The protocol on temporary procedure for forming and involvement of Groups of military observers and Collective forces on peacekeeping in zones of the conflicts between the states and in the State Parties of the Commonwealth of Independent States

of May 15, 1992

State Parties of the this Protocol,

understanding need of advance practical measures on forming and involvement of Groups of military observers and Collective forces on peacekeeping of the State Parties of the Commonwealth (which are referred to as further "Group on peacekeeping") for timely and effective response to possible armed conflicts between the states and in the states of the Commonwealth,

confirming the commitment to the purposes and the principles of the Charter of the UN and fundamental documents of CSCE,

considering positive experiment and the fundamental principles of carrying out transactions of the UN on peacekeeping in the maximum degree,

being effective in pursuance of provisions of the Agreement on Groups of military observers and Collective forces on peacekeeping signed in Kiev on March 20, 1992 in the Commonwealth of Independent States,

being guided signed in Tashkent on May 15, 1992 by the Protocol on the status of Groups of military observers and Collective forces on peacekeeping in the Commonwealth of Independent States, and also the Protocol on completing, structure, material and financial provision of Group of military observers and Collective forces on peacekeeping in the Commonwealth of Independent States,

aiming to make practical contribution to preserving the civil world and interethnic concord, to promote approval within the Commonwealth of situation of the world, stability, trust and not to allow escalation of the conflicts attracting the human victims and material destructions

agreed as follows:

Article 1

The basic political decision on carrying out transaction with use of Groups on peacekeeping is made by Council of Heads of states of the Commonwealth consensus on the basis of the address of one or several state members of the Commonwealth and with the consent of all conflicting parties.

On carrying out such transaction Council of Heads of states of the Commonwealth without delay informs on the made decision the UN Security Council and the acting chairman of CSCE.

The mandate of such transaction affirms Council of Heads of states of the Commonwealth for the proposal of Ministers of Foreign Affairs of the states of the Commonwealth or their plenipotentiaries.

Article 2

Peace support operation cannot be considered as replacement of negotiated settlement, and, thus, it needs to be considered the measure limited on time.

Article 3

Each of the State Parties of the Protocol taking into account the opportunities undertakes the obligation to create and prepare for use in carrying out peace support operations the military contingents, militia (police officer) personnel, military observers who will be attracted for forming of Groups on peacekeeping after acceptance of Heads of states of the Commonwealth of the decision by Council on carrying out specific peace support operation and informs on it Council of Heads of states.

Requirement of forces and means will be determined according to tasks in each specific transaction.

The direct management for each specific transaction of Group on peacekeeping is assigned on the Commonwealth of the Commander appointed by Council of Heads of states in case of which the Integrated headquarters consisting of representatives of Armed Forces of the State Parties of the this Protocol are created. The task of the Commander of group on peacekeeping and the Integrated headquarters includes planning, expansion and management of Group on peacekeeping.

Forces and funds allocated in structure of Group on peacekeeping turn into subordination of the Commander from the moment of arrival in the area of transaction and are removed from subordination from the moment of departure from the area of transaction.

Article 4

At the request of the states coordination of activities for forming, preparation, training and material logistics of Groups on peacekeeping is performed by the deputy Glavnokomanduyushchego the Joint Armed Forces of the Commonwealth.

Article 5

The following main objectives can be assigned to Group on peacekeeping:

observation of accomplishment of conditions of truce and Cease-Fire Agreement;

designation of zones of responsibility, separation of warring parties, creation of demilitarized zones, zones of separation, humanitarian corridors, assistance of dekontsentration of forces of the parties, prevention of their movements and collisions in these zones;

creation of conditions for negotiations and other actions for peaceful settlement of the conflict, to recovery of legality and law and order and normal functioning of public and state institutes in responsibility zones;

establishment of the facts of agreement breach about ceasefire and truces and carrying out investigation on them;

control of the area and actions of the population in responsibility zone, counteraction to mass riots, assistance to ensuring human rights;

control of liquidation of fortification constructions, obstacles and minefields in responsibility zones;

protection of the vital objects in responsibility zones;

taking measures to ensuring communication between conflicting parties, safety of formal meetings between them at all levels;

control of transportations, suppression of illegal import and export of military equipment, weapon, ammunition and explosives in responsibility zones;

ensuring safe transit of all modes of transport and functioning of communications in responsibility zone;

assistance to establishing normal contacts between the population of conflicting parties in responsibility zone;

humanitarian assistance to the civilian population, ensuring free deliveries of the humanitarian assistance;

participation in accomplishment of the decision and recommendations of the UN Security Council, bodies of CSCE for peaceful settlement of the conflict.

Article 6

During transaction the Group on peacekeeping is not involved in fighting, uses first of all peaceful means and methods for assistance to settling of the conflict.

In case of accomplishment of the functions the Group on peacekeeping according to the procedure of exception has the right to use weapon:

for the purpose of safety and protection against any infringement of life and health of the military personnel and personnel of Group on peacekeeping according to the procedure of implementation of the inalienable right to self-defense;

in case of attempts of violent discharge of Group on peacekeeping from accomplishment of the functions assigned to it;

for reflection of explicit armed attack of terrorist, diversionary groups and bands, and also for their detention;

for protection of the civilian population against violent infringement of their life and health.

Article 7

The this Protocol is open for accession of any state which is not participating in the Commonwealth of Independent States. In each case the matter will be considered by the State Parties of the this Protocol.
