About procedure for determination of the size of the state monetary reward for discovery of the field

(as amended of the Resolution of Council of Ministers of the Republic of Belarus of 15.09.2021 No. 535)

Based on part three of Item 7 of article 53 of the Code of the Republic of Belarus about subsoil the Council of Ministers of the Republic of Belarus DECIDES:

1. Approve Regulations on procedure for determination of the size of the state monetary reward for discovery of the field it (is applied).

2. This resolution becomes effective since January 1, 2009.

Regulations on procedure for determination of the size of the state monetary reward for discovery of the field

1. This Provision establishes procedure for determination by the Commission on assignment of the status of pioneers of fields and to the state monetary rewards for discovery of the fields under the Ministry of Natural Resources and Environmental Protection (daleekomissiya) of the size of the state monetary reward for discovery of the field (further - the state monetary reward).

2. The size of the state monetary reward is established depending on the industrial value of the field and type of mineral taking into account profit which can be received as a result of development of the revealed inventories of solid minerals, underground waters, oil, gas condensate and natural gas, geothermal resources of subsoil (except for petrogeotermalny resources) (further – expected profit). The size of expected profit is determined by data of carrying out geological and economic and cost assessment of the field based on results of state examination of geological information.

Determination of the size of expected profit is performed taking into account the prices of mineral raw materials operating for date of submission of documents for receipt of the status of the pioneer of the field according to item 4 of article 53 of the Code of the Republic of Belarus about subsoil by their comparison to the prices agreed in the technical and economic calculations received when carrying out geological and economic and cost assessment of the field.

3. For determination of the size of the state monetary reward Commission carries fields proceeding from mining-and-geological, mining, technological, economic and other conditions of their development, quantity of balance sheet inventories of mineral and (or) geothermal resources of subsoil (except for petrogeotermalny resources) and qualities of mineral raw materials to one of the following groups:

to the first group – large-scale deposits of minerals and (or) geothermal resources of high-quality subsoil with mining-and-geological, mining, technological, economic and other conditions, favorable for industrial development;

to the second group – large-scale deposits of minerals and (or) geothermal resources of subsoil of rather low quality and average high-quality fields with mining-and-geological, mining, technological, economic and other conditions, favorable for industrial development;

to the third group – average mineral deposits and (or) geothermal resources of high-quality subsoil with satisfactory mining-and-geological, mining, technological, economic and other conditions of their industrial development and average mineral deposits and (or) geothermal resources of subsoil of rather low quality with mining-and-geological, mining, technological, economic and other conditions, favorable for industrial development;

to the fourth group – small mineral deposits and (or) geothermal resources of subsoil irrespective of quality with favorable conditions for their industrial development and average fields irrespective of quality with rather difficult mining-and-geological, mining, technological, economic and other conditions of their development.

Quality of mineral raw materials, mining-and-geological, mining, technological, economic and other conditions of mining are established by the Commission based on results of state examination of geological information.

Reference of the field by quantity of balance sheet inventories of minerals and (or) geothermal resources of subsoil (except for petrogeotermalny resources) to one of the groups specified in part one of this Item is made taking into account classification of fields according to appendix.

4. The maximum size of the state monetary reward paid for opening of one field irrespective of number of pioneers cannot exceed for the field carried to the first group, 300 basic sizes to the second group - 200, to the third group - 150, to the fourth group - 75 basic sizes.

5. On fields of solid minerals, underground waters, geothermal resources of subsoil the size of the state monetary reward is established percentage of the size of expected profit, but no more than the sizes established in item 4 of this provision – for fields of the first group – 1 percent, the second group – 0,5 of percent, the third group – 0,4 of percent, the fourth group – percent 0,3.

6. On oil fields, gas condensate and natural gas the size of the state monetary reward is established percentage of the size of expected profit, but no more than the sizes established in item 4 of this provision – for fields of the first group – 0,1 of percent, the second group – 0,05 of percent, the third group – 0,04 of percent, the fourth group – percent 0,03.

7. For persons which revealed in earlier known field the additional inventories of minerals and (or) geothermal resources of subsoil (except for petrogeotermalny resources) significantly increasing its industrial value, the size of the state monetary reward is determined proceeding from surplus of size of in addition expected profit. At the same time the maximum size of the state monetary reward shall not exceed 50 percent from the maximum size of the state monetary reward for discovery of the field.

8. If the status of the pioneer of the field is given by the Commission for one field to several persons, the size of the state monetary reward paid to each of pioneers is determined depending on its personal deposit in discovery of the field or additional inventories of mineral and (or) geothermal resources of the subsoil (except for petrogeotermalny resources) significantly increasing its industrial value. The personal deposit of each of pioneers is determined based on the documents submitted for receipt of the status of the pioneer of the field according to item 4 of article 53 of the Code of the Republic of Belarus about subsoil.
