About approval of the Regulations on service in law-enforcement bodies of the Azerbaijan Republic

Regulations on service in law-enforcement bodies of the Azerbaijan Republic

This Provision establishes rules and conditions of service in the police and other bodies and parts which are a part of the system of relevant organ of the executive authority (further - law-enforcement bodies), bases of legal status of officials of data of bodies.

Section I. General provisions

1. Service in law-enforcement bodies - special type of public service of citizens of the Azerbaijan Republic, performing professional activity of function, obligation and right of data of bodies.

2. The legislation on service in law-enforcement bodies is based on the Constitution of the Azerbaijan Republic and consists of the Law of the Azerbaijan Republic "About police", this provision, other regulatory legal acts of the Azerbaijan Republic.

Provisions of the Law of the Azerbaijan Republic "About public service" including article 15-1 of the specified Law, connected with the right of citizens to be accepted on public service, implementation of acceptance on service on the basis of tender and transparency and other principles of public service, assessment of activities of government employees, extend to persons employed in law-enforcement bodies.

3. For the purpose of regulation of the office relations between persons working in law-enforcement bodies, establishments of term of their service and qualification qualities in these bodies are established positions of ordinary structure, younger, average, the senior and highest commanding structure and special ranks.

4. The citizens of the Azerbaijan Republic performing the powers established by the legislation of the Azerbaijan Republic which received the special ranks working at positions ordinary and younger, average, the senior, highest commanding structure or being in personnel of law-enforcement bodies and also cadets of educational institutions of relevant organ of the executive authority of the Azerbaijan Republic are considered as the staff of law-enforcement bodies.

5. The staff of law-enforcement bodies is provided at the expense of the state with dress code and distinctions. The description of dress code and distinctions affirms relevant organ of the executive authority of the Azerbaijan Republic.

6. Official IDs which samples are established by relevant organ of the executive authority of the Azerbaijan Republic are issued to the staff of law-enforcement bodies.

7. After passing of special preparation the staff of law-enforcement bodies has the right in stipulated by the legislation cases and procedure to use physical force, special means and firearms. Rules of issue, storage and carrying special means and firearms are established by relevant organ of the executive authority of the Azerbaijan Republic.

8. Service in law-enforcement bodies finds the reflection in the personal record of each employee (the personal record prepares, conducted and stored by services of personnel of law-enforcement bodies). In case of change of the duty station of the employee of law-enforcement bodies its personal record goes to the new duty station. Rules of maintaining and storage of personal records of staff of law-enforcement bodies are established by relevant organ of the Executive authority of the Azerbaijan Republic.

9. To persons appointed to positions of the private and the commanding structure in law-enforcement bodies the following special ranks are given:

1) Special, the ranks established for positions of ordinary structure:

* police officer, ordinary health service;

2) the Special ranks established for positions of the younger commanding structure:

* police lance sergeant, lance sergeant of health service;

* police sergeant, sergeant of health service;

* police staff sergeant, staff sergeant of health service;

3) the Special ranks established for positions of the average commanding structure:

* police second lieutenant, second lieutenant of health service;

* police lieutenant, lieutenant of health service;

* senior police lieutenant, senior lieutenant of health service;

* police captain, captain of health service;

4) the Special ranks established for positions of the senior commanding structure:

* police major, major of health service;

* police lieutenant colonel, lieutenant colonel of health service;

* police colonel, colonel of health service;

5) the Special ranks established for positions of the highest commanding structure:

* police major general, major general of health service;

* police lieutenant general;

* police colonel general.

Based on Item 24 of article 109 of the Constitution of the Azerbaijan Republic to persons working at positions of the highest commanding structure the highest military ranks can be given.

10. In case of dismissal from service of employees of the commanding structure of law-enforcement bodies the words "in resignation" are added to the available special rank (except for dismissed from law-enforcement bodies according to Items 2-4, 7, of the 9 and 10 article 135 of this provision).
