The State Parties of the Commonwealth of Independent States, attaching great value to harmonious development of the relations between the State Parties of the Commonwealth,
recognizing role of international treaties of the former USSR in stabilization and further development of the relations with other states,
considering necessary to determine general approach to the solution of question of legal succession concerning the agreements of the former USSR which are of mutual interest
reached mutual understanding on the following questions:
1. Practically all multi-lateral international agreements of the former USSR are of general interest to the State Parties of the Commonwealth. At the same time these agreements do not require any joint solutions or actions of the State Parties of the Commonwealth. The issue of participation in these agreements is resolved according to the principles and rules of international law each gosudarstvomuchastnik of the Commonwealth independently, depending on specifics of each case, nature and contents of this or that agreement.
2. There is number of the bilateral international treaties of the former USSR infringing on interests of two and more (but not all) gosudarstvuchastnik of the Commonwealth. These agreements require decision making or actions from those State Parties of the Commonwealth to which these agreements are applicable. The method of negotiations and searches of mutually acceptable decisions accepted in international legal practice shall be the basis when carrying out this work.
3. Number of bilateral agreements infringes on interests of all State Parties of the Commonwealth. Boundary treaties and their mode, for example, concern to them. Such agreements according to international law shall remain in force, and only those State Parties of the Commonwealth which have adjacent border with the countries which are not members of the Commonwealth can participate in them.
Taking into account it it is important that the corresponding gosudarstvauchastnik of the Commonwealth confirmed the participation in the specified agreements.
4. In case of any questions connected with legal succession concerning agreements of the former USSR consultations between the interested states will be held. Carrying out such consultations or any other actions shall not call into question into possibility of each of the interested State Parties of the Commonwealth to independently make decisions on the participation in these or those agreements provided that these decisions will meet the conventional principles and rules of international law.
It is made in the city of Moscow on July 6, 1992 in one authentic copy in Russian. The authentic copy is stored in Archive of the Government of the Republic of Belarus which will send to the states which signed this Decision, its verified copy.
