About protection of atmospheric air

This Law determines legal and organizational basis of protection of atmospheric air from emissions of pollutants and is directed to preserving, recovery of quality of atmospheric air, providing ecological safety.

Chapter 1. General provisions

Article 1. The main terms used in this Law and their determinations

1. The automated control system behind emissions of pollutants in atmospheric air - complex of technical equipment and the means providing automatic measurements and accounting of sizes of emissions of pollutants in atmospheric air, fixing and information transfer about indicators of such emissions in information system of the National monitoring system of the environment.

2. Atmospheric air - the environment component representing the natural mix of gases of the atmosphere which is outside residential, production and other rooms.

3. Emission of pollutants in atmospheric air - single, repeated or permanent intake of pollutants in atmospheric air from sources of emissions.

4. Gas-purifying installation - the construction and (or) the equipment intended for purification of the gases departing from source of release of pollutants with the subsequent emission of the purified gases directly in atmospheric air.

5. Pollution of atmospheric air - receipt in atmospheric air, stay and (or) origin in it as a result of harmful effects on the environment of pollutants, properties, location or the number of whom is led to negative changes of quality of atmospheric air, including to exceeding of standard rates in the field of protection of atmospheric air.

6. Pollutants - chemicals or their mix, microorganisms, other biological substances which intake in atmospheric air makes harmful effects on the environment.

7. Impact zone - the territory which is affected by the pollutants arriving in atmospheric air from objects of impact on atmospheric air.

8. Sources of emissions - constructions, technical devices, processing and (or) other equipment, engineering procedures, machines, mechanisms from which emission of pollutants in atmospheric air is performed.

9. Sources of release of pollutants - constructions, technical devices, processing and (or) other equipment, machines, mechanisms in which there is education and from which there is release of pollutants, or engineering procedures when which implementing there are education and release of pollutants.

10. Quality of atmospheric air - the condition of atmospheric air which is characterized by the chemical, biological and other indicators and (or) their set reflecting degree of its compliance to standard rates of quality of atmospheric air.

11. Mobile sources of emissions - vehicles, self-propelled machines which operation of engines involves emissions of pollutants in atmospheric air.

12. The best available technical methods - the engineering procedures, methods, procedure for production organization of products and energy, performance of works (rendering services) providing reduction and (or) prevention of emissions of pollutants in atmospheric air in comparison with applied and being the most effective for ensuring compliance with standard rates in the field of protection of atmospheric air on condition of economic feasibility and technical capability of their application.

13. Adverse weather conditions - the hydrometeorological phenomena and (or) meteorological elements promoting accumulating of pollutants in atmospheric air and to increase in its pollution (fog, calm, light breeze, temperature increase of air in atmosphere layer, the adverse direction of wind and other similar hydrometeorological phenomena and (or) meteorological elements).

14. Regulation of emissions of pollutants in atmospheric air - indicator of maximum permissible (critical) anthropogenous load of impact of one or several pollutants of atmospheric air in emission of pollutants in atmospheric air from source of emissions which exceeding can lead to harmful effects on the environment.

15. Standard rates of admissible emissions of pollutants in atmospheric air - sizes of emission of pollutants in atmospheric air which are established for stationary source of emissions and (or) set of stationary sources of emissions on condition of not excess by such source of emissions and (or) set of such sources of emissions of standard rates of quality of atmospheric air and (or) regulations of emissions of pollutants in atmospheric air.

16. Standard rates of quality of atmospheric air - the size of admissible concentration of pollutants in atmospheric air in case of which observance there are neither direct, nor indirect harmful effects, including the remote effects, on the environment, health of the person.

17. Objects of impact on atmospheric air - the objects of economic and other activity connected with emissions of pollutants in atmospheric air, combined by one appointment and (or) inseparably linked physically and (or) technologically, located within one parcel of land or several parcels of land combined by one border of zone of impact.

18. Objects of inclination of mobile sources of emissions - parking lots and storages of mobile sources of emissions, the buildings and constructions intended for servicing of participants of traffic along the line, freight and passenger terminals, stations, the airports, moorings and other similar objects (service stations, gas stations, sinks and other objects).

19. Protection of atmospheric air - the activities of state bodies, public associations, other legal entities, physical persons, including individual entrepreneurs directed to preserving, recovery and improvement of quality of atmospheric air by means of reduction and (or) prevention of pollution of atmospheric air.

20. Above-standard emission of pollutants in atmospheric air - emission of pollutants in the atmospheric air exceeding the standard rates in the field of protection of atmospheric air on one or more pollutant established according to this Law and other acts of the legislation on protection of atmospheric air, of sanitary and epidemiologic wellbeing of the population, including technical regulatory legal acts, obligatory for observance, or in the absence of such standard rates if their establishment is required according to this Law.

21. Specific pollutants - the pollutants in emissions of pollutants in atmospheric air which are formed as a result of implementation of engineering procedures and characteristic only of certain type of economic and other activity.

22. Stationary sources of emissions - sources of emissions which movement without dismantle is impossible and which location can be determined using single state system of coordinates or which can be moved by means of transport or other portable means, but require motionless (stationary) provision in the course of their operation.

23. Fuel - the substance, mix of substances intended for receipt of energy in case of their burning.

24. Cross-border pollution of atmospheric air - pollution of atmospheric air over the territory of one state from sources of the emissions which are in the territory of other state.

25. Background concentration of pollutant in atmospheric air - the concentration of pollutant in unit of volume of atmospheric air calculated based on results of carrying out monitoring of atmospheric air in the specific territory and caused by influence of all sources of emissions in this territory including cross-border pollution of atmospheric air.

26. Ecological information in the field of protection of atmospheric air - the information containing data on condition of atmospheric air, impacts on it and measures for its protection, and also on impacts of atmospheric air per capita, intended for informing state bodies, other legal entities, physical persons, including individual entrepreneurs, implementation of state regulation and management in the field of protection of atmospheric air.
