ORDER OF THE MINISTER OF CULTURE AND INFORMATION OF THE REPUBLIC OF KAZAKHSTAN

About approval of Rules of employee assessment of the state organizations of culture

(as amended on 03-12-2013)

According to Article 233 of the Labor code of the Republic of Kazakhstan and with article 7 of the Law of the Republic of Kazakhstan of December 15, 2006 "About culture" for the purpose of determination of level of professional and qualification training, business qualities of employees of the state organizations of culture of PRIKAZYVAYU:

1. Approve the enclosed Rules of employee assessment of the state organizations of culture.

2. To department of administrative and legal work in accordance with the established procedure:

1) to direct this order to state registration in the Ministry of Justice of the Republic of Kazakhstan;

2) to provide official publication of this order after its state registration.

3. To impose control of execution of this order on the vice-minister supervising questions of culture.

4. This order becomes effective from the date of its official publication.

Rules of carrying out employee assessment of the state organizations of culture

1. General provisions

1. These rules of carrying out employee assessment of the state organizations of culture (further - Rules) are developed according to Article 233 of the Labor code of the Republic of Kazakhstan of May 15, 2007 and with article 7 of the Law of the Republic of Kazakhstan of December 15, 2006 "About culture" and determine procedure for carrying out employee assessment of the state organizations of culture (further - cultural workers).

2. In these rules the following basic concepts are applied:

employee assessment of culture - the procedure which is carried out for the purpose of determination of compliance of skill level of the employee of the state organization of culture to qualification requirements;

employee representatives - bodies of labor unions, their associations and (or) other representatives workers physical and (or) legal entities.

3. The main evaluation criterion in case of certification is employees ability to carry out the job responsibilities assigned to them, including for establishment of increase in the corresponding category.

4. Certifications are subject all cultural workers, except for expectant mothers, after each next three years, but not earlier than six months from the date of the occupation of this position.

The cultural workers who are on child care leave are certified not earlier than in six months after appearance at work.

Cultural workers based on the statement for the purpose of increase in category on post can undergo early certification. Requirements to qualification of separate positions of specialists of public institutions and state companies, general for all fields of activity, are regulated by Article 125 of the Labor code of the Republic of Kazakhstan, and also the order of the Minister of Labour and Social Protection of the population of the Republic of Kazakhstan of September 27, 2012 No. 378-o-m "About approval of qualification characteristics of separate positions of specialists of public institutions and state companies, general for all fields of activity" (No. registered in the Ministry of Justice of the Republic of Kazakhstan on October 15, 2012 8011).

5. Certification includes the following consecutive stages:

1) preparation for carrying out certification;

2) carrying out certification (interview, viewing, listening);

3) decision of certifying commission.

2. Preparation for carrying out certification

6. Preparation for carrying out employee assessment of culture will be organized by personnel service of the certifying organization for the order of his head and includes the following events:

1) schedule development of carrying out certification;

2) determination of structure of certifying commission;

3) the organization of explanatory work about the purposes and procedure for carrying out certification.

7. The personnel service once within six months determines the cultural workers who are subject to certification according to item 4 of these rules.

8. The head of the organization for representation of personnel service accepts the order which affirm the list of the certified persons, the schedule of carrying out certification and structure of certifying commission.

9. The personnel service in writing notifies employees on terms of carrying out certification no later than month prior to its carrying out.

10. The direct head of the employee who is subject to certification draws up the office characteristic and sends it to personnel service.

11. In the office characteristic reasonable, objective assessment of professional, personal qualities and results of office activities of the certified worker is reflected.

12. The personnel service informs the worker of the office characteristic submitted on him not later than three weeks prior to meeting of certifying commission in time.

13. In case of the worker's disagreement with the office characteristic provided on it he declares it in writing in personnel service with appendix of information characterizing it.

14. The personnel service sends to certifying commission concerning each certified cultural worker the following documents:

1) office characteristic;

2) personal leaf on registration of personnel;

3) autobiography;

4) the copy of the diploma about education;

5) copies of documents on passing of professional development course for the last three years (in case of their availability);

6) copies of documents on availability of academic degree, rank (in case of their availability);

7) the copy of the service record or other document confirming labor activity of the worker.

15. On the worker who is subject to certification, the personnel service draws up the appraisal sheet on the cultural worker (further - the appraisal sheet) in form according to appendix 1 to these rules.

16. The personnel service directs collected certification materials to certifying commission.
