About social protection of the citizens who were affected by catastrophic crash on the Chernobyl NPP, other radiation accidents

This Law is directed to protection of the rights and interests of the citizens who were taking part in mitigation of consequences of catastrophic crash on the Chernobyl NPP, other radiation accidents evacuated, which are settled out, independently came out to the new residence from the territories which underwent to radioactive pollution as a result of catastrophic crash on the Chernobyl NPP (further - the territory of radioactive pollution), living in the specified territories and other categories of the citizens determined by this Law.

Chapter 1. General provisions

Article 1. The main terms used in this Law and their determinations

For the purposes of this Law the following main terms and their determinations are used:

the citizens constantly (mainly) living in the territory of radioactive pollution, – the citizens (including minor children) registered at the place of residence according to the procedure, established by legal acts, and actually living in the settlements which are in the territory of radioactive pollution in zone of the subsequent settling out, zone with the right to settling out, accommodation zone with periodic radiation control;

children of the citizens who were affected by catastrophic crash on the Chernobyl NPP, other radiation accidents – the children who were born after participation at least of one of parents in works on mitigation of consequences of catastrophic crash on the Chernobyl NPP, other radiation accidents or after reference at least of one of parents to category of the victims from catastrophic crash on the Chernobyl NPP, other radiation accidents;

radioactive pollution – presence of radioactive materials on surface and (or) in objects of control of radioactive pollution, in human body or in other place in the quantity exceeding the levels established by regulations and rules on ensuring radiation safety;

average annual effective dose of radiation of the population – the amount of the effective dose of external radiation received for calendar year, and expected the effective dose of internal radiation caused by receipt in organism of radionuclides for the same year, calculated as average dose for all population living in the specific territory;

effective dose of radiation – the size of impact of ionizing radiation used as measure of risk of emergence of the remote effects of radiation of human body and its separate bodies taking into account their radio sensitivity.

Article 2. The right of the citizens of the Republic of Belarus who were affected by catastrophic crash on the Chernobyl NPP, other radiation accidents to receipt of privileges

1. The citizens of the Republic of Belarus who were affected by catastrophic crash on the Chernobyl NPP, other radiation accidents have bonus right for the harm done to their life and health as a result of catastrophic crash on the Chernobyl NPP, other radiation accidents, according to the procedure and on the conditions established by this Law and other legal acts.

2. If the citizen has the right to the same privilege on several bases provided by this Law and other legal acts, the privilege is provided at its choice on one of the bases.

3. Realization of the rights of the citizens who were affected by catastrophic crash on the Chernobyl NPP, other radiation accidents on receipt of the privileges established by this Law and other legal acts is guaranteed by the state.

Article 3. Privileges to the foreign citizens and stateless persons who were affected by catastrophic crash on the Chernobyl NPP, other radiation accidents

The foreign citizens and persons without citizenship which were affected by catastrophic crash on the Chernobyl NPP, other radiation accidents, who are constantly living in the Republic of Belarus use all privileges established by this Law if other is not provided by international treaties of the Republic of Belarus.

Article 4. Financing of the expenses connected with implementation of this Law

Financing of the expenses connected with implementation of this Law is performed from republican and local budgets according to the Law of the Republic of Belarus of May 26, 2012 No. 385-Z "About legal regime of the territories which underwent to radioactive pollution as a result of catastrophic crash on the Chernobyl NPP", the law on the republican budget for the next financial year and decisions of local councils of deputies on the budget for the next financial year.

Article 5. Criteria of restriction of labor activity and accommodation of the population in the territory of radioactive pollution

1. Accommodation and labor activity of the population in the territory of radioactive pollution do not require any restrictions if the average annual effective dose of radiation of the population does not exceed 1 m3v over the level of natural and technogenic radiation background.

2. In case of exceeding of average annual effective dose of radiation of the population 1 m3v over the level of natural and technogenic radiation background protective measures are held.

3. In case of decrease in average annual effective dose of radiation of the population to values in the range from 1,0 m3v to 0,1 m3v over the level of natural and technogenic radiation background protective measures are not cancelled.

4. In case of average annual effective dose of radiation of the population of less 0,1 m3v over the level of natural and technogenic radiation background protective measures are not held.

Article 6. Zones of radioactive pollution

The territory of radioactive pollution depending on density of pollution of soils and extents of impact (size of effective dose) of radiation on the population is subdivided by radionuclides into zones of radioactive pollution according to the criteria established by the Law of the Republic of Belarus "About legal regime of the territories which underwent to radioactive pollution as a result of catastrophic crash on the Chernobyl NPP".

Article 7. Procedure for entrance on the territory of radioactive pollution to zone of the subsequent settling out for permanent residence

Entrance of citizens on the territory of radioactive pollution in zone of the subsequent settling out for permanent residence is performed according to the procedure, determined by Council of Ministers of the Republic of Belarus.
