About scientific and technical and economic cooperation in the field of nuclear power
The government of the Russian Federation and the Government of Ukraine which below are referred to as with the Parties
being guided by the friendship existing between both countries, and interests of further expansion and deepening of cooperation in the field of nuclear power
proceeding from the Agreement between the State Parties of the Commonwealth of Independent States on the basic principles of cooperation in the field of atomic energy,
confirming commitment of both Parties to strengthening of non-proliferation regime of nuclear weapon on the basis of the Nuclear Non-Proliferation Treaty of July 1, 1968,
in view of the Statement of the Supreme Council of Ukraine for the nuclear-free status of Ukraine of October 24, 1991, intention of Ukraine to join the Nuclear Non-Proliferation Treaty as the non-nuclear state and to sign the corresponding safeguards agreement with International Atomic Energy Agency (MAGATE),
considering what already during the transition period necessary for completion of all procedures for accession of Ukraine to the Nuclear Non-Proliferation Treaty, IAEA started implementation of technical visits and activities for check in the territory of Ukraine with use of procedures, similar subjects which the Agency applies according to the safeguards agreements signed with the State Parties of the Nuclear Non-Proliferation Treaty
noting that use of nuclear power assists in the peace purposes to all-round development of economy and growth of welfare of people, and also promotes implementation of the latest scientific and technical developments and advanced technologies and allows to keep natural resources of organic fuel,
being guided in the practical activities by the laws of the Russian Federation and Ukraine,
understanding responsibility to the people and the international community for ensuring safe operation of objects of nuclear power,
agreed as follows:
The parties develop and deepen cooperation through the relevant organizations for the purpose of development of coordinated policy in the field of development of nuclear power of the states, creating favorable conditions for cash calculations for works, services and products according to requirements and priorities of their national nuclear programs.
Being guided by the principles of this agreement, the Parties will perform cooperation in the following directions:
providing environmentally friendly nuclear power;
designing, construction and operation of the nuclear power plants (NPP) and research reactors, including realization of those from earlier planned actions concerning which there are agreed decisions of the Parties;
basic and applied researches on problem of safety of nuclear power plants, development and enhancement of systems of diagnostics and control of the capital equipment of the NPP, and also systems of support in accident elimination on the NPP;
industrial production, including on the basis of cooperation, and supply of equipment, components, devices, spare parts and materials, including nuclear materials, necessary for use in power and research reactors;
enhancement of nuclear fuel cycle with use of raw and production capacities of both Parties;
storage and conversion of spent nuclear fuel;
removal from operation, deactivation and ensuring safe handling of waste of power and research reactors;
enhancement of technology of repair of the equipment of the NPP;
development of the specifications and technical documentation on safety of the NPP and research reactors at all stages of their lifecycle;
development of standard operational documentation;
accounting and control of nuclear materials and implementation of physical protection of objects of nuclear power;
ensuring radiological protection and nuclear safety;
training in higher educational institutions and the educational and training centers of Russia and Ukraine according to the approved programs.
The cooperation provided by this Agreement is performed in the way:
developments and implementation of intergovernmental and cross-industry scientific and technical programs;
developments of regulating and other documents for nuclear power plants of the Parties;
carrying out joint scientific and technical surveys;
transfers on agreed terms of technical documentation, samples of products and materials;
rendering assistance in operation of power units of the NPP, maintenance and repair of the equipment of the NPP, in delivery of spare parts to it;
implementation of joint technical inspections according to the level of safe operation of the NPP and qualification of personnel;
exchange of operational information concerning operation of the NPP and about the occurred incidents;
sending and acceptance of specialists for carrying out consultations and acquaintance with scientific and technical achievements and the advanced know-how;
uses of other forms of cooperation as agreed by the parties.
Conditions of implementation of the cooperation provided by this agreement including on deliveries of the Ukrainian uranium concentrate to Russia, fresh nuclear fuel to Ukraine and, on temporary storage or conversion with the subsequent return of radioactive waste to Ukraine, are determined by contracts (contracts) between the companies and the organizations of both Parties according to the current legislation of the Russian Federation and Ukraine by sending spent nuclear fuel to Russia.
The parties actively participate in activities of IAEA, provide it the information required, follow recommendations of IAEA about safety of nuclear power plants, and also if necessary hold consultations for development of the approved line items.
The parties encourage and facilitate cooperation between their legal entities on the questions falling within this agreement coverage.
The parties take all necessary precautionary measures provided by their current legislation for ensuring preserving confidentiality of information, including commercial and industrial secrets, "know-how" which the organizations participating in cooperation within the Agreement exchange.
The parties do not use the provision of this agreement for the purpose of receipt of commercial benefits or to creation of difficulties in commercial bonds of other Party.
The parties assist in the solution of the questions connected with transit of nuclear materials through their territories.
This agreement does not affect the rights and obligations of the Parties following from the agreements with the third countries signed by them.
The parties at the request of one of them hold consultations for the purpose of ensuring effective implementation of this agreement.
