This Law establishes legal, economic and organizational basis of state policy in the field of employment assistance, and also the state guarantees for citizens in the field of work and in the field of social protection of the unemployed.
1.0. The basic concepts used in this Law express the following values:
1.0.1. employment - any activities of the citizens of the Azerbaijan Republic who are constantly living in the Azerbaijan Republic persons without citizenship and foreigners (further - citizens), which are not contradicting the legislation of the Azerbaijan Republic and bringing, as a rule, to them earnings (income);
1.0.2. temporary employment - socially useful activities of citizens during certain term;
1.0.3. the able-bodied population which is in working-age - persons which are between the stipulated by the legislation lower and upper age limit of the Azerbaijan Republic and capable to perform this or that labor activity;
1.0.4. the jobless citizen - the able-bodied person which is in working-age, not having work and earnings ready to get to work and registered in relevant organ of the executive authority as person who is looking for work;
1.0.5. vacancy - the free workplace at employers requiring labor power;
1.0.6. self-employment - independent providing with work as able-bodied persons;
1.0.7. the labor market - set of the demand and supply on labor power;
1.0.8. quota - the minimum quantity of workplaces (workers) established by relevant organs of the executive authority to employers for job security of the persons which are especially needing social protection and experiencing difficulties with employment;
1.0.9. persons which for the first time are looking for work - the able-bodied persons which were earlier not working and wishing to start for the first time labor activity.
The legislation of the Azerbaijan Republic on employment consists of the Constitution of the Azerbaijan Republic, this Law, other corresponding regulatory legal acts and international treaties which the Azerbaijan Republic joined.
3.0. Treat busy persons:
3.0.1. the persons which are working on hiring, including performing work for remuneration during complete or part-time on the employment contract (contract), and also having other paid work (service);
3.0.2. the entrepreneurs, persons who are engaged in individual labor activity, persons having land share in the property;
3.0.3. the persons, the elite appointed or approved to paid position;
3.0.4. persons serving in Armed Forces of the Azerbaijan Republic and other armed connections created according to the legislation of the Azerbaijan Republic;
3.0.5. persons which are temporarily absent on workplace in connection with temporary not working capacity, leave, additional education, vacation, suspension of production or other reasons;
3.0.6. the foreigners and persons without citizenship who are engaged on legal causes in paid labor activity in the territory of the Azerbaijan Republic;
3.0.7. the citizens of the Azerbaijan Republic who are engaged on legal causes in labor activity outside the Azerbaijan Republic.
