The agreement on legal succession concerning the Public Records Offices of the former USSR

of July 6, 1992

The State Parties of the Commonwealth of Independent States which are referred to as further the Party

recognizing that one of effects of the termination of existence of USSR is the question of legal succession concerning the Public Records Offices,

considering necessary to determine general approach to the solution of the matter,

attaching importance to creation of full-fledged archive funds of the State Parties,

agreed about the following:

Article 1

The parties, proceeding from the principle of integrity and indivisibility of the funds formed as a result of activities of the highest government institutions of the former Russian Empire and USSR which are kept in the Public Records Offices which are outside their territories do not apply for right ownerships of these complexes of documentary materials.

Article 2

The parties mutually recognize the transition performed according to their national legal system under their jurisdiction of the Public Records Offices and other archives of allied level, including the state industry archive funds of the former USSR which are in their territory.

Article 3

The parties have the right to return of those funds which were formed in their territory and at different times appeared beyond their limits.

Article 4

In case there is no possibility of physical allocation of complex of documents, each of the Parties has right of access to them and receipts of necessary copies. In case of work on identification and copying of documents for the State Parties of the Commonwealth the most favorable conditions for work are provided to official representatives of the public archive agency.

Article 5

Representatives of the public archive agencies of the Parties hold regular consultations on multilateral or bilateral basis for discussion of questions of cooperation in the field.

Article 6

The parties provide access for researchers to documents of their Public Records Offices according to the procedure established by their national legal system.

Article 7

The parties recognize legal force of the archive references issued by the public archive institutions of other State Parties of the Commonwealth in the territories.

Article 8

When any documents which are stored in the Public Records Offices of one state infringe on interests of another or other State Parties of the Commonwealth, concerned parties take additional agreed measures on use and ensuring safety of these documents and prevention of their destruction.

Article 9

The questions connected with return of documents with procedure for exchange of copies and calculations for provision of copies, in each case shall be subject of bilateral agreements.

Article 10

In cases when the Party - the owner transfers right to use of the archive documents infringing on interests of other Party, to foreign states, legal entities or physical persons, the right to use these documents remains behind the Party which interests are infringed by this document.

Article 11

The agreement becomes effective from the moment of its signing.

It is made in the city of Moscow on July 6, 1992 in one authentic copy in Russian. The authentic copy is stored in Archive of the Government of the Republic of Belarus which will send to the states which signed this agreement, its verified copy.
