About approval of Requirements to content and structure of the plan of ensuring physical protection of nuclear installation and nuclear materials and the plan of ensuring accounting and control of nuclear materials

According to article 61 of the Law of Ukraine "About use of nuclear energy and radiation safety", article 12 of the Law of Ukraine "About allowing activities in the field of use of nuclear energy", item 4 of the Regulations on the State committee of the nuclear regulation of Ukraine approved by the resolution of the Cabinet of Ministers of Ukraine of December 27, 2006 No. 1830, and for the purpose of ensuring regulation of activities in the field of physical protection of nuclear installations and nuclear materials and accounting and control of nuclear materials of PRIKAZYVAYU:

1. Approve Requirements to content and structure of the plan of ensuring physical protection of nuclear installation and nuclear materials and the plan of ensuring accounting and control of nuclear materials (are applied).

2. To provide to the head of department of guarantees of non-proliferation Lopatin S. D. according to the current legislation submission of the order on state registration in the Ministry of Justice of Ukraine.

3. I reserve control over the implementation of this order.

Requirements to content and structure of the plan of ensuring physical protection of nuclear installation and nuclear materials and plan of ensuring accounting and control of nuclear materials

1. General provisions

In Requirements to content and structure of the plan of ensuring physical protection of nuclear installation and nuclear materials and the plan of ensuring accounting and control of nuclear materials (further - Requirements) terms are used in the values given in the Laws of Ukraine "About physical protection of nuclear installations, nuclear materials, radioactive waste, other sources of ionizing radiation", "About allowing activities in the field of use of nuclear energy", Rules of physical protection of the nuclear installations and nuclear materials approved by the order of the State committee of nuclear regulation of 04.08.2006 No. 116 and Rules of accounting and control of nuclear materials registered in the Ministry of Justice of Ukraine 21.09.2006 for No. 1067/12941,  the General requirements approved by the order of the State committee of nuclear regulation of 26.06.2006 No. 97 and registered in the Ministry of Justice of Ukraine 17.07.2006 for No. 849/12723, to system of physical protection of the nuclear installations and nuclear materials approved by the order of the State committee of nuclear regulation of 28.08.2008 No. 156, registered in the Ministry of Justice of Ukraine 21.10.2008 for No. 999/15690.

1.2. These Requirements are obligatory to execution by the operating organizations which perform or declared intention to perform activities at specific stages of lifecycle of nuclear installation, namely:

construction and commissioning;

operation;

removal from operation.

1.3. The plan of ensuring physical protection of nuclear installation and nuclear materials (further - the plan of ensuring physical protection) and the plan of ensuring accounting and control of nuclear materials (further - the plan of ensuring accounting and control) are documents which confirm capability of the operating organization to fulfill stipulated by the legislation requirements concerning ensuring physical protection of nuclear installations and nuclear materials (further - physical protection), accounting and control of nuclear materials.

1.4. The plan of ensuring physical protection of nuclear installation and nuclear materials and the plan of ensuring accounting and control contain the description of actions which implementation by the operating organization provides achievement of the purposes of physical protection, accounting and control of nuclear materials determined by the legislation at specific stage of lifecycle of nuclear installation.

1.5. The plan of ensuring physical protection of nuclear installation and nuclear materials and the plan of ensuring accounting and control affirm the head of the operating organization and are approved by the central executive body or National academy of Sciences of Ukraine depending on subordination of nuclear installation and the State inspection of nuclear regulation.

1.6. The plan of ensuring physical protection of nuclear installation and nuclear materials and the plan of ensuring accounting and control are enclosed by the operating organization to the application on receipt of license for activities at specific stage of lifecycle of nuclear installation in set of the documents certifying the level of safety of nuclear installation.

1.7. The operating organization if in one protected zone there are several subordinates to it nuclear installations, develops unified plan of ensuring physical protection and unified plan of ensuring accounting and control.

1.8. The plan of ensuring physical protection of nuclear installation and nuclear materials and the plan of ensuring accounting and control shall not contain information which is carried to the state secret.

2. Content and structure of the plan of ensuring physical protection and the plan of ensuring accounting and control at specific stages of lifecycle of nuclear installation

2.1. Stage of construction and commissioning of nuclear installation.

2.1.1. The plan of ensuring physical protection of nuclear installation and nuclear materials contains the description of the actions directed to creation, commissioning of system of physical protection before delivery of nuclear materials on nuclear installation and maintenance of continued operation of system of physical protection after delivery of nuclear materials on nuclear installation. Content and structure of the plan of ensuring physical protection of nuclear installation and nuclear materials are given on stage of construction of nuclear installation in appendix 1.
