About service in bodies of prosecutor's office

This Law regulates rules and conditions of service in bodies of prosecutor's office of the Azerbaijan Republic.

Section I. General provisions

Article 1. Service in bodies of prosecutor's office

1.1. The service in bodies of Prosecutor's office of the Azerbaijan Republic (further - "service in prosecutor's office") is special type of the public service performed by prosecutors in connection with accomplishment of the powers by them on activities of prosecutor's office.

1.2. Service by prosecutors is based on the principles of activities of prosecutor's office provided by the Law of the Azerbaijan Republic "About prosecutor's office". In case of service employees of bodies of prosecutor's office, being guided by requirements of the Law, perform activities within the powers.

Article 2. The legal basis of service in prosecutor's office

2.1. 3.1. This Law extends to the prosecutors specified in article 1 of the Law of the Azerbaijan Republic "About prosecutor's office".

3.2. Other questions which are not provided by this Law concerning employment relationships are regulated by the relevant standards of the Labor code of the Azerbaijan Republic.

3.3. Employment relationships of the civil workers working in bodies of prosecutor's office at the positions which are not providing special ranks are regulated by the Law of the Azerbaijan Republic "About public service", and employment relationships of the workers who are not government employees (the cleaner, the janitor, the gardener, the watchman, the stoker, the workers who do not have qualification degree, etc.) are regulated by the Labor code of the Azerbaijan Republic.

3.4. The bases and conditions of passing of military service of the military personnel who is not the prosecutor serving in bodies of military prosecutor's office are regulated by the Laws of the Azerbaijan Republic "About military service", "About the status of the military personnel", "Disciplinary the charter of Armed Forces of the Azerbaijan Republic" and other regulatory legal acts determining activities of the military personnel.

Section II. Acceptance on service in prosecutor's office, appointment of workers to position and release them from position

Article 4. Conditions and Regulations of Admission to service in prosecutor's office

4.1. The requirements connected with acceptance on service in prosecutor's office are established by article 29 of the Law of the Azerbaijan Republic "About prosecutor's office".

4.2. Persons wishing to be employed in prosecutor's office file to the Attorney-General of the Azerbaijan Republic petition of the established form.

4.3. Documents of persons who requested acceptance on service in prosecutor's office are checked according to the procedure, established by the Attorney-General of the Azerbaijan Republic.
