About ordering of system of registration, issue, use and accounting of permissions to international carriages of passengers and loads road transport

According to the Law of Ukraine "About road transport" and for the purpose of further ordering of system of registration, issue, use and accounting of permissions to international carriages of passengers and loads road transport of PRIKAZYVAYU:

1. Approve the Procedure for registration and issue of permissions to trip on the territories of foreign states in case of accomplishment of public conveyances and loads by road transport in the international message, their exchange and accounting and the Procedure for carrying out tender and issue of allowing documents of the European Conference of Ministers of Transport which are attached.

2. To State department of road transport (to Zakirov E. O.) and Service of the international motor transportations (Tantsyure E. V.):

2.1. Provide approval of this order of the State committee of Ukraine concerning regulatory policy and entrepreneurship and provision on state registration in the Ministry of Justice of Ukraine.

2.2. After state registration of this order to bring it to permission of the companies, organizations and organizations which activities are connected with the organization of international carriages of passengers and loads.

3. Create the Commission on questions of efficiency analysis of use by the Ukrainian carriers of permissions, considerations of the revealed violations, developments of corrective actions on violators. The structure of the Commission affirms the order of the Ministry of infrastructure of Ukraine.

4. Consider invalid orders of the Ministry of transport of Ukraine of June 4, 2002 No. 352 "About simplification of journey through the territory of Ukraine by the vehicles crossing frontier" of September 26, 2003 No. 746 "About ordering of system of registration, issue, use and accounting of permissions to international carriages of loads road transport" and of March 11, 2004 No. 198 "About modification of procedure for registration and issue of permissions to trip on the territories of foreign states in case of accomplishment of carriages of goods by road transport in the international message, their exchange and accounting".

Procedure for registration and issue of permissions to trip on the territories of foreign states in case of accomplishment of public conveyances and loads road transport in the international message, their exchange and accounting

I. General provisions

1.1. This Procedure is developed according to the Law of Ukraine "About road transport" and international treaties of Ukraine concerning the international motor transportations.

1.2. This Procedure establishes the procedure of registration and issue of permissions to trip the territory of foreign states during execution of public conveyances and loads road transport in the international message (further - permission), their exchange and accounting.

1.3. Public conveyance and loads road transport the territory of foreign states or en route through their territories is performed by automobile carriers according to requirements of international treaties of Ukraine and based on properly drawn up corresponding permissions if another is not provided by international treaties of Ukraine.

1.4. Public conveyance and loads is prohibited by road transport between the Items located in the territory of foreign state if the corresponding permission of competent authority of foreign state according to requirements of international treaties of Ukraine is not got for it.

1.5. Forms of permissions are number forms and are not documents of the strict reporting.

1.6. In this Procedure terms are used in such values:

the order of the form of permission electronically - electronic the statement for the preorder of the form of permission on which the qualified digital signature of automobile carrier is imposed;

quota - the number of permissions to journey of the automotive vehicle from one country in another during the certain period;

limited quota - quota of permissions which is not sufficient for ensuring requirements of automobile carriers.

Authorized body - the central executive body providing realization of state policy on safety issues on the land transport.

II. Approval of quota of permissions

2.1. The quota of permissions for Ukraine the next year is determined by competent authorities of foreign states according to international treaties of Ukraine concerning the international motor transportations.

2.2. Approval of quota of permissions for public conveyance and loads taking into account requirement of automobile carriers performs the Ministry of infrastructure of Ukraine.

2.3. The authorized body based on information provided by the Ministry of infrastructure of Ukraine performs the organization of the order for production of forms of permissions:

on entrance (import) and movement on the territory of Ukraine of the cargo vehicle in the international automobile communication which are valid for one run (transportation in the through and return traffic) (appendix 1 to this Procedure), and repeated (transportation in the through and return traffic) (appendix 2 to this Procedure);

for implementation of the corresponding public conveyances on the territory of Ukraine according to requirements of the order of the Ministry of transport of Ukraine of February 09, 2004 No. 75 "About approval of the Procedure for the organization of regular, irregular and pendular public conveyances by road transport in the international message", registered in the Ministry of Justice of Ukraine on June 22, 2004 for No. 759/9358 (with changes).

2.4. The ministry of infrastructure of Ukraine annually not later than December 20 performs with competent authorities of foreign states exchange of forms of the permissions specified in Item 2.3 of this Section to forms of foreign permissions.

2.5. The Ministry of infrastructure of Ukraine transfers the received forms of permissions in full to authorized body for their further accounting, registration and issue to automobile carriers.

III. Registration and issue of permissions

3.1. Registration and issue of permissions are carried out in Items of issue of permissions of authorized body and its territorial authorities (further - Item of issue of permissions).

3.2. Permissions for carriage of goods are drawn up and issued to the driver of the automotive vehicle (automobile carrier or person authorized by it) (further - the authorized person) based on the oral address, the written statement or the order of the form of permission electronically in which are specified the name (surname, own name, middle name (in the presence) automobile carrier and its location (place of residence), data concerning automotive vehicles (number boards, loading capacity, fully loaded mass), traffic route with indication of the countries of departure and assignment, and also the countries of following of the automotive vehicle, load (weight, total quantity), types of permissions which the automobile carrier, and Item of issue of permissions wishes to receive.

For registration and issue of permission in case of the oral circulation, submission of the written application and the order of the form of permission electronically in Item of issue of permissions the authorized person shows original documents, proving the identity, registration certificates of the vehicle, the document on load (except for implementation of empty giving of the vehicle on loading to the countries of departure), certificates of conformity of the vehicle concerning traffic security and ecological safety to requirements of the countries on which territory it will be transported if other is not provided by international treaties of Ukraine.

The automobile carrier is provided with the permissions provided by the laws or international treaties of Ukraine concerning international carriages necessary for it only for specific trip, in the presence of remaining balance of permissions on condition of presentation in Item of issue of permissions of all of the permissions to the automotive vehicle got earlier.

In case of empty giving of the vehicle on loading to the country of departure the authorized person shows the request for accomplishment of this transportation in any form.
