About use and protection of emblems of the Red cross and Red crescent

(as amended of the Law of the Azerbaijan Republic of 08.05.2007 No. 326-IIIQD)

This Law establishes rules of use and protection of emblems of the Red cross and Red crescent according to the interstate international treaties supported by the Azerbaijan Republic and governs the legal relations arising in this area.

Section I. General provisions

Article 1. Basic concepts

Treat the basic concepts used in this Law:

medical forming - the military and civil medical institutions created for the medical purposes that is for treatment of wounded, patients and persons, castaway, including their search, rescuing, transportation, establishment of the diagnosis and rendering first aid to them, and also for prevention of diseases. Medical forming can be stationary or mobile, permanent or temporary;

medical personnel - persons who are designated by the party which is in the conflict only for the medical purposes, and also for implementation of administrative ensuring medical forming or for work on sanitary vehicles and implementation of their administrative technical supply;

sanitary vehicles - the military or civil, permanent or temporary means of transportation provided only for sanitary transportations and which are under control of competent authority of the party participating in the conflict;

spiritual personnel - the persons occupied only with accomplishment of the spiritual functions, attached to armed forces, medical forming or sanitary vehicles of the party which is in the conflict;

the distinctive emblem - represents the image of the Red cross or Red crescent on white background used for protection of medical forming, sanitary vehicles, medical and spiritual personnel, the equipment or inventories;

distinctive signal - any signal or the message established for identification of medical forming or sanitary vehicles.

Article 2. Legislation of the Azerbaijan Republic on use and protection of emblems of the Red cross and Red crescent

The legislation of the Azerbaijan Republic on use and protection of emblems of the Red cross and Red crescent consists of the Constitution of the Azerbaijan Republic, this Law and other regulatory legal acts, and also international treaties supported by the Azerbaijan Republic.

Article 3. The objects protected by this Law

Treat the objects protected by this Law:

emblems of the Red cross and Red crescent;

name of the Red cross and Red crescent;

the distinctive signals used for identification of medical forming and sanitary vehicles.

Article 4. Emblems of the Red cross and Red crescent

The emblem of the Red cross - represents the image of two equal rectangles of red color which are crossed in the center at right angle in the middle of white background without reaching edge of this background.

The emblem of Red crescent - represents the image of half moon of red color in the middle of white background, without reaching edge of this background.

Rules of use of emblems of the Red cross and Red crescent are established by this Law, the Geneva conventions of August 12, 1949 (further - the Geneva conventions) attached to these conventions by protocols No. 1 and 2 of June 8, 1977 (further protocols No. 1 and 2).

Article 5. Types of use of emblems of the Red cross and Red crescent

Emblems of the Red cross and Red crescent are used according to the Geneva conventions, protocols No. 1 and 2, and also this Law as sign of protection or distinctive mark.

Section II. Rules of use of Emblems of the Red cross and Red crescent

Article 6. General requirements to use of emblems of the Red cross and Red crescent as protection sign

Due to the assistance to wounded during the military conflict, to patients and persons, castaway, for the designation of medical and spiritual personnel, medical forming, sanitary vehicles and medical property which are under protection of the Geneva conventions, protocols No. 1 and 2, as sign of protection emblems of the Red cross and Red crescent are used.

For ensuring visual viewing of emblems of the Red cross and Red crescent from far distance their sizes shall be whenever possible large.

During the military conflict members of medical and spiritual personnel shall have for confirmation of the status according to the sample established by the Geneva conventions, protocols No. 1 and 2, the identity certificate and armband.

The identity certificate is constituted in Azerbaijani. In the certificate the surname and name, birth date, rank, army number of its owner are entered and also as whom it is under the auspices of the Geneva convention. On the identity certificate there shall be picture of the owner and his signature. The identity certificate is certified by seal of the relevant organ of the executive authority of the Azerbaijan Republic which issued it.

Its duplicate is issued to person which lost the identity certificate.

On the armband issued to members of medical or spiritual personnel there shall be distinctive mark, it is certified by seal of relevant organ of the executive authority of the Azerbaijan Republic.

Article 7. Use of relevant organs of the executive authority of the Azerbaijan Republic by health services of emblem of Red crescent as protection sign

Health services of relevant organs of the executive authority of the Azerbaijan Republic use emblem of Red crescent as protection sign during the conflict and in peace time only for mark of the medical personnel, medical forming, sanitary vehicles and medical property.

Health services of relevant organs of the executive authority of the Azerbaijan Republic issue to members of the medical personnel of the identity certificate and armbands.

Article 8. Use by civil medical forming of emblem of Red crescent as protection sign

During the military conflict with the consent of relevant organ of the executive authority of the Azerbaijan Republic and under its direct supervision civil medical personnel, medical forming, sanitary vehicles and medical property are marked with the emblem of Red crescent used as protection sign.

The relevant organ of the executive authority of the Azerbaijan Republic issues to members of civil medical personnel of the identity certificate and armbands.

Article 9. Use of Red crescent of emblem of Red aolumesyaets by the Azerbaijani society as protection sign

The medical personnel, medical forming, sanitary vehicles and medical property transferred by the Azerbaijani society of Red crescent to the order of relevant organs of the executive authority of the Azerbaijan Republic are marked with emblem of Red crescent as protection sign.

During the military conflict the existing regulatory legal acts of the Azerbaijan Republic extend to the medical personnel specified in part one of this Article, medical forming, sanitary vehicles and medical property.
