties existing within EurAsEC, decisions of bodies of Community.

4. The commission acts on the basis of the this provision and the Regulations approved by the Commission.

5. The commission is responsible before Integration Committee of EurAsEC and is accountable to it.

6. The main objectives of the Commission are:

assistance to development and enhancement of national systems of export control of the Parties taking into account the international experience in the field, including for the purpose of creation of conditions for connection of the Parties to work in the international modes of export control;

development of offers for Integration Committee of EurAsEC on rapprochement and harmonization of legislations and mechanisms of export control of the Parties;

assistance to exchange of information between the Parties, including at the level of departments, on policy issues and practical aspects of activities in the field of export control.

7. The commission on the questions carried to its competence:

a) takes measures for implementation of decisions of bodies of Community and the international treaties existing within EurAsEC, concerning perspective of export control;

b) considers the questions connected with development and realization of the general principles of implementation of export control, harmonization of national legal systems of the Parties in this area and make in accordance with the established procedure offers in Integration Committee of EurAsEC;

c) performs the analysis of national legal systems of the Parties in the field of export control;

d) takes part in development and implementation of interstate projects, programs and other joint actions of the Parties connected with perspective of export control;

e) annually provides to Integration Committee of EurAsEC information on condition of processes of integration into areas of export control and the report on the work;

e) at the request of Integration Committee of EurAsEC interacts with similar bodies of other international organizations;

g) performs other functions within the competence.

8. The commission has the right:

a) develop within the competence the documents directed to implementation of decisions of bodies of Community and the international treaties signed within EurAsEC;

b) make in accordance with the established procedure offers on the questions entering competence of the Commission and also on drafts of decisions of Integration Committee of EurAsEC and Interstate Council of EurAsEC;

c) draw the conclusions according to drafts of international treaties on the questions entering competence of the Commission;

d) develop recommendations and specific proposals about harmonization (rapprochement, unification) of national legal systems of the Parties in the field of export control;

e) interact with bodies of Community;

e) request and obtain necessary information according to the national legal system of the Parties and decisions of bodies of Community;

g) submit in accordance with the established procedure for consideration of Integration Committee of EurAsEC of the offer on the conclusion of the agreements on performance of works connected with activity of the Commission within expense budget of Integration Committee of EurAsEC, provided on these purposes.

9. About two representatives from each of the Parties are part of the Commission. The structure of the Commission on representation of the Parties is created by the Secretariat of Integration Committee of EurAsEC and affirms Integration Committee of EurAsEC.

Members of the commission are deputy managers of executive bodies of the Parties or authorized persons of these bodies.

Members of the commission have the equal rights in case of discussion of questions.

10. The commission chairman is elected members of the commission from the structure open voting for a period of two years.

11. Commission chairman:

a) presides over commission sessions;

b) performs the common directorship of preparation of the questions submitted for consideration of the Commission;

c) exercises general control of implementation of the decisions made by the Commission;
