Procedure for confirmation of the fact of loss by the taxpayer of insured property

1. This Procedure determines the procedure of confirmation of the fact of loss by the taxpayer of the insured property belonging to it on the property rights (further - property) owing to plunder, destruction or recognition of property unsuitable for use in the presence of force majeure circumstances or owing to its forced replacement by other bases.

2. The taxpayer addresses no later than the insurance of term of representation to the insurer of the statement for loss occurrence determined by terms of the contract with the written application for confirmation of the fact of inventory loss:

owing to its stealing - in law-enforcement body;

owing to destruction or recognition unsuitable for use in the presence of force majeure circumstances - in territorial authority or division of the Ministry of Emergency Situations in the place of permanent or temporary placement (storage, use) property;

owing to its forced replacement on other bases - in law-enforcement body or territorial authority or division of the Ministry of Emergency Situations (depending on the reason of such property exchange).

3. The copy of the insurance contract (the insurance certificate, the policy, the certificate) is enclosed to the written application.

4. In case of establishment according to the legislation of the fact of inventory loss the body specified in Item 2 of this Procedure issues the conclusion about confirmation of this fact.

5. The inventory loss fact owing to its plunder, destruction or recognition unsuitable for use in the presence of force majeure circumstances or owing to its forced replacement on other bases proves to be true in the presence of the insurance statement (average certificate) which is drawn up according to the legislation.

6. The form of the conclusion about confirmation of the fact of inventory loss and procedure for its issue affirms the Ministry of Internal Affairs and the Ministry of Emergency Situations.
