Regulations on procedure for customs clearance of the goods which are conditionally issued according to customs regime "Release for free circulation"

(as amended on 13-08-2015)

This Provision is developed according to the Law of the Republic of Uzbekistan "About the State Customs Service" and the Customs code of the Republic of Uzbekistan.

I. General provisions

1. Conditional release - transfer by customs authorities of the goods and vehicles which passed customs clearance in the order of person integrated to obligations about observance of the set restrictions, requirements or conditions.

In case of conditional release goods and vehicles are under customs control.

Use of conditionally released goods in other purposes than in what conditional release was performed, is not allowed.

2. Conditional release of goods can be applied to goods which customs clearance is made according to customs regime "release for free circulation (import)":

necessary in case of natural disasters, accidents, catastrophic crashes, and also in case of construction and reconstruction of especially important objects, carrying out symposiums, conferences, exhibitions, doctrines, implementation of urgent seasonal reaping actions, etc.;

when importing live animals, perishable products, the radioactive materials requiring special storage conditions, messages and other materials for the purposes of mass information, goods sent to the address of the supreme bodies of the legislative, executive and judicial authorities of the republic Uzbekistan as the humanitarian assistance;

requiring special conditions and requirements of storage, application and use;

in the absence of separate documents (except for certificate of conformity, licenses and allowing documents of other state bodies) and data. At the same time for conditional release of the goods allowed to customs clearance without submission of the certificate of conformity availability of such certificate it is not required.

II. Implementation of conditional release of goods

3. Conditional release of goods is performed only in case of possibility of carrying out customs control over use and the order by the imported goods at any time only in those purposes in what conditional release is performed.

5. For customs clearance of conditionally issued goods are represented:

consumption rates of goods in case of use in case of natural disasters, accidents, catastrophic crashes, and also in case of construction and reconstruction of especially important objects, carrying out symposiums, conferences, exhibitions, doctrines, implementation of urgent seasonal reaping actions, etc.;

transport (delivery note depending on mode of transport) and consignment (invoice) documents.

At the same time the customs clearance, including electronically, is performed in the presence of the data on customs payment (except for case of provision of delay or payment by installments of customs payment) on personal account of the payer in the Single automated information system of the State Customs Committee of the Republic of Uzbekistan represented from the servicing banks (treasuries) and allowing documents of other authorized bodies.

8. Conditional release cannot be provided if at person:

there are no documents and data specified in Item 5 of this provision or doubtful documents and the information are provided;

there are goods which are earlier drawn up on conditional release, the term of submission of the cargo customs declaration on which expired;

debt on customs payment and penalty fee on them, percent for provision of delay or payment by installments on these payments, and also penalties for customs offense is had.

III. Customs clearance, accounting and control of conditionally released goods

9. The customs clearance of conditionally issued goods is made on customs post in which region of activities there is their receiver, on two-stage basis:

at the first stage the incomplete cargo customs declaration is submitted to customs post (further - NGTD);

at the second stage in case of conditional release the complete cargo customs declaration is submitted to customs post (further - GTD).

Representation of NGTD and GTD, and also the documents necessary for customs clearance can be performed in paper or electronic form, with confirmation by the digital signature.

In case of this NGTD shall contain the main data necessary for the customs purposes.

Collection for customs clearance is levied before acceptance or along with acceptance of complete GTD.

11. NGTD is filled according to the procedure for filling of the cargo customs declaration operating concerning customs regime "release for free circulation" taking into account the following features:

a) in the first subsection of the column 1 "Declaration Type" the alphabetic ND index - the incomplete cargo customs declaration is specified;

b) in the last two figures of column 37 the code - "36" is specified;

c) ceased to be valid according to the Resolution registered by the Ministry of Justice of the Republic of Uzbekistan of 30.05.2013 No. 1404-4

d) the column 50 after the words "Bears Responsibility for the Provided Data..." is supplemented with the words "I Promise to Provide GTD to " __" ____ 200_g.".

12. For the purpose of carrying out customs control the customs post surely keeps the "Accounting of NGTD of Conditional Release" magazine.

13. The customs post controls terms of provision of GTD and use of conditionally released goods only in those purposes in what they were issued.

At the same time submission due date of GTD cannot exceed two months from the date of registration of NGTD.
