About approval of the Regulations on urgent restoration, repair or preservation of unique documents

1. Approve Regulations on urgent restoration, repair or preservation of unique documents which are applied.

2. To storage division and accounting of National Archive Fund of management of clerical work, forming and storage of National Archive Fund (Kiselyova L. A.) provide provision of this order on state registration in the Ministry of Justice of Ukraine.

3. Declare invalid the order of the State committee of archives of Ukraine of 04.03.2003 N 33 "About approval of the Regulations on urgent restoration, repair or preservation of unique documents", registered in the Ministry of Justice of Ukraine 20.03.2003 for N 223/7544.

4. To impose control of execution of this order on the vice-chairman of the State committee of archives of Ukraine K. E. Novokhatsky.

Regulations on urgent restoration, repair or preservation of unique documents

1. This Provision is developed according to Procedure for reference of documents of National Archive Fund to unique, their accounting and storage, the approved resolution of the Cabinet of Ministers of Ukraine of 08.08.2007 N 1004.

2. Action of this provision extends to the archive organizations performing powers of the owner of documents of National Archive Fund, legal entities and physical persons in which property there are unique documents (daleevladelets of documents), and persons authorized by them.

3. Urgent restoration, repair or preservation of unique documents irrespective of patterns of ownership on them are carried out in case:

local or mass damage by fire, water, chemical and radioactive materials as a result of natural disaster, technogenic environmental disaster, emergency violation of storage mode;

detection of unique documents with shabby basis and reduction of contrast of the text or image (fading of the text or image) struck with biological wreckers;

other damage.

4. Urgent restoration, repair or preservation of unique documents are carried out by the relevant structural divisions of the public archive institutions and the public specialized agencies.

5. Owners of documents or persons authorized by them can make restoration, repairs or preservation of these documents in the public archive institution where the specified documents are entered to National Archive Fund.

6. Carrying out restoration, repair or preservation of unique documents in the public archive institution is performed on a contract basis based on the order submitted the owner of documents or person authorized by it according to Procedure for provision by the public archive institutions of the help to the legal entities and physical persons which are owners of documents of National Archive Fund in improvement of storage conditions, restoration, the preservation, creation of insurance fund and fund of use of documents approved by the order Goskomarkhiva of 25.04.2002 of N 32, registered in the Ministry of Justice of Ukraine 28.05.2002 for N 457/6745.

7. Payment for work, executed by the public archive institution, is performed by the owner or person authorized by him according to the prices and rates approved according to the current legislation.

8. The public archive institutions can provide to owners of documents or persons authorized by them the help in work on restoration, repair or preservation of unique documents within the selected assignments.

9. Unique documents which are transferred to restoration, repair or preservation to the public archive institution or other public specialized agency shall be insured by owners of documents or persons authorized by them according to the Law of Ukraine "About National Archive Fund and archive organizations".

10. Unique documents are transferred to the public archive institutions for carrying out restoration, repair or preservation under the act of temporary transfer of unique documents which form is determined by Regulations on creation and accounting of copies of insurance fund of the unique documents which are not property of the state, the approved order Goskomarkhiva of 15.01.2003 of N 5, registered in the Ministry of Justice of Ukraine 04.02.2003 for N 88/7409 (with changes).

11. The public archive institution to which unique documents for carrying out restoration, repair or preservation are transferred shall ensure safety of documents from the moment of their receipt and until return to the owner or person authorized by it.
