About fight against terrorism

Chapter 1. General provisions

Article 1. Subject of regulation of this Law

This Law establishes legal and organizational basis of fight against terrorism in the Republic of Armenia and governs the relations connected with implementation of fight against terrorism.

Article 2. Purposes of fight against terrorism

The organization of fight against terrorism in the Republic of Armenia is directed:

1) on the prevention, identification, prevention, suppression of terrorist activities and minimization of its effects;

2) on protection of the personality, society and state against terrorism;

3) on identification and elimination of the reasons and conditions promoting terrorist activities.

Article 3. Legal basis of fight against terrorism

The legal basis of fight against terrorism are the Constitution of the Republic of Armenia, Criminal, Criminal procedure and Civil codes of the Republic of Armenia, this Law, other laws and regulatory legal acts, and also the international agreements of the Republic of Armenia.

Article 4. Basic principles of fight against terrorism

The basic principles of fight against terrorism are:

1) legality;

2) priority of preventive measures;

3) one-man management in management raised by forces and funds when carrying out counter-terrorist operations;

4) inevitability of punishment for making and also for preparation and financing of act of terrorism;

5) minimum concessions to the terrorist in urgent cases;

6) combination of public and secret methods of fight against terrorism;

7) complex use of preventive, legal, political, social and economic, propaganda measures;

8) priority of protection of the rights of persons endangered owing to act of terrorism;

9) minimum publicity of methods, acceptances (tactics) of carrying out counter-terrorist operations and list of their participants.

Article 5. The basic concepts used in the Law

In this Law the following basic concepts are used:

1) act of terrorism - direct crime execution of terrorist nature by means of explosion, arson, applications or threats of application of head explosive elements, radioactive, chemical, biological, explosive, toxic, strong materials; destructions, damage or hijacking of vehicles or other objects; infringement of life of the state or public figure, representative national, ethnic, religious or other national groups; taking of hostages, kidnapping; creations of danger of damnification of life, to health or property of the uncertain group of people by creation of conditions for accidents and catastrophic crashes of technogenic nature or real threat of creation of such danger; distribution of threats in any form and by all means; other actions attracting the human victims, causing significant property damage or socially dangerous effects;

2) terrorist activities - the organization, preparation and implementation of act of terrorism; instigation to violence over physical persons or the organizations, destruction of material objects in the terrorist purposes; the organization of illegal armed group, criminal group for making of act of terrorism, and also participation in such share; recruitment, arms, training of terrorists; financing or other assistance of the terrorist organization or terrorist group;

3) the terrorist - the person who committed act of terrorism, performed preparation of act of terrorism or attempt of its making;

4) fight against terrorism - the activities directed to identification, the prevention, suppression, minimization of effects of terrorist activities;

5) counter-terrorist operation - the special events directed to identification, prevention of act of terrorism, and also ensuring interests of the state and safety of physical persons, neutralization of terrorists and minimization of effects of terrorist actions;

6) zone of carrying out counter-terrorist operation - certain sites of the area, the vehicle, the building, structure, construction and the territories adjoining to them within which the specified operation is performed;

7) the hostage - the person kidnapped or withheld for the purpose of compulsion of the state, the organization or individuals to make any action or to refrain from making of any action.

Article 6. International cooperation of the Republic of Armenia in the field of fight against terrorism

The Republic of Armenia cooperates in the field of fight against terrorism with foreign states, and also with the international organizations fighting terrorism on the basis of international treaties.

Chapter 2. Organization of fight against terrorism

Article 7. Organa, fighting terrorism

Terrorism is fought bodies of system of public administration, within the powers allocated for them under the law.

The subjects who are directly fighting terrorism are:

1) Service of homeland security;

2) Police;

3) Ministry of Defence.

Other systems of public administration also take part in fight against terrorism within the powers fixed by the law.

Article 8. Operational staff on counter-terrorist operation

For the purpose of coordination of actions of the subjects who are directly fighting terrorism and others system of public administration the Prime Minister of the Republic of Armenia in case of need can create operational staff on counter-terrorist operation which structure on position joins heads of the bodies of system of public administration listed in article 7 of this Law.

Operational staff on counter-terrorist operation also heads of others of system of public administration can be included.

The common directorship of operational staff on counter-terrorist operation is performed by the Prime Minister of the Republic of Armenia, and direct management - the chief of staff.

Proceeding from nature of the measures undertaken in connection with act of terrorism, on counter-terrorist operation in each case the head of one of the bodies of system of public administration specified in article 7 of this Law is appointed the chief of operational staff.

Article 9. The main functions of the bodies fighting terrorism

The bodies of system of public administration fighting terrorism within the powers fixed by the law:
