About approval of the technical regulation "Procedures of Confirmation of Conformity"

For the purpose of implementation of the Law of the Republic of Kazakhstan of November 9, 2004 "About technical regulation" the Government of the Republic of Kazakhstan DECIDES:

1. Approve the enclosed technical regulation "Procedures of Confirmation of Conformity".

2. This resolution becomes effective after six months from the date of official publication.

Technical regulation "Procedures of Confirmation of Conformity"

Chapter 1. General provisions

1. This technical regulation (further - regulations) is applied in case of confirmation of conformity of products or services (in the form of adoption of the declaration of conformity or issue of the certificate of conformity) to the requirements established by regulations, standards or conditions of agreements except medicines, products of medical appointment and medical equipment.

2. These Regulations are applied in case of obligatory and voluntary confirmation of conformity.

Other procedures of confirmation of conformity of products or services which are considering features of production, rendering services, testing, deliveries and operation of products, but not contradicting these Regulations can be established by other regulations.

3. In case of obligatory confirmation of conformity products compliance to the requirements of regulations, specific standards ensuring its safety for life and health of the person, environmental protection, the prevention of the actions misleading consumers concerning quality and safety of object proves to be true.

4. In case of voluntary confirmation of conformity compliance of products or services to requirements of standards or other regulating documents at the choice of the applicant, and also to special requirements of the applicant proves to be true.

5. Procedures of confirmation of conformity are carried out only by bodies for confirmation of conformity (further - Body) and test laboratories (centers) accredited on the right of carrying out such works in the field of confirmation of conformity.

6. The expenses connected with work are paid for confirmation of conformity by the applicant, irrespective of its results, based on the agreement.

7. Certificates of conformity (further - the Certificate) foreign states, test reports of products, marks of conformity are recognized according to international treaties.

Recognition of foreign documents in the sphere of confirmation of conformity is performed according to the procedure established by authorized body in the field of technical regulation.

8. The general requirements to procedures of confirmation of conformity established in these Regulations correspond to documents of the International Organization for Standardization and International electrotechnical commission.

Chapter 2. Certification of products
