1. Approve "Rules of provision of providing and compensations to the staff of diplomatic service" (are applied).

2. Recognize invalid the resolution of the Cabinet of Ministers of the Azerbaijan Republic "About provision of providing and compensations to the staff of diplomatic service" of February 4, 2002 as No. 20 (Collection of the legislation of the Azerbaijan Republic, 2002, No. 2, Article 99; 2004, No. 8, Article 655) and Item 2 of the resolution of the Cabinet of Ministers of the Azerbaijan Republic "About introduction of amendments and entering into some resolutions of the Cabinet of Ministers of the Azerbaijan Republic" of August 9, 2004 No. 109 (Collection of the legislation of the Azerbaijan Republic, 2004, No. 8, Article 655).

3. This resolution becomes effective from the date of signing.

Rules of provision of providing and compensations to the staff of diplomatic service

1. General provisions

1.1. These rules are prepared according to requirements of the Laws of the Azerbaijan Republic "About diplomatic service" and "About the budget system" and regulate questions in connection with financial provision of diplomatic representations and consulates of the Azerbaijan Republic (further - diplomatic representations). These rules establish provision to the staff of diplomatic service and family members living with them (the husband, the wife, children to 18-year age, disabled children are more senior than 18 years) payments and implementation of other providing during their work in diplomatic representations.

1.2. These rules extend to the persons who are carrying out administrative maintenance in diplomatic representations, and members of their families, and also sent to diplomatic representations of representatives of state bodies of the Azerbaijan Republic and members of their families.

1.3. Diplomatic representations annually with observance of requirements of the Law of the Azerbaijan Republic "About the budget system" represent to the Ministry of Foreign Affairs of the Azerbaijan Republic offers and the relevant supporting documents concerning expense budget for their content next year. These offers after the comprehensive analysis in the Ministry of Foreign Affairs go to the Ministry of Finance of the Azerbaijan Republic, and these offers are considered by preparation of expense allocation of diplomatic representations the next year.

1.4. Distribution of the means provided in the government budget for content of diplomatic representations annually affirms the corresponding order of the Cabinet of Ministers of the Azerbaijan Republic on the basis of common offerings of the Ministry of Foreign Affairs and Ministry of Finance.

Annually after approval of the government budget and approval by the Cabinet of Ministers of the Azerbaijan Republic of distribution of the means provided in the budget for content of diplomatic representations, the Ministry of Foreign Affairs with observance of requirements of the Law of the Azerbaijan Republic "About the budget system" no later than 10 days constitutes according to this distribution of expense budget of diplomatic representations for the next year and approves them, having approved with the Ministry of Finance.

1.6. Staff lists of diplomatic representations affirm the Ministry of Foreign Affairs after coordination with the Ministry of Finance and are annually represented to the Ministry of Finance till January 1.

Financing on maintenance costs of diplomatic representations is carried out by the Ministry of Finance according to the quarter distribution approved on expenses on their content within 10 days on the basis of the request submitted by the Ministry of Foreign Affairs in 20 days prior to the next quarter.

1.9. If the government budget the next year does not affirm in stipulated by the legislation time, in January of the next year the Ministry of Finance carries out financing in volume of 1/12 parts of the means planned for content of diplomatic representations next year.

Financing of diplomatic representations is performed by the Ministry of Foreign Affairs in centralized procedure within the funds allocated from the government budget by means of the State Treasury with observance of requirements of the Law of the Azerbaijan Republic "About the budget system".

1.11. The Ministry of Foreign Affairs provides rational and effective use of budgetary funds in diplomatic representations, receipt of financial statements from diplomatic representations and representation to their Ministry of Finance in accordance with the established procedure and at the scheduled time, preparation of offers on organizational, financial and other matters in connection with financial provision of diplomatic representations.

1.12. For the purpose of check of financial and economic activities of the Ministry of Finance diplomatic representations according to the schedule approved with the Ministry of Foreign Affairs carries out regular audits. If the diplomatic representation timely does not submit the financial statement, the Ministry of Finance and the Ministry of Foreign Affairs can carry out extraordinary inspection in this diplomatic representation.

1.13. The financial resources allocated to diplomatic representations from the government budget shall be used for designated purpose, and the remaining balance unused by the end of the year shall be returned to initial source. Officials bear responsibility according to the procedure, established by the law, for proper use of the financial resources allocated to diplomatic representation.
