Chapter 1. General provisions

Article 1. The basic concepts used in this Federal Law

For the purposes of this Federal Law the following basic concepts are used:

1) request - the address of the user information in oral or written form, including in the form of the electronic document, in courts, Judicial department under the Supreme Court of the Russian Federation (further - Judicial department), managements of Judicial department in subjects of the Russian Federation (further - bodies of Judicial department), bodies of judicial community about provision of information on activity of the courts in the Russian Federation (further - information on activity of the courts);

2) information on activity of the courts - the information prepared within the powers by courts, Judicial department, bodies of Judicial department, bodies of judicial community or which arrived in courts, Judicial department, bodies of Judicial department, bodies of judicial community and relating to activity of the courts. The legislation of the Russian Federation establishing procedure for legal proceedings, power and procedure for activity of the courts, Judicial department, bodies of Judicial department, bodies of judicial community, court resolutions on specific cases and other acts regulating questions of activity of the courts also belong to information on activity of the courts;

3) the user information - the citizen (physical person), the organization (legal entity), public association, public authority or local government body performing information search about activity of the courts;

4) court resolution - the decision passed in the form established by the relevant law on the merits of the case, the implementation of the constitutional, civil, administrative or criminal trial or legal proceedings considered according to the procedure in Arbitration Court. Also the decisions of the courts of appeal, cassation and supervising instances which are taken out in the form established by the relevant law by results of consideration appeal or writs of appeal (representations) or review of the judgments according to the procedure of supervision belong to court resolutions;

5) courts - the federal courts and magistrate judges of subjects of the Russian Federation (further - magistrate judges) constituting judicial system of the Russian Federation;

6) common information space of federal courts and magistrate judges - set providing information exchange of the Supreme Court of the Russian Federation, federal courts, magistrate judges, bodies of judicial community and system of Judicial department of the databases and databanks, technologies of their maintaining and use, information systems and information and telecommunication networks functioning on the basis of the single principles and general rules;

7) delayed broadcast of judicial session - broadcast of judicial session per radio, television or on the Internet (further - Internet network), performed after carrying out judicial session in record;

8) live broadcast of judicial session - broadcast of judicial session per radio, television or in Internet network, performed directly during proceeding in open court in real time;

9) partial broadcast of judicial session - broadcast of part of judicial session per radio, television or in Internet network, performed after carrying out judicial session in record.

Article 2. Coverage of this Federal Law

1. Operation of this Federal Law extends to the relations connected with ensuring access of users information to information on activity of the courts.

2. If the legislation of the Russian Federation establishing procedure for legal proceedings, power and procedure for activity of the courts, Judicial department, bodies of Judicial department, bodies of judicial community, or the legislation of subjects of the Russian Federation establishing powers and procedure for activities of magistrate judges provide other requirements to provision of information on activity of the courts, than those which are determined by this Federal Law, then provisions of this Federal Law are applied taking into account requirements of the legislation of the Russian Federation, and to information on activities of magistrate judges - also by the legislation of subjects of the Russian Federation.

3. Operation of this Federal Law extends to the relations connected with provision of information on activity of the courts to the editorial offices of mass media in the part which is not settled by the legislation of the Russian Federation on mass media.
