About non-governmental organizations (public associations and funds)

Chapter I. General provisions

Article 1. Purpose of this Law

1.1. This Law governs the relations connected with creation and functioning of public associations and funds, and also branches and representative offices of non-governmental organizations of foreign states.

1.2. In this Law "non-governmental organizations" are included into concept public associations and funds.

1.3. This Law establishes creation, activities, rules of reorganization and liquidation of non-governmental organizations as legal entities, activities of non-governmental organizations, management of them, their relations with public authorities.

1.4. This Law does not extend to political parties, labor unions, religious associations, local government bodies, and also the managements created for the purpose of implementation of functions, these organizations and other non-profit organizations regulated by other laws.

Article 2. Non-governmental organization

2.1. Public association - the voluntary, self-governed non-governmental organization which is not providing in quality of main objective of the activities of commercialization and not distributing the gained income among the members, created for the purpose of determined in its constituent documents at the initiative of several physical and (or) legal entities who united on the basis of common interests.

2.2. Fund - the non-governmental organization which does not have members, founded by one or several physical and (or) legal entities on the basis of property fee, pursuing social, charitable, cultural, educational or other socially useful purposes.

2.2-1. Branches and representative offices of non-governmental organizations of foreign states - the structures of the non-commercial legal entity created outside the Azerbaijan Republic determined in this way by the Civil code of the Azerbaijan Republic.

2.3. Non-governmental organization can be created and function for the purpose of, not prohibited by the Constitution and the laws of the Azerbaijan Republic. Creation and activities of non-governmental organizations are not allowed, and also branches or representative offices of non-governmental organizations of foreign states in the Azerbaijan Republic, the purpose or activities of which is directed to change by violent way of the constitutional system and secular nature of the Azerbaijan Republic, violation of its territorial integrity, propaganda for war, violence and cruelty, provoking of racial, national and religious hostility. Creation and activities of non-governmental organizations in Armed forces of the Azerbaijan Republic is forbidden.

2.4. Non-governmental organization cannot take part in election of the president of the Azerbaijan Republic, Millie of Majlis of the Azerbaijan Republic and municipalities, to give to political parties financial and other financial support. According to the electoral laws of the Azerbaijan Republic non-governmental organizations can observe, perform exit-poll behind the presidential elections which are held in the Azerbaijan Republic, elections to Millie Majlis and elections to municipalities. Foreign legal entities can participate in the actions connected with exit-poll during the election of the president of the Azerbaijan Republic, elections to Millie Majlis of the Azerbaijan Republic and municipal elections only together with non-governmental organizations of the Azerbaijan Republic. Non-governmental organization can according to the procedure, provided by the laws of the Azerbaijan Republic and its charter, propose enhancement of regulatory legal acts.
