Approximate regulations on quarter committees of municipalities

1. According to article 31 of the Law of the Azerbaijan Republic "About the status of municipalities" quarter committees of municipalities (further - "quarter committees") are the voluntary associations created by citizens on the initiative of the residence for the purpose of rendering to them the help in the solution of the questions carried to competences of municipalities.

2. The quarter committee is created by the territorial principle. The territory of functioning of quarter committee is established within the certain house or several houses (quarter).

3. The quarter committee is elected at meeting of the inhabitants living in the territory of functioning of this committee as a part of 5-11 members by open voting for a period of two years. The meeting is competent with the assistance of at least 15 percent of the citizens living in the territory of functioning of committee and having the vote right. At this meeting the chairman, the vice-chairman and the secretary of quarter committee are elected.

In structure of quarter committee the citizens who are living in this territory and reached 18-year age are elected. Persons who collected more than a half of votes of participants of the meeting of citizens are considered as the elected to structure of this committee.

The quarter committee can be ahead of schedule re-elected by the decision of meeting of citizens fully or partially. Meetings of citizens are convened at the initiative of at least 10 percent of the persons living in the territory of functioning of quarter committee and having the vote right or one third of members of quarter committee. Election of new members of the committee is performed according to the procedure, provided by this Article.

4. The quarter committee determines the list and priority of upcoming events and records the done work.

The quarter committee is convoked if necessary, on at least once in two months and it is considered competent with the assistance of more than a half of his members.

Meetings of quarter committee are held openly.

5. Decisions of quarter committee are made by regular vote and by a simple majority vote.

6. The quarter committee of times in six months reports at meeting of citizens on the activities. Persons living in the territory of functioning of the relevant quarter committee in week shall be notified on holding meeting.

7. Quarter committees perform the following main powers:

petition before municipalities for questions of local value;

hold the meetings of citizens connected with questions of local value;

take the initiative of creation of municipal acts on local value and discuss drafts of these acts at open sittings with participation of the population;

make the conclusions and offers on use of the respective municipal lands;

will organize participation of the population in improvement, gardening of settlements, improvement of their sanitary condition, construction, reconstruction, repair and content of nurseries and sports grounds, highways, streets, sidewalks, other objects;

promote compliance with the law about conservation, historical and cultural monuments;

give to educational institutions help in involvement of preschool children to education;

promote creation of conditions for rest of children and youth, their sports;

give help living in the territory of their functioning poor, to patients and persons (families) with difficult living conditions;

render assistance to development of initiative and experience of self-government of the population in the solution of questions of local value.

Quarter committees can perform also other powers which are not contradicting the legislation of the Azerbaijan Republic and the charter of the relevant municipality.

8. Quarter committees perform the powers at the expense of donations and other sources which are not forbidden by the legislation of the Azerbaijan Republic.

9. Municipalities within one month shall respond to the conclusions provided by quarter committees, offers or petitions.

The opinion of quarter committees on this or that question is considered by municipalities in case of the solution of the matters.

10. For the purpose of interaction of municipalities and quarter committees committees are entered in lists of municipalities. Entering into the list is performed based on the protocol of meeting of citizens.
